RAY, husband and wife, the parties o f the first part, hereinafter called the Grantors, and the City o f McCall, a municipal corporation of the State of Idaho, situ- ate in Valley County, Idaho, P. O. Box 1065, McCall, Idaho 8363q, the party of the second part, hereinafter called the Grantee, W I T N E S S E T H: WHEREAS, the City of McCall has obtained a grant from the State of Idaho to replace old and defective sanitary sewer lines, install manholes and install domestic sewer service lines in a ✓ esidential area in the Northeast portion of the City of McCall, the same to be financed by a grant from the State of Idaho Community Development Block Grant Porgram under Grant No. ICBG-85-COMP-III-35; and WHEREAS, the Grantors desire to provide an easement and ✓ ight of way across the premises hereinafter described for the purposes herein set forth. NOW, THEREFORE, in consideration of the sum of ONE DOLLAR ($1.00) to them in hand paid, the receipt whereof is hereby acknowledged, and in further consideration of the benefits to be received by the Grantors, by the construction of said sewer line, the Grantors hereby give, grant and convey to the Grantee, its successors and assigns, an easement and right of way for sewer pipes, mains, and conduits on, under, through and across the premises hereinafter described, together with the right to construct, maintain and repair underground pipelines and/or mains for the purpose of conveying sewage, together with the ✓ ight to excavate and refill ditches and/or trenches for the location of said sewer pieplines, mains and conduits. The land affected by this easement and right of way is situate in McCall, Valley County, Idaho, and is described as follows: A tract of land in the SE4NE4 of Section 9, Town- ship 18 North, Range 3 East, B.M., Valley County, Idaho, more particularly described as follows: Beginning at the Northwest corner of said SE4NE4; t hence South approximately 482.375 feet to a Point; t hence East 39.5 feet across the dedicated t he real point of beginning; thence East 295.25 feet to a thence North 147.625 feet to thence East 295.25 feet to a street; thence South along the West boundary cated street 147.625 feetto a point; t hence West approximately 240.25 feet to a point; thence South 147.625 feet, more or less, to a point o n the North boundary of a dedicated street; thence Wcst along the North boundary of said dedi- cated street 110.5 feet, more or less, to a point; thence North 75 feet to a point; thence West 240.0 feet to a point on thence North along the East boundary cated street 73.813 feet to the real street, point; a point; point on a dedicated of said dedi- a dedicated street; of said dedi- point of beginning. The said easement and right of way covers a strip of land over and across the above premises, which strip of land lies ten (10) feet on each side of the following described center- line, to -wit: Commencing at the Northwest corner of said SF4NEls (Northeast 1/16 corner); thence South 498.78 feet; t hence North 89°44'58" East 39.50 feet to the point o f beginning; thence continuing North 89°44'58" East 294.29 feet; thence North 55°22'25' East 106.21 feet; thence North 87°34'30' East 209.01 feet to the point o f termination, as shown on Exhibit "A° attached hereto and by this reference made a part hereof as if fully set forth at length herein. TO HAVE SIND TO HOLD, all and singular the said premises, together with the appurtenances, unto the said Grantee and to its successors and assigns forever. This grant shall be effective as long as said easement shall be actually used for the purposes above specified, and all right hereunder granted shall revert to the owners of the land when said use shall have been abandoned and discontinued for a term of five (5) years or longer. The Grantee shall at all times have the right to enter upon the lands hereinabove described for the purpose of constructing, repairing and maintaining said sewer pipes, mains and conduits, doing as little damage as possible.
