Subject: Declaration of State of Emergency – Tropical Storm Eta
The purpose of this Letter to Council (LTC) is to inform you that on November 7, 2020 at
6:00 PM, I declared a State of Emergency for the Village of Bal Harbour relative to the
forecasted potential landfall of Tropical Storm Eta in Southern Florida.
On November 10, 2020, at 6:00 PM, after determining that the conditions leading to or
causing the emergency no longer existed, I terminated the State of Emergency.
An item has been placed on the November 17, 2020 Regular Council Meeting Agenda for
your ratification of my declaration and termination of the State of Emergency due to
Tropical Storm Eta.
Attached are the Declaration and the Termination orders for your review.

BAL HARBOUR
- VILLAGE -
BAL HARBOUR VILLAGE DECLARATION OF A STATE OF EMERGENCY
WHEREAS, as of 10:00 AM on November 7, 2020, the National Hurricane Center reported
Tropical Storm Eta was located 45 miles west-northwest of Grand Cayman Island in the
northwestern Caribbean Sea; and
WHEREAS, Tropical Storm Eta has maximum sustained winds of 50mph and is expected to
strengthen as it approaches the Florida Keys;
WHEREAS, the National Weather Service predicts Tropical Storm Eta will affect southern
Florida with significant rainfall, in some areas up to 15 inches of rain; and
WHEREAS, the National Hurricane Center has issued Tropical Storm Watch or Warnings as
well as a Hurricane Watch for South Florida; and
WHEREAS, the National Weather Service has issued Flood Watches for Broward, Collier,
Glades, Hendry, Indian River, Martin, Miami -Dade, Monroe, Okeechobee, Palm Beach and St.
Lucie Counties; and
WHEREAS, there is a risk of severe flooding, strong winds, storm surge, hazardous seas and
potential for isolated tornadic activity for portions of southern Florida; and
WHEREAS, Tropical Storm Eta poses a severe threat to Southeast Florida and requires that
timely precautions are taken to protect the Bal Harbour Village to include public health, safety,
welfare and critical infrastructure of the Village;
WHEREAS, the threat posed by Tropical Storm Eta requires that timely precautions are
taken to protect the communities, critical infrastructure, and general welfare of Florida; and as a
result, Governor Ron DeSantis declared a state of emergency on November 7, 2020; and
WHEREAS, due to the same severe weather conditions, Mayor Carlos Gimenez declared a
Local State of Emergency for Miami -Dade County on November 7, 2020; and
WHEREAS, as the Bal Harbour Village Manager, I am responsible to mitigate the dangers
presented to the Village and its people by this emergency;
NOW, THEREFORE, 1, JORGE M. GONZALEZ, as the Bal Harbour Village Manager, by virtue of
the authority vested in me by Chapter 252.38(3)(a) Florida Statutes and Bal Harbour Village Code of
Ordinances Article VIII. EMERGENCY MANAGEMENT (as detailed therein).
Section 1: I declare a state of emergency exists for Bal Harbour Village.
Section 2: Pursuant to this Declaration, further orders may be issued to protect the health,

BAL HARBOUR VILLAGE TERMINATION OF A STATE OF EMERGENCY
WHEREAS, on November 7, 2020, at 6 PM, Bal Harbour Village Manager Jorge M.
Gonzalez, declared a State of Emergency for the Village of Bal Harbour relative to the
forecasted potential landfall of Tropical Storm Eta in Southern Florida; and
WHEREAS, this Declaration of State of Emergency activated the emergency plans
applicable to the Village and automatically invoked emergency measures listed in Florida
Statutes 870.044, as provided therein; and
WHEREAS, as of Tuesday, November 10, the potential destructive effects of Tropical Storm
Eta due to severe wind and flooding, resulted in manageable impact to Village residents
and property; and
WHEREAS, the streets and roadways in the gated residential District, Collins Avenue,
Harding Avenue from 96th Street to Haulover Bridge are intact, unobstructed and passible
to vehicles and pedestrians; and
NOW, THEREFORE, I, JORGE M. GONZALEZ, as the Bal Harbour Village Manager, by
virtue of the authority vested in me, given the conditions leading to or causing the
emergency by Tropical Storm Eta no longer exist and the Village's departments are able
to manage the situation without extraordinary assistance provided by the State of
Emergency established under Florida Statutes 870.041 through 870.046; and pursuant to
Bal Harbour Village Code, Article III Emergency Management, Section 2-355 Termination
of State of Emergency, shall hereby be terminated on November 10, 2020 at 6PM.
