HomeMy Public PortalAboutResolution 85-1219 PCRESOLUTION NO. 85 -1219 PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING ZV 85 -773 AND MZM 85 -166. THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. Based upon a Public Hearing for a zone variance for a reduced setback from 5 feet to 4 feet, .from the Easterly property line and from 15 feet to 5 feet from the Southerly pro- perty line, -to build a second story addition at 5421 Baldwin Ave - nue; and, to determine the front yard of said lot, .the Planning Commission finds: A. That there are exceptional or extraordinary circum- stances or-conditions applicable to the property involved or to the intended use of such property, which do not generally apply toother properties in the same zone as follows: 1) The size of the lot is less than the minimum. Code standards; The orientation.of lots and need for a common easement /drive; and, The orientation of the single family residence . and relationship to other uses in the area. B. That such Variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed . by other property similarly situated, but which is denied to the property in question since to comply with Code standards would result in less open space and a higher lot coverage for the site. C. That the granting of the Variance will not be mat- erially detrimental to the public welfare or injurious to the adjacent property as the development will not result in negatively impact on adjacent properties. D. That there are special circumstances as provided in Section 65906 of the California Government Code. SECTION 2. Accordingly, said Variance is approved, subject to the following conditions: 1. Development shall take place substantially as indi- cated on the plans submitted, labeled Plans A, B, and C. 2. Applicant shall submit plans for checking and ap- proval prior to issuance of building permits. . Once construction has commenced, all work shall be completed within one year of the commencement date. " " RESOLUTION NO. 85 -1219 PC 4. Except as specifically modified by this Variance, all other applicable Zoning Ordinance requirements shall be met. 5. This Variance shall be null and void unless exer- cised within a period of one year from and after the date of adoption of the Resolution granting the zone variance. 6. The applicant shall file a Certificate of Accept- ance of conditions within 30. days and prior to filing plans for building permits. SECTION 3. The North property line is determined to be the front yard. SECTION 4. The Secretary shall certif to the adoption of this Resolution.
