HomeMy Public PortalAbout2273-1967 - Zoning - Clasification of Beauty ShopORDINANCE NO. 2273-1967 AN ORDINANCE AMENDING ORDINANCE NO. 1472-19539 CON-IONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHNOND, INDIANA APPROVED APRIL 219 1953. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. WHEREAS, Ordinance No. 1472-1953 commonly known as the Zoning Ordinance of the City of Richmond, Indiana, and charts made a part thereof, designate and describe certain Contingent Uses which are likely or liable, but not certain, to occur and which are not inappropriate to the principal use of the district in which they are located, and WHEREAS, it has been found by experience that many beauty shops have been located in residential districts even though they are not classified as a Contingent Use, and WHEREAS, it is the intent of this amendment to rectify this situation by classifying existing beauty shops located in residential districts as a Contingent Use. NOW THEREFOREs SECT}ON II. It is hereby ordained that Chart 5 "Contingent Uses" shall be amended so as to include the following uses: BEAUTY SHOP located in any residential district provided such beauty shop is licensed by the State of Indiana Beauty Culture Examiners and further provided that such beauty shop existed prior to the effective date of this amendment regardless of the number of operators employed or amount of or type of arti- cles sold or offered for sale, which are incidental to the operation of beauty culture. BEAUTY SHOP Located Within a Residence, after the effective date of this amendment shall be deemed to be a Contingent Use provided the following conditions are met: 1. Such beauty shop shall only be operated by an owner -occupant who holds a valid license issued by the State of Indiana Board of Beauty Culture Examiners. 2. Nit more than one (1) assistant employed. 3. No more than one room or twenty-five (25%) percent of the gross floor area of one floor of said residence, whichever is less, shall be used for such beauty shop. Use of attached or detached accessory buildings for this purpose is excluded. 4. One non -illuminated sign not to exceed one (1) square foot in size and mounted flush against the front wall or in the front window is permitted. 5. No article not incidental to the practice of Beauty Culture is sold or offered for sale. 6. No structural changes are permitted which would alter the residential character of the exterior of the residence. SECTION III. This Ordinance shall be in full force and effect from and after its passage, approval by the Mayor and publication as by law required.
