Simmons : Last October 1 , 1993 you executed and recorded two deeds respectingthe above three lots , which deeds have caused some measure of confusion in the assessor ' s office and in the planning department . I enclose copies of the two deeds and of aportion of the plat . It appears that you conveyed to yourselves three strips of land on the northerlyedge of each of the three lots . The assessor is tempted g to tax you on six lots . If you intended to adjust the location of the lot lines between these three lots , the deeds used did not accomplish that purpose. The first-recorded deed evidences that "Gary Simmons , DDS Employee Retirement Trust" conveyed what it did not own , namelythe north six feet of Lot 23 , to Gary & Janet who we believe already owned it . That deed also conveyed the north six feet of Lot 22 to Gary & Janet , which they did not before then own , and which part of that deed may have accomplished something. The second-recorded deed evidences that "Gary Simmons , DDS Employee Retirement Trust" then conveyed what it no longer owned , namelythe north threey g feet of Lot 22 , to Gary & Janet , who already owned it and the next northerly three feet also , under the first-recorded deed . The second -recorded deed also evidences that "Gary Simmons , DDS Employee Retirement Trust" conveyed to itself what it alreadyy Y owned , namely the north three feet of Lot 21 . Possibly we may be forgiven for being a little confused . To forestall the assessor ' s doing something expensive to you , you maywish to immediately p avail yourself of knowledgeable local counsel to straighten out what you have done . Partnership of McCall , Valley County , Idaho , hereinafter called the partnership , WITNE S SETH : WHEREAS , the Partnership is subdividing certain parcels of land in the SW 1 / 4 NW 1 / 4 of Section 10 , Township .A North ,, Range 3 East , E . I1 . , in McCall , Idaho , known or to be known as Timberlost VI Subdivision , which subdivision borders upon Fairways No . 6 and 6 of the McCall Municipal Golf Course owned by the City ; WHEREAS , to properly develop and provide services for said subdivision it is necessary and desirable for the partnership to construct , install and maintain a sewer line and sewer pump and appurtenances upon , over and across said golf course fairways ; and YALREAS , attached hereto as Exhibit " A " and by this reference made a part hereof , is a preliminary plat of said Timberlost VI Subdivision , showing the boundaries of such subdivision , the fairways an': the proposed sewer line which such proposed sewer line is shown as a broken red and black line on such Exhibit " A " ; and WHEREAS , actual instae_ iation of such sewer line may vary from the center line thereof as shown on said Exhibit " A " in order to avoid trees and other natural objects . NOW ,. _ - 1[ REFOPE , in consideration of the mutual covenants and agreements hereinafter set forth , the parties do hereby agree as EASEMENT AGPEEMENT 4 follows : 1 . That the City hereby grants to the P' arrit. ership the right to enter upon and construct , maintain , operate and repair a sewer line upon , over and across the premises herein described , and to install a sewer pump station and appurtenances , if any , as aa.mx be ✓ equired to properly operate such sewer line , all of which shall be done and performed pursuant to City specifications . 2 . That such easement shall consist of a permanent easement e xtending 6 feet on either side of such center line as shown on said plat , together with a. temporary construction easement e xtending 15 feet on each side of such center line and further , that such easement may vary in order to miss, and avoid trees and o ther natural objects and monuments to be preserved to enhance the appearance of and play of golf upon such fairways . 3 . The partnership specifically agrees that such sewer line pump station and appurtenances , spill be installed , constructed and maintained so as to cause minimal damage to the surface of the ground and that such easement shall be restored to the appearance thereof prior to the commencement of construction . 4 . That the Partnership shill complete the installation of such sewer line and the cleanup and restoration of such premises prior to 4 I i V40 1990 . cP// 5 . The Partnership agrees to indemnify and save harmless the City from any and all claims for damage that may be made against the City by John P . Drips , under that certain McCall huicipal Golf Course Management Contract dated the 6th day of April , 1990 , by and between the City of TeCall and Cohn P . Drips , together with EhtEhPPh hddEEMEd 1 eh court costs and attorney fees for def ending any action that may be brought against the City . 6 . That the Partnership agrees to indemnify and hold harmless the City from any and all damages , claims or liability that may be asserted by patrons of the 1'icCall golf course which may be alleged to be caused by the conduct and activity of the Partnership in the installation of such sewer line , pump station and appurtenances , together with court costs and attorney fees in defending against the same . 7 . That upon completion of the installation of said sewer line , sewer pump station and other appurtenances , if any , the Partnership shall furnish to the City a center line survey of said sewer line as the same is constructed and that the City shall e xecute and deliver to the partnership an easement extending 6 feet on either side of said established sewer line for the purpose o f reconstruction , maintenance , operation and repair of such sewer line , which easement shall expire at such time as said sewer line : pump station , and appurtenances are accepted by the City for maintenance and operation as a part of the City sewer system . 8 . Prior to or coincidentally with the acceptance by the City o f the maintenance and operation of said sewer line , the Partnership shall furnish to the City a. permanent easement and ✓ ight of way for surer line construction , reconstruction , maintenance and operation , upon , over and across the premises of the Partnership situate , lying and being between Fairways No . 6 and 66 of the hcball golf course , as shown on said Exhibit " A " .
