SANITARY SEWER EASEMENT

THIS INDENTURE, made this 17 1Z day of necerr'Ikia- 198 % ,
between GORDON REED RAY and DELORES T. RAY, husband and wife, the
parties of the first part, hereinafter called the Grantors, and
the City of McCall, a municipal corporation of the State of
Idaho, situated in Valley County, Idaho, P.O. Box 1065, McCall,
Idaho 83638, the party of the second part, hereinafter called
Grantee,
W I T N E S E T H:
W HEREAS, The City of McCall has obtained a grant from the
State of Idaho to replace old and defective sanitary sewer lines,
install manholes and install domestic sewer service lines in a
✓ esidential area in the Northeast portion of the City of McCall,
the same to be financed by a grant from the State of Idaho
Community Development Block Grant Program under Grant No.
ICBG-85-COMP-III-35; and
W HEREAS, the Grantors desire to provide easements and
✓ ights -of -way across the premises hereinafter described for the
purposes herein set forth.
N OW THEHEFOREs in consideration of the sum of ONF DOLLAR,
($1.00) to them in hand paid, the receipt whereof is hereby
acknowledged, and in further consideration of the benefits to be
✓ eceived by the Grantors, by the construction of said sewer
lines, the Grantors hereby give, grant and convey to the Grantee,
its successors and assigns, easements and rights -of -way for
sewer service pipes, on, under, through, and across the premises
herein after described, together with the right to construct,
maintain and repair underground pipelines and of service pipes
for the purpose of conveying sewage, together with the right to
e xcavate and refill ditches and/or trenches for the location of
said sewer pipelines.
The land affected by this easement and right-of-way is
situated in McCall, Valley County, Idaho, and is described as
follows:
A tract of land in the SE1/4NE1/4 of Section 9, Township 18
North, Range 3 East B.M. Valley County Idaho, more
particularly described as follows:

Beginning at the Northwest corner of said SE1/4NE1/4;
thence South approximately 482.375 feet to a point;
thence East 39.5 feet across a dedicated street to
the real point of beginning;
thence East 295.25 feet to a point;
thence North 147.625 feet to a point;
thence East 295.25 to a point on a dedicated street
thence South along the West boundary of said dedicated
street 147 625 feet to a point;
thence West approximately 240 25 feet to a point on the
North boundary of a dedicated street•
thence West along the North boundary of said dedicated
street 110 5 feet, more or less, to a point;
thence North 75 feet to a point;
t hence West 240.0 feet to a point on a dedicated street;
t hence North along the East boundary o: said dedicated
street 73.813 feet to the real point of beginning.
Said easements and rights -of -way cover three individual
strips of land over and across the above premises, each of which
lies five (5) feet on each side of the following described
centerlines, to -wit:
SERVICE LINE NO. 1
Commencing at the northwest corner of said SE1/4 NE1/4;
thence SOUTH 498.78 feet to a point;
thence N 89°44'58" E 229.43 feet to a point on the existing
sewer line and the POINT OF BEGINNING;
thence S 0°04'33' E 57.23 feet to a point on the southerly
boundary of Payette Lakes Trailer Court and the POINT OF
TERMINATION.
SERVICE LINE NO. 2
Commencing at the northwest corner of said btll/ 4 iNE1/ 4;
thence SOUTH 498.78 feet to a point;
thence N 89°.44'58" E 333.79 feet to a point on the existing
sewer line;
thence N 55°22'25" E 31.41 feet to a point on the existing
sewer line and the POINT OF BEGINNING;
thence S 65°03'42" E 33 22 feet to a point on the boundary
line of Payette Lakes Trailer Court and the POINT OF
TERMINATION.
SERVICE LINE NO. 3
Commencing at the northwest corner of said SE1/4 NE1/4;
thence SOUTH 498.78 feet to a point;
thence N 89°44'58" E 333.79 feet to a point on the existing
sewer line;
thence N 55°22'25" E 106.21 feet to a point on the existing
sewer line;
thence N 87°34'30" E 76 59 feet to a point on the existing
sewer line and the POINT OF BEGINNING;
t hence S 0°15'27' W 48 65 feet to a point on the boundary of
P ayette Lakes Trailer Court and the POINT OF TERMINATION.
Said easements also are contiguous to, and connect to, an
easement granted for the purpose of constructing, operating and
maintaining a sanitary sewer main as recorded at the Valley
County
Recorders office, Valley County, Idaho, Instrument Number 155114.

TO HAVE AND TO HOLD, all and singular the said premises,
together with the appurtenances, unto the said Grantee and to its
successors and assigns forever.
This grantshall be effective as long as said easement shall
be actually used for the purposes above specified, and all rights
hereunder granted shall revert to the owners of the land when
said use shall have been abandoned and discontinued for a term of
five (5) years or longer.
The Grantee shall at, all times have the right to enter upon
the lands hereinabove described for the purpose of constructing,
repairing and maintaining
doing as little damage as
said
sewer pipes, mains and conduits,
possible.
