HomeMy Public PortalAboutOrd. 13-20Mrbin anU No. 13-27 II1 t 19 Jarjaug4 laf garb 1, Ya J, Councilman Presents the following Ordinance Seconded by Councilman AMENDING & SUPPLEMENTING CHAPTER 160, ENTITLED LAND DEVELOPMENT, OF THE CODE OF THE BOROUGH OF CARTERET BE IT ORDAINED by the Mayor and Council of the Borough of Carteret ( "the Borough ") that the Code of the Borough is hereby amended and supplemented as follows: Section 1. Article VII, "Subdivision Regulations" is hereby amended and supplemented as follows: §160- 47(A). Sketch Plat shall be amended to read as follows: Any owner of land within the Borough of Carteret, prior to subdividing or resubdividing land, as defined in this chapter, shall submit to the Secretary of the appropriate approving authority, at least 14 days prior to a regular meeting of the Board, eight copies of a subdivision plat prepared in accordance with § 160 -68, together with eight copies of the subdivision application form for classification purposes. The provision of this Article VII concerning subdivision regulations shall not apply to the Borough of Carteret, its assignees, agencies and instrumentalities, the municipality being exempt from all such requirements. The secretary of the approving authority, at the time of filing the sketch plat, shall immediately mark it "filed," put a date on each copy and issue an application number. Once an application has been assigned a number, such number shall appear on all documents, maps and plats submitted for processing in conjunction with the subdivision. Section 2. Article VIII, "Site Plan Review" is hereby amended to read as follows: §160 -54(G) Exemptions shall be amended to read as follows: G. Site plan review shall be required for all other uses, including use of a vacant parcel, except that the Borough of Carteret, its assignees, agencies and instrumentalities shall not be required to obtain any type of site plan review or approval. 3, Article XVI, "Zoning" is hereby amended and supplemented thereof, as follows: Supplement §160 -123. Applicability of District Regulations is hereby amended and supplement to add new Subsection G to read as follows: G. 'The regulations set by this Chapter shall not be applicable to the Borough of Carteret, its assignees, agencies and instrumentalities. NO. 13tn2Q PAGE 2 Of 2 Section 4. All Ordinances or parts thereof inconsistent with the provision of this Ordinance are hereby repealed limited to the extent of any such inconsistency. Section 5. If any section, paragraph, subdivision, clause or provision of this Ordinance is adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of this Ordinance shall be deemed valid and effective. 6.
