ABATEMENT PROGRAM OF 4043 BEECHWOOD AVENUE
Comments:
The Weed Abatement Program consists of the removal of weed
from properties within the City and the collection of the cost
of said work through a special assessment. On October 16,
1990, the City Council adopted Resolution 90 -174 setting
the date for a public hearing on the weed abatement program
for 4043 Beechwood Avenue.
Recommendation:
It is recommended that the City Council hold a public hearing
and approve a resolution entitled: "A Resolution Passing Upon
Objections and Directing the Director of Public Works to
Abate the Nuisance of Dry and Drying Weeds that Exist at 4043
Beechwood Avenue in the City of Lynwood."
11. PUBLIC HEARING: TO CONDUCT A PUBLIC HEARING FOR WEED
ABATEMENT PROGRAM OF 11168 POPE AVENUE
Comments:
The Weed Abatement Program consists of the removal of weed
from properties within the City and the collection of the
lost of said work through a special assessment. On October
16, 1990, the City Council adopted Resolution 90 -174 setting
the date for a public hearing on the weed abatement program
for 11168 Pope Avenue.

Recommendation:
It is recommended that the City Council hold the public
hearing and adopt the attached resolution determining that a
nuisance is being maintained at the subject property and
directing the abatement of the nuisance.
12. PUBLIC HEARING: APPEAL OF RAYMUNDO SANCHEZ, CONDITIONAL USE
PERMIT, CASE NO. 60 (APPEAL NO. 2)
Comments:
The applicant is appealing a decision of denial by the
Planning Commission for Conditional use Permit, Case No. 60,
to sell beer and wine at an established restaurant located at
10136 Long Beach Boulevard in the C -3 (Heavy Commercial)
zone.
Recommendation:
It is recommended that the City Council sustain the City
Planning Commission decision of denial of Conditional Use
Permit, Case no. 60.

Comments:
City Council hear matter and direct staff accordingly.
CONSENT CALENDAR NOTICE
All matters listed under the Consent Calendar will be acted upon
by one Motion affirming the action recommended on the agenda.
There will be no separate discussion on these items prior to
voting unless members of the Council or staff request specific
items be removed from the Consent Calendar for separate action.
14. INFORMAL BID PROCESS FOR THE CITY HALL ELECTRICAL SYSTEM
UPGRADE
Comments:
The existing City Hall electrical system is overloaded. In
order to adequately and safely provide electrical power, the
system needs to be upgraded. Due to the nature and its small
size, the work can be done more effective and economically
through an informal bid process.
Recommendation:
It is recommended that the City Council adopt the attached
resolution approving the City Hall electrical upgrade be done
through an informal bid.

15. REQUEST TO ADD AN ADDITIONAL CODE ENFORCEMENT OFFICER IN THE
CODE ENFORCEMENT DIVISION BUDGET OF THE COMMUNITY DEVELOPMENT
DEPARTMENT
Comments:
To request City Council approval to add an additional Code
Enforcement Officer position in the Code Enforcement Division
of the Community Development Department.
Recommendation:
Staff respectfully recommends that, after consideration, the
City Council adopt the attached resolution providing a new
Code Enforcement Officer position, appropriating funds and
amending the fiscal year 1990 -91 Budget.
16. REQUEST TO ALLOW THE INFORMAL BID PROCESS TO PURCHASE
PLAYGROUND EQUIPMENT FOR VARIOUS CITY PARK LOCATIONS
Comments:
The City of Lynwood Recreation and Parks Department has
received forty six thousand nine hundred forty six dollars ($
46,946.00) to purchase playground equipment at various city
park locations. One of these locations (Birch Street
Playground area in Dymally Park) will become a Pepsi Play
Park.
Recommendation:
Staff respectfully requests that the City Council, through
the adoption of the attached resolved, authorize staff to
purchase the playground equipment through the informal bid
process.
17. PHASE II IRRIGATION PROJECT MERVYN M. DYMALLY CONGRESSIONAL
PARK
Comments:
Staff is pursuing design and installation of Phase II of
Mervyn M. Dymally Congressional Park automated irrigation
system.
Recommendation:
Council authorize staff to enter negotiations with D.D.
Pagano Irrigation for design and specification of Phase II
automatic irrigation system in Mervyn M. Dymally
Congressional Park.

Recommendation:
It is recommended that the City Council approve the Warrant

the lives of more than 22,000 Americans each

WHEREAS, Every gear, about 534,000 people suffer
�i injuries in alcohol- related traffic crashes. About 40,000
of these are serious injuries; and

youthful fatalities are alcohol- related; and
WHEREAS, WADO(Rathers Against Drunk Driving) is inviting Americans to
"Cie One On For Safety" bq participating in Project Red Pibbna, a national halidag
public awareness carpaign. Bg tying a red ribbon to a visible location on their

vehicles, Americans can show their commitment to driving saber this holiday season
and throughout the gear; and
MHEREAS, December 9 -15, 1990 has been designated as Patinnal Drunk ant
Drugged Driving Awareness Week; and

WHEREAS, the United $fates Conference of Wagors is calling upon all
cities to join in a national mobilisation that will raise our citizens' awareness
of the threat posed bg drunk driving.

PURPOSE
To identify parcels within the City limits that are in need of
weed removal and direct City crews to remove said weeds pursuant
to Section 39501 -39588 of the Government Code.
FACTS
o Each year the City is involved in a weed abatement program
which consists of the Street Maintenance crews removing weeds
from properties within the City limits and then collecting the
cost of said work through a special assessment.
o The subject property was identified to pose a nuisance of dry
and drying weeds, and the owner was contacted by the City Code
Enforcement Department. Since the owner refused to have his
property cleaned up, this property is including in the
program.
o On October 16, 1990, Council approved and adopted Resolution
No. 90 -174 (see Attachment A) that established a public
hearing on November 20, 1990 , for the purpose of allowing all
persons having objections to the proposed work to have an
opportunity to be heard.
o The property owner, identified on Resolution No. 90 -174,
has been notified by mail of the Public Hearing
(see Attachment B).
RECOMMENDATION
Recommend that the City Council approve the attached resolution
entitled: "A RESOLUTION PASSING UPON OBJECTION AND DIRECTING THE
DIRECTOR OF PUBLIC WORKS TO ABATE THE NUISANCE OF DRY nun nDvTmT

to be removed, and he and his assistants are hereby expressly
authorized to enter upon private property for that purpose.
BE IT FURTHER RESOLVED that any property owners shall
have the right to have any such nuisance removed and abated at
his own expense, provided such work is done prior to the time
that work is done by the Director of Public Works. If the work
is done by the property owner, no charge shall be made by the
City of Lynwood.
This resolution shall take affect immediately upon its
adoption.

RESOLUTION NO. 90,174
RESOLUTION OF INTENTION TO ABATE DRY AND DRYING
WEEDS ON CERTAIN PARCELS OF LAND IN THE CITY OF
LYNWOOD
WHEREAS, Chapter 13 of the Government Code, cited as
"Weed and Rubbish Abatement," provides for abatement of dry and
drying weeds, stubble, brush, litter, or other flammable
material, that constitute a Public Nuisance; and
WHEREAS, it has been brought to the attention of the
City Council of the City of Lynwood by the Director of Public
Works that there exists a public nuisance on certain parcels of
land in the City of Lynwood, as hereinafter more particularly
described.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Lynwood, as follows:
1. That by reason of dry and drying weeds, stubble,
brush, litter or other flammable material being located on or in
front thereof, a public nuisance exists upon the parcel of land,
lot or portions of lots set forth below:
Tract 7984; Portion of Lot 326 (11168 Pope)
Tract 15016; Lot 75 (4043 Beechwood)
2. That said weeds are hereby found and declared to be
seasonal and recurrent nuisances;
3. That said weeds and /or stubble, brush, litter, or
other flammable material which endangers the public safety by
creating a fire hazard, constitute a public nuisance which must
be abated by the removal thereof and that if the same are not
removed by the owner of the aforesaid property, the nuisance will
be abated by the City and the cost thereof assessed upon said --
properties and that upon confirmation, such costs will constitute
lien thereon until paid;
4. That the Director of Public Works is directed to
cause said notices to be posted in the time, form and manner
required by law;
5. That the proceedings for aforesaid work shall be
taken under an Act of the Legislature of the State of California
designated as the Government Code, Chapter 13, Section 39501, et
seq., cited as "Weed and Rubbish Abatement", and amendments
thereto.
6. Notice is hereby given that on the 20th day of
November, 1990, Tuesday, at the hour of 7:30 p.m., in the Council
Chambers, City Hall, 11330 Bullis Road, in the City of Lynwood,
any and all persons having any objections or protests to said
proposed work may appear before said City Council and show cause
why said proposed work should not be carried out in accordance
with said Act.
7. This resolution shall take effect immediately upon
its adoption.

The City Council at its meeting of October 16, 1990,
adopted a resolution of its intention of abating seasonal
and recurrent weeds and nuisances on parcels and /or adjacent
parkways within the corporate limits of the City of Lynwood.
In an effort to provide personal notification to all owners
of said properties, we are also mailing this notice to you.
The resolution of intention further indicates a public
hearing will be held at 7:30 p.m. on Tuesday, November 20,
1990, in the Lynwood City Council Chambers on this matter.
Your name has been obtained from the most recent Assessor's
Rolls as the legal owner of parcels of land within the City
of Lynwood upon which or adjacent to parkways upon which
seasonal and recurrent weeds and nuisances exist. The
purpose of the public hearing will be to hear arguments for
and against the adoption of said resolution. It is
anticipated that the City upon adoption of such resolution,
will proceed with the abatement and removal of all nuisances
throughout the City.
It is anticipated work will be done by City forces and each
lot or adjacent parkway abatement will have its own charge
based upon material, time and equipment needed. Should you
have any questions regarding this matter or any of these
particulars, please feel free to call me for further
clarifications.

RESOLUTION NO. 90 -174
RESOLUTION OF INTENTION TO ABATE DRY AND DRYING
WEEDS ON CERTAIN PARCELS OF LAND IN THE CITY OF
LYNWOOD
WHEREAS, Chapter 13 of the Government Code, cited as
"Weed and Rubbish Abatement," provides for abatement of dry and
drying weeds, stubble, brush, litter, or other flammable
material, that constitute a Public Nuisance; and
WHEREAS, it has been brought to the attention of the
City Council of the City of Lynwood by the Director of Public",'.;:
Works that there exists a public nuisance on certain parcels'
land in the City of Lynwood, as hereinafter more particularly
described.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Lynwood, as follows:
1. That by reason of dry and drying weeds, stubble,
brush, litter or other flammable material being located on or in
front thereof, a public nuisance exists upon the parcel of land,
lot or portions of lots set forth below:
Tract 7984; Portion of Lot 326 (11168 Pope)
Tract 15016; Lot 75 (4043 Beechwood)

2. That said weeds are hereby found and declared to be
seasonal and recurrent nuisances;
3. That said weeds and /or stubble, brush, litter, or
other flammable material which endangers the public safety by
creating a fire hazard, constitute a public nuisance which must
be abated by the removal thereof and that if the same are not
removed by the owner of the aforesaid property, the nuisance will
be abated by the City and the cost thereof assessed upon- said —
properties and that upon confirmation, such costs will constitute
lien thereon until paid;
4. That the Director of Public Works is directed to
cause said notices to be posted in the time, form and manner
required by law;
5. That the proceedings for aforesaid work shall be
taken under an Act of the Legislature of the State of California
designated as the Government Code, Chapter 13, Section 39501, et
seq., cited as "Weed and Rubbish Abatement ", and amendments
thereto.
6. Notice is hereby given that on the 20th day of
November, 1990, Tuesday, at the hour of 7:30 p.m., in the Council
Chambers, City Hall, 11330 Bullis Road, in the City of Lynwood,
any and all persons having any objections or protests to said
proposed work may appear before said City Council and show cause
why said proposed work should not be carried out in accordance
with said Act.
7. This resolution shall take effect immediately upon
its adoption.

The City Council at its meeting of October 16, 1990,
adopted a resolution of its intention of abating seasonal
and recurrent weeds and nuisances on parcels and /or adjacent
parkways within the corporate limits of the City of Lynwood.
In an effort to provide personal notification to all owners
of said properties, we are also mailing this notice to you.
The resolution of intention further indicates a public
hearing will be held at 7:30 p.m. on Tuesday, November 20,
1990, in the Lynwood City Council Chambers on this matter.
Your name has been obtained from the most recent Assessor's
Rolls as the legal owner of parcels of land within the City
of Lynwood upon which or adjacent to parkways upon which
seasonal and recurrent weeds and nuisances exist. The
purpose of the public hearing will be to hear arguments for
and against the adoption of said resolution. It is
anticipated that the City upon adoption of such resolution,
will proceed with the abatement and removal of all nuisances
throughout the City.
It is anticipated work will be done by City forces and each
lot or adjacent parkway abatement will have its own charge
based upon material, time and equipment needed. Should you
have any questions regarding this matter or any of these

SUBJECT: Appeal of Raymundo Sanchez on Conditional Use Permit
No. 60 (CUP 60) to sell beer and wine.
Purpose
The applicant is appealing a decision by the Planning Commission
denying Conditional Use Permit, Case No. 60, to sell beer and
wine at a restaurant located at 10136 Long Beach Boulevard in the
C -3 (Heavy Commercial) zone.
Background
At its regular meeting on September 27, the Site Plan Review
Committee evaluated the project and recommended approval to the
Planning Commission, subject to established conditions and
requirements. On October 9, 1990, the City Planning Commission
denied the request based on information submitted by the
Sheriffs Department.
Facts
1. Ordinance No. 1306 of the Lynwood Municipal Code requires
that a conditional use permit be obtained in order to
operate any establishment selling alcoholic beverages for
on -site consumption.
2. Section 25 -16.40 of the Code allows bona fide restaurants to
be closer than five - hundred feet from other restaurants, and
less then 150 feet from residential uses, schools, churches,
hospitals, clinics or other health facilities, health
facilities, and public parks.
3. The City Planning Commission, in denying the request for a
conditional use permit, based its decision on the following
findings:
A. The layout of the existing restaurant
does not allow for adequate monitoring of
patron activity and consumption of
alcoholic beverages.
B. The hours of operation for the restaurant
8:00 a.m. to 10:00 p.m., would lend
itself to allow for a higher increase and
concentration of the sale of alcoholic
beverages during evening hours, a
dangerous time for patrons who have been
drinking and must drive upon leaving the
restaurant.

ISSUES AND ANALYSIS
The subject use, a 1,822.5 square foot restaurant, was developed
as a part of a 11,492.5 square foot retail center containing
forty -two (42) parking spaces (per Site Plan Review approval No.
87011). The restaurant has seating for forty -four (44) patrons
and features Mexican Cuisine.
Upon investigation of the subject site, it was observed that
approximately twenty -eight (28) seats in the restaurant could not
be easily monitored by employees stationed at the front of the
restaurant.
The appellant has stated that the request to sell beer and wine
is necessary to support the restaurant business.
The appellant further states that the following should be
considered leading to approval of the request:
1. There are no other establishments in the immediate vicinity
of the subject site that offers alcoholic beverages to the
public.
2. There are no sensitive uses, such as school, parks,
churches, or playgrounds in the vicinity.
3. Ample parking, forty -two (42) parking spaces within the
retail shopping center, are available.
4. The existing use is consistent with the existing zoning
classification of C -3' (Heavy Commercial) zone.
5. Long Beach Boulevard is adequate to carry any additional
traffic generated by the restaurant.
6. The proposed use, selling beer and wine, meets the distance
requirements as set by Ordinance No. 1306, Section 25- 16.40,
On -Sale Alcoholic Beverage Establishments.
7. Approval of this request will upgrade the commercial use of
the property.
8. Beer and wine would not be sold between opening hours and
eleven 11 a.m. as discussed during the Planning Commission
meeting on October 9, 1990.
However, the Planning Commission denied the request as a result
of the testimony from the Sheriffs Department.

WHEREAS, the Planning Commission of the City of Lynwood,
pursuant to law, held a public hearing on subject application;
and
WHEREAS, the Commission has carefully considered all
pertinent testimony offered at the public hearing; and
WHEREAS, the Community Development Director has determined
that the proposal is exempt from the provisions of the State CEQA
Guidelines, Section 15061 b(3) as amended; and
WHEREAS, the project is consistent with the General Plan in
that the subject site is designated "Commercial" on the General
Plan Map; and
WHEREAS, the restaurant is located in the C -3 (heavy
commercial) zone and may sell alcoholic (beer and wine)
beverages, subject to the granting of a Conditional Use Permit.
The Planning Commission of the City of Lynwood does hereby
resolve as follows:
Section•l. The Planning Commission of the City of Lynwood
finds and concludes as follows:
A. That the granting of the proposed Conditional Use
Permit will not adversely affect the General Plan.
B. That the proposed location of the Conditional Use is
in accord with the objectives of the Zoning Ordinance
and the purpose of the zone in which the site is
located.
C. That the proposed location of the Conditional Use and
the conditions under which it would be operated or
maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious to
properties or improvements in the vicinity;
D. That the proposed Conditional Use Permit will comply
with each of the applicable provisions of the Zoning
Ordinance as stated in the conditions below.

GENERAL
1. The proposed development shall comply with all applicable
regulations of the Lynwood Municipal code, the Uniform
Building Code and the Uniform Fire Code.
2. Any proposed subsequent modification of the subject site or
structures thereon, shall be first reported to the Community
Development Department, Planning Division, for review.
3. The applicant, or his representative, shall sign a Statement
of Acceptance,stating that he /she has read, understands, and
agrees to the conditions stated herein before any building
permits are issued.
REDEVELOPMENT AGENCY
4. only beer and wine shall be sold, unless another Conditional
Use Permit beverage license is approved by the Planning
Commission.
5. This application shall be subject to a yearly review by the
Redevelopment Agency.
6. The proponent shall not post or maintain any signage visible
from the public right -of -way advertising brands of alcoholic
beverages offered for sale on the premises.
7. Alcoholic beverages shall not be offered for off -site
consumption.
8. Acholic beverages cannot be served in disposable containers.
9. A waitress must be on duty to serve meals and beverages to
table and booths within the restaurant.
PLANNING DIVISION
10. This permit shall become void one hundred twenty (120) days,
unless extended, after the use permitted has been abandoned
or has ceased to be actively exercised.
11. Entity will maintain a pro- active approach to the
elimination of graffiti from the structures, fences and any
accessory building, on a daily basis.

14. Per Section 25 -16.40 (4), of the Zoning Ordinance, a minimum
of fifty -one percent (51 %) of restaurant gross receipts
shall be from food sales. The owner /operator shall submit
evidence of total food sales to the Accounting Department of
the City of Lynwood, one year after approval of Conditional
Use Permit No. 60 by the Planning Commission.

It was agreed that the restaurant is now in operation, but
there is no sale of alcoholic beverages.
Chairperson Haynes opened the Public Hearing.
Art Rodriguez, 211 W. Alameda Avenue, Suite 101, Burbank,
California 91502, representing the applicant, rose to accept
all conditions and assured the Commissioners that beer and
wine will not be served unless the customer also orders
food.
Chairperson Haynes asked if anyone wished to speak in favor
of the proposal. There being no one, he then asked if
anyone wished to speak in opposition.
Sgt. Harry Astep, of the Sheriff's Department, rose to state
the Sheriff's Department's opposition to any more businesses
in Lynwood selling alcoholic beverages. he stated that
because of the peculiar construction of this building, the
customers will not be visible to employees working at the
counter, therefore, there will be no control over who drinks
the beer /wine after it i served. Several gangs, (Lynwood
Mob, Elm Street Watts, Paragon) already congregate only one
block away; it is considered'a high narcotics area and this
location is very close to South Gate where our Sheriff's
Department has no jurisdiction.
The possibility of limiting beer /wine sales to 154 of each
customer's bill was discussed, as was the possibility of
limiting the hours of sale to 11:00 a.m. to 10:00 p.m.
Ellen Mendoza, 12512 S. Atlantic, Lynwood, rose to state her
Opposition to the granting of any more liquor licenses in
Lynwood.
There being no one else wishing to speak in favor of, or in
Opposition to the proposal, Chairperson Haynes closed the
Public Hearing.

available for sale in Lynwood.

Dear Mayor Henning and City Councilpersons:
The Los Angeles County Sheriff's Department opposes
of a Conditional Use Permit (C.U.P.) for the sale
berverages on the premises located at 10136 S. Long
That objection is based on the following:

1. The location in question, "E1 Azteca", is a restaurant
presently in operation. it is configured as a fast food
stand with seating for approximately 40+ patrons. The
seating area is far removed from the immediate control
and view of the employes. Control of the consumption of
alcoholic beverages by the establishment would be
minimal, if at all. As configured, only a server, when
delivering food orders to other tables, would be in a
position to periodically view the consumption or use of
the alcoholic beverages sold. The "fast food" atmosphere
of the location would lend itself for patrons to have
several drinks and have immediate access to drive a motor
vehicle.
An interesting note to consider is the continual increase
of persons arrested for driving under the influence of
alcoholic beverage in the City of Lynwood - 442 in 1987;
532 in 1988; 801 in 1989 and a projected 850 in 1990.
2. The applicant wishes that 49% of his gross income be from
the sales of alcoholic beverage. Considering the hours
of operation - 8:00 AM to 10:00 PM - little if any
alcoholic beverages are generally consumed for Breakfast
and only a small amount for Lunch or during the afternoon
hours. This scenario would allow for increased or
concentrated sales of alcoholic beverages during the
evening hours. It would be difficult to limit the

percentage of alcoholic beverage sales per sales ticket
when the control or supervision of the eating area is
nearly non - existent.
3. There is considerable gang and narcotics activity in
this area. Four (4) active street gangs (Lynwood Mob,
Paragon, Colonial Watts and Elm Street Watts) congregate
in the surrounding areas and collectively are
responsible for more than 60 shootings since January of
1990. A heavy concentration of street narcotics
activity,, indigent persons and prostitution exist in the
immediate area. Another licensed alcoholic beverage
sales location could only exacerbate the existing
problems.
The City of Lynwood has made great strides in recent years
increasing the quality of life for it's residents. Several years
ago the City of Lynwood had the second highest ratio of alcoholic
beverage control license per capita of the area cities. Now with
the pro- active stance by the city of Lynwood, a number of licenses
have been revoked or disallowed because of repeated violations.
Lynwood now has one liquor license, of one kind or another, for
every 616 residents. South gate, which boarders Lynwood to the
North, and is in close proximity to the applicant's business, now
has a far higher ratio of license to population than Lynwood. But
in comparison to Compton, with a ratio of 1:716, and Carson, with
a ratio of 1:776, the city of Lynwood's ratio is still higher.
This abuse and its associated problems create an ever increasing
drain on existing law enforcement assets. It is requested that
the council deny the introduction of this additional alcoholic
beverage license.

BACKGROUND:
Attached is a report from Code Enfrocement to the Director of
Community Development listing several allegations of illegal
activity at the subject address. Among the charges are six
instances of possession of cocaine; one sale of cocaine; two armed
robberies and attempted grand theft. In addition, the Code Enforcement
Division of the Community Development Department has various complaints
of noise, littering, and poor maintenance of the site.
FACTS:
A series of code infractions cited by Code Enforcement and
various criminal activities documented by the Sheriff's
Department require that the subject business E1 Chubasco be
brought to public hearing to consider their continued operation.
In accordance with Section 4 -9.5 of the Municipal Code, the
accused has been notified of the meeting and of the items
being on the agenda for consideration.
RECOMMENDATION:
Staff recommends that the City Council hears the matter and
direct staff accordingly.

PURPOSE
To recommend that the City Council adopt the attached resolution
approving the City Hall electrical system upgrade through an
informal bid process.
• In September of 1990, the City Hall electrical load survey was
performed. The results indicated that the existing electrical
system is overloaded.
• To safely provide electrical power for the City Hall and its
office equipment, the electrical system needs to be upgraded.
• The project involves the replacement of low load electrical
panels of 100 and 225 amps with higher load panels of 225 and
400 amps.
• The work encompassed in this project is designed to complement
the electrical work required by the future building addition
to the City Hall.
• The project is estimated to cost $12,000 and funds are
available for the work from the Sec. 108 Loan.
• Due to the small size of the work, it can be completed more
efficiently and economically if done through an informal bid
process.
ANALYSIS
Under Section 6 -3.13 of the Lynwood Municipal Code, Council
can authorize -informal bids by a 4/5 vote.
RECOMMENDATION
It is recommended that the City Council adopt the attached
resolution approving the City Hall electrical system upgrade

REQUEST TO ADD AN ADDITIONAL CODE ENFORCEMENT OFFICER IN
THE CODE ENFORCEMENT DIVISION BUDGET OF THE COMMUNITY
DEVELOPMENT DEPARTMENT.
To request City Council approval to add an additional Code Enforcement
Officer position in the Code Enforcement Division of the the Community
Development Department.
FACTS
At the present time staff is unable to adequately answer the
existing complaints from the citizens in a timely manner. From
the date the complaint is received to the actual inspection
approximately three weeks elapse. Citizens' concern about the
time elapsed creates conflicts as it is perceived that staff is
not responsive.
2. The duties and obligations of the Code Enforcement Staff have
increasingly become more technical and precise. Besides the
regular enforcement of the property maintenance regulations and
the prevention and removal of all illegal posting in the public
right -of -way, staff is increasingly involved in the enforcement
of the National Electrical Code, Uniform Building and Plumbing
Code.
3. Due to demographic changes and lack of available land within the
city, a shortage of housing stock exists in proportion to the
population growth. As a result, staff is encountering an
alarming increase in illegal garage conversions, additions and
the subdivision of residential dwelling. During the fiscal year
of 1986 -87 the total number of violations of the building,
plumbing and electrical code found by staff was only 304. From
July 1 to October 31 of the current year staff has reported 513
violations of the codes listed above. This represents and
increase of over 500% in said activities.
4. The "Beautification Program" is being coordinated by staff in
conjunction with the Anti - Graffiti Department. Said program will
intensify the surveillance and compliance along the major
thoroughfares of the city and will heavily impact the workload of
staff.

bail schedule for violations of the Lynwood Municipal Code for
the City of Lynwood. Pursuant to Council directions, the
infraction system will begin operation by February 1991. Said
implementation will generate revenues to the city in the form of
fines levied against property owners /operators cited for code
violations.
6. Presently the Code Enforcement Program is being funded with
Community Development Block Grant (CDBG) Funds and General Fund
monies at a ratio of approximately 80% CDBG Funds and 20% General
Fund monies. The additional expenditure will be funded using the
same ratio allocation currently used.

ANALYSIS AND CONCLUSION:
The addition of the new Code Enforcement Officer will allow the City
to shorten the time of response to complaints, to increase compliance
with the Municipal Code and increase overall efficiency of the Code
Enforcement Program. In addition, the added position will facilitate
the transition into an infraction system by minimizing disruption
during the staff training /orientation process by increasing the
manpower in the program. The financial burden (20 %) imposed on the
General Fund will not be a burden as the recently approved citation
program will offset said burden.
RECOMMENDATIONS
Staff respectfully recommends that, after consideration the City
Council adopt the attached resolution providing a new Code Enforcement
Officer position, appropriating funds and amending the fiscal year
1990 -91 Budget.

The City of Lynwood Recreation and Parks Department is anxious to
proceed with the purchase and installation of new playground equipment
at various park locations.
FACTS:
1.
The City of Lynwood, through its Recreation and Parks Department,
competed for and received a play park grant from Pepsi Cola
Corporation.

The Pepsi Play Park agreement specifies Mountain Forge Equipment.
Mountain Forge Company provides Pepsi Play Park recipients with
substantial discounts on any equipment purchased over and above that
which is specified for the Pepsi Play Park.
3.
The non Pepsi Play Park equipment can be transported at no charge if
it transported with the play park equipment.
4.
The play park grant from Pepsi provides nineteen thousand dollars
($19,000.00) to purchase and install playground equipment.
5. In addition, we have the Roberti -Z -Berg Urban Open Space Act of 1990
allocation of nineteen thousand, five hundred sixty two dollars
($19,562.00) and its City Match of eight thousand three hundred
eighty four dollars ($8,384.00) designated for the purchase and
installation of playground equipment.
6. The wide variety of types of equipment in which we would like to
purchase and install, would ma ke the formal bid process impractical.
CONCLUSION /RECOMMENDATION:
Staff respectfully requests that City Council authorize staff to waive
the city's formal bid process by allowing the use of informal bid for
purchase and installation of playground equipment and adopt a resolution
approving this action.
Staff will be approaching the Mayor and Members of the City Council at a

CONGRESSIONAL PARK
FACTS:
The City of Lynwood Recreation and Parks Department is preparing to
continue automatic sprinkler system design and installation in Mervyn M.
Dymally Congressional Park.
The initial phase of the program was completed in 1987 when twenty (20)
acres of the total thirty -two (32) acre park received an automatic
irrigation system. Funds for completion of this initial phase were
recognized through the 1980 State Bond in the amount of one hundred
thirty -four thousand two hundred fifty dollars ($134,250.00).
The City of Lynwood Recreation and Parks Department has assigned
one hundred two thousand dollars ($102,000.00) from 1988 State Bond
funds for continuation of the automatic irrigation installation.
It is hoped that these funds will allow the completion of the remaining
twelve (12) acres of park land staff has solicited resumes and related
background information from thirty six (36) landscape architects.
Five responses have been received. They are:

B. Larson and Associates - Los Angeles
C. D.D. Pagano Irrigation Consultant - Santa Ana
D. Jerry Cummings Associates, Inc. - Los Angeles

After review of all information, by staff, it has been determined that
D.D. Pagano Irrigation appears to be the most qualified firm for design
of our specific needs.
Staff requests that council authorize staff to enter into negotiations

for this project.

CALIFORNIA, ADDING SECTION 3 -12.17 OF THE LYNWOOD
MUNICIPAL CODE RELATING TO BOOM BOXES
THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1: Section 3 -12.17 is hereby added to the Lynwood
Municipal Code to read as follows:
3 -12.17 Boom Boxes
a. Use restricted It shall be unlawful for any person to
play music on a "boom box" at a location closer than fifty (50)
feet outside of the property line of any residential property
located within the city at any time of night or day in a manner
which would be unreasonably loud to a reasonable person of normal
sensitivity.
b. Definition A "boom box" shall be defined for purposes
of this section as any radio, cassette player, compact disk
player or similar device with stereo speakers.
SECTION 2: The City Clerk shall certify to the passage of
this ordinance and shall cause same to be published once in the
Lynwood press within fifteen days after its passage and said
ordinance shall become effective thirty (30) days after its
passage.

Site Suitability
The property is adequate in size and shape to accommodate
the proposed development relative to structures, parking
walls, fences, landscaping, driveways and other development
features required by the Zoning Ordinance.
Long Beach Boulevard is a major arterial and is well suited
to carry the quantity of traffic which will be generated by
the restaurant.
3. Compatibility
The development is surrounded by a mixture of commercial
developments; therefore, the project will be compatible with
the surrounding land uses.
4. Compliance with Development Standards
The restaurant meets the development standards required by
the Zoning Ordinance with respect to setbacks; lot coverage;
building height, parking, and density. It also is in
accordance with distance requirements as established by the
City's Liquor Ordinance (1306) Section 25 -16.40 On -Sale
Acoholic Beverage Establishments.
Conditions of Approval
The sell of alcoholic beverages as proposed, subject to the
conditions recommended by the Site plan Review Committee,
will not have a negative effect on the values of the
surrounding properties or interfere with or endanger the
public health, safety or welfare.
6. Benefits to Community
The restaurant will assist in upgrading the commercial use
of the property and support the Commercial designation of
the General Plan.
The Community Development Department has determined that the
project could not have a significant effect on the
environment. Therefore, a Notice of Exemption has been
prepared and is on file in the Community Development
Department office and in the office of the City Clerk.

Staff respectfully requests that after consideration the Planning
Commission adopt the attached Resolution No. 2353:
Certifying that the project is categorically exempt,
from the provisions of the State CEgA Guidelines as
amended by Section 15061 b(3).
Approving Conditional Use Permit No. 60, subject to
the stated conditions and requirements.
