WHEREAS the CITY OF RICHMOND, INDIANA, hereinafter referred to as "Grantee," on or about
December 17, 2014 acquired a parcel of real estate and/or interests therein from John T. Myers, Trustee of
Bartlemay & Associates, Inc. Profit Sharing Pension Plan, hereinafter referred to as "Owner", which real estate
is located in Wayne County, Indiana. The acquisition is further identified and described in Parcel Number 6,
6A, 613, under Project 1173174, in the Manor Drive Project Plans of the CITY OF RICHMOND, INDIANA; and
WHEREAS, Grantee has subsequently determined that the initial acquisition failed to compensate the
Owner for fence relocation; and
WHEREAS, the Owner has petitioned INDOT for additional compensation for cost to cure the above
mentioned damages; and
WHEREAS, Grantee has agreed to pay the sum of five thousand seven humdred ($5,700.00) as
additional compensation to the Owner as reimbursement for cost to cure the fence relocation; and

WHEREAS, the Owner for themselves, their heirs, and assigns, agree(s) to accept said sum as full,
complete and adequate compensation for any and all claims, damages, and recompense due the Owner, their
heirs, and assigns, caused by or arising out of or in any way related to Project 1173174; and
WHEREAS, the Owner, their heirs, and assigns, covenant that in accepting said sum and conditions,
forever relinquishes all future claims and legal rights it may have in regard to and arising out of or in any way
related to Project 1173174 and agrees to save and hold harmless Grantee from same; and
WHEREAS, this agreement shall inure to the benefit of the CITY OF RICHMOND, INDIANA, and is
binding upon the Owner, their heirs, legal representatives, assigns, and successors in interest.
NOW THEREFORE, for the consideration above stated, the payment of same being hereby
acknowledged, the Owner herein sets their hand and seal to this agreement hereby agreeing to, and in all ways
accepting and binding themselves to the terms and conditions set forth hereinabove and hereby so ever.
The undersigned represents and warrants that he is the Trustee of the Bartlemay & Associates, Inc.
Profit Sharing Pension Plan that pursuant to the Trust Agreement he has full authority to manage the affairs of
said Trust and sign and execute documents on its behalf and that said authority has not been revoked, and that
he is therefore fully authorized and empowered to convey to the City of Richmond real estate of the Trust, and
that on the date of execution of said conveyance instruments he had full authority to so act.
