HomeMy Public PortalAbout08-10-1998 Regular Session . . . 474 MINUTES HILLSBOROUGH TOWN BOARD August 10, 1998 7:30 PM, Town Barn The Hillsborough Town Board held a regular meeting on August 10,1998 at 7:30 PM in the Town Barn. Present for the Board Meeting were Mayor Horace H. Johnson, Sr., Commissioners Richard Simpson, Catherine Martin, Frances Dancy, Kenneth Chavious, and Evelyn Lloyd. Staff Present were Town Manager Eric Peterson, Planning Director Margaret Hauth, Town Engineer Tom Hartye, Police Chief Nathaniel Eubanks, Code Enforcement OfficerlFire Inspector Todd Chavious, and Town Clerk Donna Armbrister. Mayor Horace H. Johnson, Sr., called the meeting to order at 7:35 PM. I. PUBLIC CHARGE Mayor Horace Johnson read the Public Charge. II. ADDING ITEMS TO THE PRINTED AGENDA Town Manager Eric Peterson requested to table Item X.B. until next month. The Board agreed. Commissioner Martin updated the Board on the success of the Tarwheels Bikefest Event which was held last weekend. Martin expressed the Tarwheels' appreciation to the Town Staff for their assistance. III. AUDIENCE COMMENTS A. Matters on the printed agenda Lester Marlow requested to address the Board regarding the new water and sewer rates. He was added to the Agenda as Item VI.A. Michael Alexander also requested to speak on the water and sewer rates. He was added to the Agenda as Item VI.B. Don d' Ambrosi requested to address the Board regarding Items XI D & F. Myron Martin requested to address the Board regarding Items VI and XI.D.a & b. Linda Quigley requested to address the Board regarding Item IV. 1 . . . 475 B. Matters not on the printed agenda There were no audience comments. IV. Lynn Sykes wishes to address the Board concerning the condition of neighboring property Lynn Sykes appeared before the Board regarding the condition of the property at 208 Brownville Street. Mr. Sykes cited several health concerns and the presence of foul odor, rats, and snakes. This property is located beside Mr. Sykes home. Linda Quigley also appeared before the Board citing the same concerns. Ms. Quigley is the neighbor living on the other side of 208 Brownville Street. Code Enforcement OfficerlFire Inspector Todd Chavious reported to the Board that he has been working on this property since June of 1997 when he issued the property owner a notice of violation. Chavious said that he had personally taken roll-out containers to the home and had the Town's Street Superintendent mow the right of way by the house. Earlier this year he attempted to serve a final notice of violation which the property owner refused to sign. Chavious has contacted Adult Services to obtain assistance for the property owner. In July he spoke with the property owner's attorney and was told that the attorney would no longer represent her. Chavious reported that he had spoken with Adult Services again today and was told that the property owner is now willing to meet with him and Adult Services to discuss the violations and remedies. V. Cindy Defoor will address the Board concerning the Special Olympics World Games Cindy Defoor spoke to the Board regarding the Special Olympics Host City Program. She explained that they are building a Committee in Hillsborough to host delegates and asked the Board for any suggestions for volunteers. The Board agreed to review the Special Olympics materials Ms. Defoor presented and make their recommendations to the Town Manager to pass on to her. Mayor Johnson suggested that the Town take the delegation to lunch and asked the Manager to make the appropriate arrangements. VI. Melinda Phillips will address the Board regarding Water/Sewer Rates Melinda Phillips did not attend the meeting. ADDED ITEM VI.A. Lester Marlow Lester Marlow appeared before the Board outlining the impact the new water and sewer rate increase is having on his Laundromat business. He told the Board that this increase will put him out of business and he relies on this business to support two children in college. 2 . . . 476 ADDED ITEM VI.B Michael Alexander Michael Alexander also expressed his concerns with the rate increase. Town Manager Eric Peterson presented a letter he had received from Mr. and Mrs. Terry L. Muntz outlining their displeasure with the water and sewer rate increase. Myron Martin addressed the Board regarding the rate increase and explained that several of the people in his development are elderly, some are sick, and most live on fixed incomes who cannot pay the fees. Town Manager Peterson responded to citizen concerns admitting that a 23% rate increase is quite a bit of money. Manager Peterson explained that the Town has incurred over $550,000 in new debt over the last year and a half. Of the total water/sewer budget of 3.8 million dollars, over 1 million of that is for debt. Peterson stated that the current system has an old water plant and an old sewer plant with old lines which are continually breaking and in need of repair. He add that the Reservoir Project is 1.4 million dollars over budget. Lester Marlow inquired about the possibility of a reduced rate for his business due to the volume of water consumed. Mayor Johnson suggested that he meet with the Town Manager in his office to discuss this possibility. VII. APPROVAL OF THE MINUTES OF THE JULY 13TH. 1998 TOWN BOARD MEETINGS AND THE JULY 28TH, 1998 PUBLIC HEARING Upon a motion by Commissioner Lloyd, seconded by Commissioner Dancy, the Board moved to approve the Minutes of the July 13th, 1998 Town Board Meeting and the July 28th, 1998 Public Hearing with the correction of adding Commissioner Dancy's name as being present at the July 28th meeting by a vote of 5-0. The motion was declared passed. VIII. REPORT FROM THE TOWN MANAGER Town Manager Eric Peterson reminded the Board that he would not be present at the September Board Meeting. Manager Peterson informed the Board that he has appointed Finance Director Sherry Carter as Acting Town Manager in his absence. IX. REPORT FROM THE TOWN ENGINEER Town Engineer Tom Hartye gave a status report on all current water and sewer projects. 3 . . . 4 '77 X. ITEMS FOR DECISION -- CONSENT AGENDA A. Approve Resolution Updating the List of Employees Authorized to Drive Town Vehicles Home Town Manager Peterson presented the Resolution for the Board's consideration. Upon a motion by Commissioner Lloyd, seconded by Commissioner Martin, the Board moved to approve the Resolution Updating the List of Employees Authorized to Drive Town Vehicles Home as presented by a vote of 5-0. The motion was declared passed. A copy of the Resolution is hereby made a part of these Minutes as an Attachment. B. Approve Contract and Memorandum of Agreement with Robert Odell Mayo for Pump Station Easement This Item was tabled until the September meeting. XI. ITEMS FOR DECISION -- REGULAR AGENDA A. Consideration of an Ordinance amending Chapter 12 of the Town Code transferring responsibility for the issuance of burning permits and collection of burning permit fees from the Town Clerk and Deputy Town Clerk to the Town's Code Enforcement Officer/Fire Inspector Planning Director Margaret Hauth presented the Ordinance to the Board for their consideration. Upon a motion by Commissioner Simpson, seconded by Commissioner Dancy, the Board moved to approve the Ordinance amending Chapter 12 of the Town Code transferring responsibility for the issuance of burning permits and collection of burning permit fees from the Town Clerk and Deputy Town Clerk to the Town's Code Enforcement Officer/Fire Inspector as presented by a vote of 5-0. Consideration of Police Officer (Canine Handler) Position Description Manager Peterson presented the Position Description to the Board. Upon a motion by Commissioner Simpson, seconded by Commissioner Dancy, the Board moved to approve the Police Officer (Canine Handler) Position Description as presented by a vote of 5-0. The motion was declared passed. 4 . . . jll :: 478 Police Chief Nathaniel Eubanks reported that Community Policing Officers Bigelow, Harward, Davis, and Jacobs are now completely outfitted for bike patrol. Chief Eubanks told the Board they might even see him riding on bike patrol. C. Consideration of Annexation Ordinance for Parrish Tract Consisting of Two Separate Parcels ofland (A 7.75 acre tract and a 100 acre tract). Planning Director Margaret Hauth presented the Annexation Ordinance for the Board's consideration. Upon a motion by Commissioner Simpson, seconded by Commissioner Lloyd, the Board moved to approve the Annexation Ordinance for Parrish Tract Consisting of Two Separate Parcels of land (A 7.75 acre tract and a 100 acre tract) as presented by a vote of 5-0. The motion was declared passed. A copy of the Ordinance is hereby made a part of these Minutes as an Attachment. D. Consideration of ordinances to amend the Zoning Map as follows: a) Request from Centex Homes to zone 117.75 acres Residential-l0.TM 4.45.3&25 Planning Director Hauth presented the zoning request for the Board's consideration. Myron Martin appeared before the Board stating that there was not a map available showing the proposed water and sewer lines at either the Public Hearing or the Planning Board meeting. James Tucker with Centex addressed the Board stating that it is their intent to create a nice community that will not adversely impact other residents. Upon a motion by Commissioner Simpson, seconded by Commissioner Lloyd, the Board moved to approve the Ordinance to amend the Zoning Map to zone 117.75 acres (TM 4.45..3& 25) Residentia1-1O by a vote of 4-1 with Commissioners Simpson, Lloyd, Dancy, and Chavious voting Aye, and Commissioner Martin voting Nay. The motion was declared passed. A copy of the Ordinance is hereby made a part of these Minutes as an attachment. b) Request from Elam, Todd, d' Ambrosi (design firm) to rezone 58.18 acres in the southwest quadrant of the I-85/NC 86 interchange from General Commercial to High Intensity Commercial. TM 4.45..4c. Planning Director Hauth presented the rezoning request for the Board's consideration. Myron Martin expressed concerns with the traffic problems this will cause. 5 . . . t.,. 479 Don d' Ambrosi addressed the Board stating this rezoning also gives the flexibility of restaurants, hotels, and large assemblies (i.e., movie theaters, or sports arenas, etc.) Upon a motion by Commissioner Martin, seconded by Commissioner Dancy, the Board moved to approve the Ordinance to amend the Zoning Map to rezone 58.18 acres (TM 4.45..4c) in the southwest quadrant ofthe I-85/NC 86 interchange from General Commercial to High Intensity Commercial by a vote of 5-0. The motion was declared passed. A copy of the Ordinance is hereby made a part of these Minutes as an Attachment. c) Request from Tredmont, Inc. to rezone 5 acres from Office Institutional to Agricultural Residential. TM 4.38.B.17. Planning Director Hauth presented the rezoning request for the Board's consideration. Upon a motion by Commissioner Martin, seconded by Commissioner Dancy, the Board moved to approve the Ordinance to amend the Zoning Map to rezone 5 acres from Office (TM 4.38.B.17) Institutional to Agricultural Residential by a vote of 5-0. The motion was declared passed. A copy of the Ordinance is hereby made a part of these Minutes as an Attachment. E. Consideration of an Ordinance to amend the Subdivision Regulations to add Section 4.4.3 to require the provision of sidewalks during the development of all new subdivisions. Planning Director Hauth presented the Ordinance for the Board's consideration. After much discussion, this Item was tabled to the September meeting. F. Consideration of a Preliminary Subdivision Plan for Granville Centre, an 8 lot commercial subdivision between South Churton and Mayo Streets. (TM 4.40.A.41) Planning Director Hauth presented the Preliminary Subdivision Plan for Granville Centre. Upon a motion by Commissioner Simpson, seconded by Commissioner Lloyd, the Board moved to approve the Preliminary Subdivision Plan for Granville Centre, an 8 lot commercial subdivision between South Churton and Mayo Streets. (TM 4.40.A.41) as presented by a vote of 5-0. The motion was declared passed. G. Approval of fee schedule and policies for Level I Fire Code Enforcement Planning Director Hauth presented an Ordinance amending Chapter 12, Section 12-23 of the Town Code to include policies for Level I Fire Code Enforcement and a Resolution Authorizing the Level I Fire Inspection Fee Schedule. 6 . . . 480 Upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd, the Board moved to approve the Ordinance amending Chapter 12, Section 12-23 of the Town Code to include policies for Level I Fire Code Enforcement and a Resolution Authorizing the Level I Fire Inspection Fee Schedule as presented by a vote of 5-0. The motion was declared passed. A copy of the Ordinance and Resolution are hereby made a part of these Minutes as Attachments. H. Discuss recommendation to Orange County to fill a Hillsborough Township vacancy on the Parks and Recreation Advisory Board Town Manager Peterson informed the Board that he had received via the Internet a volunteer application from Heather Clark indicating her desire to serve in the area of Parks. The Board directed the Town Clerk to contact Ms. Clark and ask if she wishes the Town to recommend her to Orange County to fill a Hillsborough Township vacancy on the Parks and Recreation Advisory Board. I. Consideration of an Ordinance to amend Chapter 4, Section 4-7 of the Town Code to include the positions of Development Coordinator and Police Officer Canine Handler to Occupational Groups Town Manager Peterson presented the Ordinance to the Board for their consideration. Upon a motion by Commissioner Dancy, seconded by Commissioner Martin, the Board moved to approve the Ordinance to amend Chapter 4, Section 4-7 of the Town Code to include the positions of Development Coordinator and Police Officer Canine Handler to Occupational Groups as presented by a vote of 5-0. AN ORDINANCE ANNEXING CERTAIN CONTIGUOUS PROPERTY WHEREAS, a petition was received requesting the annexation of the Hurley I. Parrish Jr. and Ruth Cook Woods properties; WHEREAS, the petition was signed by the owners of all the real property located within such area; and WHEREAS, a public hearing on the annexation was held on July 28, 1998 following notice of such hearing published in the News of Orange on July 15 and July 22, 1998. NOW, THEREFORE, THE BOARD OF COMMISSIONERS FOR THE TOWN OF HILLSBOROUGH ORDAINS: Section 1. The Board of Commissioners finds that a petition requesting the annexation of the area described in Section 2 was properly signed by the owners of all the real property located within such area and that such area is contiguous to the boundaries of the town of Hillsborough, as the term "contiguous" is defined in G.S. 160A-31(f). Section 2. Section .3.- The Zoning Map of the Town of Hillsborough is hereby amended to rezone the 5 acres owned by Tremont, Inc. on the northwest side of the Exchange Club Park (part oftax map 4.38.B.17) from Office Institutional to Agriculture-Residential. Armbrister, Town Clerk . , . . , 488 AN ORDINANCE AMENDING SECTION 12-23 OF THE TOWN CODE OF THE TOWN OF HILLSBOROUGH THE BOARD OF COMMISSIONERS OF THE TOWN OF HILLS BOROUGH ORDAINS: Section 1. Section 2. Section 3. Section 4. Section 5. Section 12-23, paragraph (a) is amended by deleting the second sentence and replacing it with the following: The amount of the fee for Level I inspections is included in the Town's adopted fee schedule. The amount of the fee for Level II & III inspections shall be equal to the amount charged to the Town of Hillsborough by Orange County for performing this inspection on behalf of the Town, plus an additional 10% in the case of inspections made within the corporate limits of the Town and an additional 20% with respect to inspections made within the Town's extraterritorial planning jurisdiction. Paragraph (b) is amended to changed the payment due date from ten days to fifteen days. Paragraph (c) is to be re-Iettered to (d) and the following added as paragraph (c): The inspection fee is due regardless of whether the premises is in compliance with the Fire Prevention Code.
