3. CITY PARK IRRIGATION PROJECT
Comments: Ten requests for proposals for the automated
irrigation system in City Park were mailed and Three (3)
proposals were submitted: A.H.B. Associates $30,000.00,
Wilson, Inc., Sheehan & Associates $13,700.00, and
Williamson, Morris & Associates $10,000.00.
Recommendation: That City Council approve the proposal of
Williamson, Morris & Associates for the automated
irrigation system in Lynwood City Park and authorize the
Mayor to execute the agreement for these services.
4. SECOND READING OF AN ORDINANCE ENTITLED: "AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF LYNWOOD ESTABLISHING A CITY -WIDE
PARKING AND BUSINESS IMPROVEMENT AREA IN THE CITY OF LYNWOOD
AND ADDING SECTION 17 -58 TO THE LYNWOOD MUNICIPAL CODE ".

Comments: A. Salary schedule needs to be amended to include
part -time Planning Technician.
B. Acting Department Head needs authorization to
hire the Planning Technichian help as either
temporary employee or as a consultant or as a
combination of both.
7. PUBLIC HEARING: ON ANNEXATION NO. 3 -A.
Comments: The continuation of a hearing opened on November
19, 1985. Some testimony was taken on the 19th, however,
several people are awaiting their chance to speak.

SUBJECT: APPROVAL OF PROPOSAL FOR DESIGN OF AUTOMATIC IRRIGATION SYSTEM
IN LYNWOOD CITY PARK
Objective
Approval of proposal for design portion of City Park Automatic Irrigation
Project.
Facts:
The design and installation of a fully automated irrigation system is one of
the projects in the 1985 -86 Capital Improvement Budget. Funds for this
project are derived from the 1980 California Parklands Act in the amount
of $134.248.00. On September 6, 1985, a letter was sent from the Recreation
and Parks Department to ten (10) consultants, soliciting their interest in the
project. Six (6) of those consultants expressed an interest in the project and
were invited to a briefing on October 25, 1985. Three (3) of the six (6) con-
sultants invited to the meeting have submitted proposals for the design of
a fully automated sprinkler system in City Park.
As the estimated cost to install the system throughout the entire park is
$400,000.00, the proposals requested and received also include: Establishment
of a phase development design for future installations. The three (3) consultants
submitting proposals were:

Conclusion
The design and installation of an automated irrigation system in City Park
will be a valuable asset for present and future park maintenance programs. Funds
available through the State Parkland Act enable the City to begin the project
and establish a development plan for future installations. The firm of
Williamson, Morris 6 Associates, which has submitted the low proposal is a
very reputable firm in the field of parks design and development. They have
completed many projects for the City of Lynwood in the past, including the design,
development and construction of John D. Ham Park, rehabilitation of the Community
Center, and Natatorium, remodeling of City Park restrooms, picnic shelters and
tennis court lighting.
Recommendation
City Council approve the proposal of Williamson, Morris S Associates for design
and development of an automated irrigation system in Lynwood City Park and
authorize the Mayor on behalf of the City to enter into an agreement to provide
these services.

ORDINANCE NO.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD ESTABLISHING A CITY -WIDE PARKING
AND BUSINESS IMPROVEMENT AREA IN THE CITY OF
LYNWOOD AND ADDING SECTION 17 -58 TO THE
LYNWOOD MUNICIPAL CODE.
The City Council of the City of Lynwood does hereby ordain
as follows:
Section 1. That the City Council of the City of Lynwood
hereby fin s�termines and declares as follows:
(a) That pursuant to Section 36500 et seq. of the
Streets and Highways Code of the State of Calif-
ornia, the City Council adopted, on May 21, 1985,
that certain Resolution No. 85 -58 entitled: "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD DECLARING ITS INTENTION TO ESTABLISH A
CITY -WIDE PARKING AND BUSINESS IMPROVEMENT AREA
IN THE CITY OF LYNWOOD", and caused said Re-.
solution to be duly published and mailed, as
provided by law;
(b) That a Public Hearing concerning the formation
of, said City -Wide Parking and Business Improve-
ment Area ?(hereinafter "Area ") was held on
June 18, 1985 and was continued to July 16, 1985
at the hour of 7:30 p.m. in the City Hall Council
Chamber of the City Hall of the City of Lynwood;
(c) That at said Hearing all written and oral protests
made or filed were duly heard, evidence for an
against the proposed action was received, and a
full, fair and complete Hearing was granted and
held;
(d) That all protests, both written and oral, were
duly overruled and it was determined by the
Council that there was no majority protest with-
in the meaning of said Streets and Highways Code,
Section 36500 et seq.;
(e) That the public interest, convenience and ne-
cessity require the establishment of the pro-
posed Area;
(f) That businesses conducting their activities with-
in the Area will benefit by the expenditure of
funds raised by the charges, as contemplated by
said Saction 36500, et seq.
Section 2 . ESTABLISHMENT OF AREA. Pursuant to Section
36500 et seq. of the Streets and Highways Code of the State of
California, a Parking and Business Improvement Area of the City of
Lynwood is hereby created and established.
Section 3. DESCRIPTION OF AREA. The Area shall include
all of the te rr tory within the exterior boundaries of the City of
Lynwood as same exist on the date of adoption of this Ordinance.

Section 4. SYSTEM OF CHARGES. This Ordinance adds Section
17 -58 to the Lynwood Municipal Code:
(a) In addition to the Business License Tax imposed
upon businesses regularly established in the
City in the classifications described Division 3,
Section 17 -57, there is hereby imposed an addi-
tional Business License Tax in an amount equal
to fifty percent (50 %) of the Business License
Tax otherwise imposed upon such businesses;
(b) Payment of Charge. The charge hereby levied
shall be due and payable and shall be paid at
the same time and in the same manner that the
Business License imposed by the City Code is
due and payable;
(c) Payment Pre- requisite to License:
No Business License shall be issued pur-
suant to the Lynwood Municipal Code unless
the Business License charge hereby imposed
is paid together with the Business License
payable pursuant to said Code; and
(2) A Business License shall be considered
unpaid and penalties shall be assessed
upon the total amount, at the rate speci-
fied in Article II, Division 3, Section
17 -56 of the Municipal Code, until such
time as both the Business License Tax and
the charge are paid.
(d) Refusal to Pay Charge. No person shall fail or
refuse to pay tea ditional Business License
Charge imposed;
(e) Statement of Charge Due. A written statement,
on such forms as may e required or furnished
by the City Manager, shall be filed when the
charge is paid.
Section 5. Voluntary Contribution. Any business which is
exempt from t e payment o the charge by reason of the provisions of
the Constitution of the United States, or the State of California,
may make voluntary contributions to said Area for the purposes pro-
vided in this Ordinance.
Section 6. Use of Revenues. Uses of revenues derived
from charges imposed pursuant to this Ordinance shall be limited to
the following:
(a) The acquisition, construction, or maintenance of
parking facilities for the benefit of the Area;
(b) Decoration of any public place in the Area;
(c) Promotion of public events which are to take place
on or in the Area;
(d) Furnishing of music in any public place in the Area;
(e) The general promotion of business activities in
the Area.
Section 7. Accounting of Fds. The City shall create
a special revenue category into whic
E the charges levied under this
Ordinance shall be placed. The City Council shall annually approve
a Budget which includes an estimate of the expenditures to be made
from the City -wide Parking and Business Improvement Area assessment.
Section 8. Amendments. Businesses within the Area es-
tablished by tTOrdinance shall be subject to any amendments to
Section 36500 et seq. of the Streets and Highways Code.

Section 9. Effective Date. This Ordinance shall apply to
Business License taxes levied for the calendar year 1986 and each
year thereafter, and the additional charges imposed by this
Ordinance shall be due and payable from January, 1986.
Section 10. If any section, sentence, clause or phrase of
this Ordinance is, for any reason, held by a court of competent
jurisdiction to be invalid, such decision shall not affect the validity
of the remaining portions of this Ordinance. The City Council of
the City of Lynwood hereby declares that it would have passed, and
does hereby pass, this section and each sentence, section, clause
and phrase hereof, irrespective of the fact that any one or more
sections, sentences, clauses, or phrases be declared invalid or
unconstitutional.
Section 11. That the City Clerk shall certify to the adoption
of this Ordinance and cause the same to be published in the manner
prescribed by law.
Section 12. The City shall certify to the adoption of this
Ordinance and cause the same to be published in the Lynwood Press,
a newspaper of general circulation, printed, published and circulat-
ed in the City of Lynwood.
First read at a regular meeting of the City Council of said
City held on the 'day of 1985, and finally
adopted and ordered pub at a meeting of said
Council held on the day of 1985, by the following

SUBJECT: MORATORIUM ON ISSUANCE OF BUILDING PERMITS
FOR NEW MULTI - FAMILY DEVELOPMENT IN THE R -2
AND R -3 ZONES
PU RPOSE :
The purpose of this item is to discuss_the.
on the issuance of building permits for new multi- family
development in the R -2 and R -3 zones and accept public
testimony relating to land use within those zones.
ANALYSIS
1. Pursuant to Government Code sections 36934 and 65858
the current moratorium will complete the initial
forty -five (45) day period on November 29, 1985.
Prior to or on this date the moratorium may be
extended for a time period of ten (10) months and
fifteen (15) days. If not extended the moratorium
will expire.
2. Because of inadequate noticing of the meeting on
this date, it is suggested that the Council allow
the moratorium to expire and continue the public
discussion on development in the R -2 and R -3 zones
until the next regular City Council meeting on
December 3, 1985.
3. At the meeting on November 25, 1985, the Council
may wish to establish a workshop for the purpose
of discussing further and in greater detail,
development of multi - family housing in the R -2 and
R -3 zones.
4. The Council may wish to direct staff as to the area
to be noticed prior to the workshop (either the
area easterly of Atlantic Avenue or Citywide) and
the content of the discussion as to land use, zoning
and development standards.
RECOMMENDATION
1. The Council accept testimony from the public;
2. The Council establish a date for a workshop;
3. The Council continue the item and discussion
to the regular meeting on December 3, 1985.
