AN ORDINANCE AUTHORIZING THE ALIENATION AND CONVEYANCE OF REAL PROPERTY BELONGING TO THE CITY OF RICHMOND, INDIANA. WHEREAS, the City of Richmond, Indiana, is the owner of the following described real estate in Wayne County,:Indiana, to -wits A tract of land located in SE. 1/4 Sec. of Sec. 8; Twp. 13-N; Range.2W; in the City of Richmond, Wayne County, Indiana, and more particularly described as followss Beginning at the Southeast corner of the Southeast 1/4 of Sec. 8; thence North along the East line of said Sec. 8 eight hundred forty-seven and ninety-five hundredths (847.95) feet; thence West one hundred twenty-five and eight tenths (125.8) feet to the East right-of-way line of US Highway 27; thence Southwestwardly on a CO - 59' minute curvej. on the East right-of-way line of said US Highway.27 and the West line of this tract eight hundred and fifty-six and eight tenths (856.8) feet to the South line of Sec. 8; thence East two hundred and seventeen and fifty-four hundredths (217.54) feet to the point of be inning. Containing three.and thirty-four hundredths (3.34}3 acres more or less. Subject to a thirty foot (3011) easement for street right-of-way along South 9th Street? Subject also to sewer easement, and, WHEREAS, said real estate has been appraised by three disinterested freeholders of said city appointed by the Judge of the Wayne Circuit Court, and that said real estate was appraised at $9,000.00; and, WHEREAS, the City of Richmond, Indiana by its Board of Public Works and Safety has accepted a written offer to purchase said real estate executed by A.L.T., Inc. at and for the sum of $9,000.00; that said offer is the only bona fide offer of not less than the appraised value made to said city and said offer is not less than the full appraised value thereof. NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, SECTION 1. That the Mayor of the City of Richmond, Indiana, is hereby authorized and empowered to convey in the name of the City of Richmond, Indiana, by Warranty Deed, the 8bove described real estate to A.L.T., Inc. in consideration of the payment by said A.L.T., Inc. of the sum of 59,000.00 to said City of Richmond; and said conveyance shall be attested by the City Clerk with the Seal of the City of Richmond. Said conveyance shall be made subject to and upon the following covenants and restrictions, to -wits No billboard, sign board, or advertising sign of any kind shall be placed, erected or maintained on the above described real estate save and except for signs advertising the usage to be made of said premises by the owner thereof, which signs shall not have a larger Surface area than 30 quare feet. Said Covenants and re- strictions shall be covenants running with the land and shall be binding upon said A.L.T., Inc., its successors and assigns. SECTION 2. This ordinance shall be in full force and effect from and after its passage and approval by the Mayor. PASSED and ADOPTED by the Common Council of the City of Richmond, Indiana, this.- — day of 1967.
