There will be no separate discussion on these items prior to voting unless members of the Council or staff request specific items be removed from the Consent Calendar for separate action. 3. VACATION OF STREETS AND ALLEY WITHIN THE LYNWOOD REDEVELOPMENT AREA Comments: The subject streets and alley are within the Lynwood Redevelopment area. These streets and alley are unnecessary for access and public circulation due to the proposed development. The sale of the property by the Lynwood Redevelopment Agency to Davina Incorporation requires the vacation of these streets and alley. Recommendation: That the City Council adopt a resolution declaring its intention to vacate and abandon the street and alley within the Lynwood Redevelopment area and set a public hearing. 4. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION NO. 67 -9 DESIGNATING CERTAIN INTERSECTIONS AS STOP INTERSECTION 5. PROPOSAL FOR CONSTRUCTION OF OFF - PREMISES SIGNS ALONG THE GLEN ANDERSON I 105 FREEWAY Comments: To enter into an agreement with a sign company leasing land for construction of off - premises freeway oriented signs along the Glen Anderson, I -105 freeway. Recommendation: It is recommended that the City Council of the City of Lynwood approve Robert's proposal and adopt the agreement drafted by the City Attorney's office; to lease land to Robert's Outdoor Sign Company for construction of billboards on City owned properties along the I -105 freeway. i 0 CITY COUNCIL SPECIAL MEETING OF NOVEMBER 12, 1990 6. DISCUSSION OF REMOVAL OF COMMISSIONER FROM PARKS AND RECREATION COMMISSION Comments: At the regular meeting of November 6, 1990, the City Council experienced a disorderly commissioner and staff was asked to place an item on the agenda for considerationn of the matter and action by City Council to remedy. Recommendation: That the City Council of the City of Lynwood instruct the City Clerk to notify the commissioner in question of Council action requesting his removal from the Commission. DISCUSSION ITEM 7. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DEFINING EXEMPTIONS AND IMPLEMENTATION SCHEDULING FOR A UTILITY USER'S TAX AS ESTABLISHED UNDER ORDINANCE 1352 Comments: Council will discuss options and issues relative to providing hardship exemptions to the Utility Users Tax implemented under Ordinance 1352. Also to be discussed will be an alternative implementation schedules for the Utility Users Tax. Recommendation: It is recommended that the City Council review and discuss options provided and instruct staff accordingly. MURGA, DIRECTOR OF PUBLIC WORKS C SUBJECT: VACATION OF STREET AND ALLEYS WITHIN THE LYNWOOD REDEVELOPMENT AREA, ADJACENT TO THE LYNWOOD TOWNE CENTER PURPOSE To recommend that the City Council adopt a resolution declaring its intention to vacate and abandon those street and alleys within the Lynwood Redevelopment Area as being: Mulford Street between Long Beach Boulevard and Plaza Street The portions of alleys south of Mulford Avenue west of Long Beach Boulevard BACKGROUND The subject street and alleys proposed for vacation and abandonment are within the Lynwood Redevelopment Area, adjacent to the Lynwood Towne Center (see attached sketch). This area will be developed by Davina Inc. where a Travel Lodge will be constructed. ANALYSIS The street and alleys proposed for vacation are unnecessary for access and traffic circulation. Existing utilities are being relocated outside the project area. Public utility easements will be provided for those utilities remaining along Mulford Avenue. An agreement was made whereby the developer will post bonds to relocate the sewer within the project site within two years (see attached agreement and bonds). Also, the developer will cap and abandon water lines running through the project area. A public hearing is being set for December 18, 1990. That the City Council of Lynwood adopt the attached resolution declaring its intention to vacate and abandon for public purposes certain street and alleys within the Lynwood Redevelopment Area and set a public hearing. c22 -500 pGOA IT %A 3_ RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO VACATE AND ABANDON FOR PUBLIC PURPOSES THAT PORTION OF MULFORD AVENUE BETWEEN LONG BEACH BOULEVARD AND PLAZA STREET AND PORTIONS OF THE ALLEYS SOUTH OF MULFORD AVENUE, WEST OF LONG BEACH BOULEVARD The City Council of the City of Lynwood, California, hereby resolves and ordains as follows: Section 1: That portion of Mulford Avenue between Long Beach Boulevard and Plaza Street as shown on Tract Map number 2551, recorded in Map Book 24, page 78 -80 in the Office of the Recorder of Los Angeles County, between the westerly right -of -way line of Long Beach Boulevard and the easterly prolongation of the right -of -way of Plaze Street. Those portion of the alleys south of Mulford Avenue, west of Long Beach Boulevard as shown in Map Book number 2551, page 78 -80 in the Office of the Recorder of Los Angeles County. Said portions of Street and alleys which legal descriptions , being a part of this resolution, are attached herewith, are located within the corporate limits of the City of Lynwood, and are unnecessary for present or prospective public street purposes and that the public interest, necessity and convenience require, and the City Council of said City hereby declares its intention to vacate and abandon those portions of said streets and alleys. Section 2: Those said portions of the street and alleys, as above described, being in the City of Lynwood, are shown on the official map of the City of Lynwomd, at the office of the City Clerk of said City, to which all parties interested are referred for particulars as to the proposed vacation and abandonment. Section 3: That the City Council elects to proceed in said vacation and abandonment under Section 8300 to 8324, inclusive, of the Streets and Highways Code of the State of California, as amended. Section 4: The City Council of the City of Lynwood does hereby determine that the public convenience and necessity require that easements be retained for construction and maintenance of utility lines within the limits of the street vacation as described in Section 1. Section 5: That the City Clerk of the City of Lynwood is hereby directed to give and post, as required by law, notice of the passage of this Resolution of Intention, and give therein the legal description of said streets proposed to be vacated and abandoned, and specify the time and place of hearing of this Resolution of Intention, which is hereby fixed as follows: The hearing to be before the City Council of the City of Lynwood, at 11330 Bullis Road, in the City Council Chambers of the City Hall of said City of Lynwood, at the hour of 7:30 p.m. on December 18, 1990, at which time and place all persons interested may appear and object or protest to the proposed vacation and abandonment of said street and alleys. (hereafter "Developer "). W I T N E S S E T H The parties hereto do agree as follows: =first: That the Developer, in accordance with the Dispositio: and Development Agreement, Planning Commission Resolution No 2344, Site Plan Case No. CUP -56, pertaining to that certain parcel of land known as 11401 Long Beach Boulevard, Lynwood California, hereby agrees at his sole cost and expense, to furnish all equipment, material and labor necessary to perforn and complete within twenty -four (24) months from the date that the building permits are issuedlin a good and workmanlike manner, the following work and improvement, to -wit: Relocate existing 8 inch sanitary sewer in project site to Mulford Avenue by construction of a new 8 inch sanitary sewer in Mulford Avenue including all required asphalt concrete pavement replacement and other related work on Mulford Avenue and properly capping /abandoning the existing sanitary sewer (hereafter "Improvement "). Said improvements shall be accomplished in conformity with applicable provisions of the Lynwood City Code, the plans, profiles and specifications filed in the office of the Director of Public Works, under the supervision of, and to the satisfaction of, the Director of Public Works. The estimated cost of said work and improvements is the sum of $23,250.00. Second: That the City shall not, nor shall any officer or employee thereof, be liable or responsible for any accident, loss or da-mage happening or occurring during the construction of improvements specified in this contract prior to the acceptance of same. Developer agrees to hold City and its officers and employees free and harmless from all liability or claim because of or arising out of the construction of said work. Third: That it is further agreed that said Developer will at all times prior to the acceptance of said improvements by said City, give good and adequate warning to the traveling public of each and every dangerous condition caused by construction of said improvements, and will take the steps necessary to protect the traveling public from such defective or dangerous conditions. The Developer hereby agrees to pay for such inspection of improvements as may be required by the Director of Public Works. v44-980 =ourth: It is further agreed that said Developer has filed with -he City a cash deposit, surety bond, or instrument of credit, in zhe sum Of $25,400.00 being the estimated cost of the design, construction and inspection of said improvements as above specified, as a guarantee for the faithful performance of this contract. Murga Director of Public Works) H 0 0 DISPOSITION AND DEVELOPMENT AGREEMENT by and between the COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF LYNWOOD, AGENCY, and DAVINA INCORPORATED, DEVELOPER E1 0 0 ATTACHMENT NO. 5 SCOPE OF DEVELOPMENT A. GENERAL DESCRIPTION Pursuant to Section 104 of this Agreement, the S::e is specifically delineated on the Site Map (Attachment No. 1) and described in the Legal Description of the Site (Attach ==_nt No. 2). The Site consists of approximately 55,158 square feet. B. DEVELOPMENT The Developer shall develop that portion of the Site so indicated on the Site Map with a building or buildings consisting of not less than 20,000 square feet (gross floc= area), and with equipment suitable for operation of a Travelodge Franchise Motel. Building(s) shall be constructed of masonry, concrete, concrete block, wood frame and stucco, or such other materials as may hereafter be approved by both the Travelodge Franchise Motel Company and the Agency or its designee. Those improvements to be situated on -site pursua-= to this Attachment No. 5 which shall be developed by the Developer shall constitute the Developer Improvements. The Developer shall commence and complete the Developer Improvements by the respective times established therefor in the Schedule of Performance (Attachment No 3). C. DEVELOPMENT STANDARDS The Developer Improvements shall conform to local zoning and applicable provisions of the Lynwood Municipal Code. A conditional use permit ( "CUP ") granted to Developer for the use of the Site for a Travelodge Franchise Motel is attached to this Scope of Development as Exhibit "A ". D. PUBLIC IMPROVEMENTS AND UTILITIES The Developer, at its own cost and expense, shall provide or cause to be provided within the time set forth for the completion of the Developer Improvements in the Schedule of Performance (Attachment No. 3) the following on -site public improvements as are required by the City as part of the entitlement process: KTF \713.A 59 0 1. Reconstruct damaged sidewalk, curb and gutter and all paving along Mulford Avenue. 2. Construct two new approaches on Mulford Avenue and close up unused approaches. 3. Construct two wheelchair ramps (Mulford & Court & Mulford & Plaza). 4. Install five 24 -inch box trees along Mulford Avenue. 5. Install two marbelite street lights, underground services and conduits along Mulford Avenue. 6. Relocate existing 8 -inch sewer main around Site. This would require Developer to install two new manholes and install three hundred feet of new 8 -inch sewer main. 7. Relocate or cap existing 8 -inch water nain where it goes under the proposed motel at z`:e west side of the proposed property. 8. Install one new fire hydrant in front of the proposed motel on Mulford Avenue. The Agency shall provide or cause to be provided the following on -site and off -site improvements: 1. Demolition of buildings on Site property prior to close of escrow. 2. Finish site grading and compaction of the Site in accordance with approved grading plan prior to close of escrow. 3. Construction of public improvements consisting of an access or entry road to Long Beach Boulevard running through the Site property, and curb, gutter, sidewalk, street paving, water lines and appurtenances, traffic signals, KTF \713.A 60 0 i 83061 Cost of Development (a) The Agency shall pay the cost of demolition and rough grading of the Site to be performed by the Developer. The Agency must approve all contractors hired by the Developer to perform this work and the Developer shall submit receipts, vouchers or work orders for all such work performed. In addition, the demolition and rough grading work must be performed under the supervision and subject to the approval of the City's public works department. The cost of demolition and rough grading shall be offset against the purchase price for the Site property to be paid by Developer. All other costs of preparing the Site,except as specified elsewhere in this Agreement, shall be borne by the Developer, including, but not limited to, any costs of street improvement and related structures, sanitary sewers and storm drains, water system, electric power and street lighting, gas lines and telephone lines necessary to serve the development in or around the Site. However, the Developer shall pay for the first One Thousand ($1,000) and the Agency shall pay for the rest of the telephone line removal. Also, the cost of underground utilities, to the extent shown as the Agency's responsibility in the Scope of Development (Attachment No. 5), and all public improvements which may be desired by the City other than those specified in the Scope of Development (Attachment No. 5) as the responsibility of the Developer shall be borne by the Agency or the city (the "Agency Improvements "). (b) Except where in conflict with other parts of this agreement, the Developer shall bear all costs of developing the Site and constructing all improvements thereon and in connection therewith notwithstanding any requirement that such costs be borne by others except the Agency, all governmental permits and approvals, costs of design and construction, and financing. (c) An eight -inch sewer line ( "Sewer Line ") located on the Site property currently serves the Lynwood school district building located on an adjacent parcel. If the school district or some other entity continues to occupy the building, the sewer line must be relocated so that it does not travel underneath the motel structure and, yet, can KTF \713.A 21 Ll 0 school district building. on the other hand, if :he Agency acquires the school district )uilding, the building will be torn down and the sewer line removed. Developer shall post a bond in an amount determined by the City Public Works )epartment to be sufficient to pay for the Future relocation or removal of the sewer line :urrently located on the Site. Such bond amount shall constitute a ceiling on the amount that can be charged to the Developer for this relocation or removal. Costs of relocation would include but would not be limited to the cost of design, construction and administration of the relocation project. While this bond is in effect and the sewer line is still in place, the Developer will commence construction of the on -site improvements including the building and the parking lot. If relocation of the sewer line becomes necessary, such relocation shall be performed subject to approval by the City's Public Works Department. In any event, the sewer line must be removed within two (2) years from the date that the building permits are issued. (d) The cost of building a public road and constructing related improvements such as sidewalks, street lights and related maintenance on the easement reserved by the City over the Site property shall be borne by the Agency. The location of the easement shall be agreed upon by the Agency and the Developer. 6. [ §307] Construction Schedule After the Conveyance, the Developer shall promptly begin and thereafter diligently proceed through completion with the construction of the Developer improvements. The Developer shall begin and complete all construction and development within the respective times specified therefor in the Schedule of Performance (Attachment No. 3). 7. Facts 1. The City of Lynwood in the past years has purchased property along the Glen Anderson, I 105 freeway, to be used as parkland. (see attached map, exhibit A). 2. The City Council at its February 6, meeting approved a land use plan for the General Plan. The above mentioned properties have been designated commercial and given a zoning classification of C -2 (Light Commercial) zone. 3. Light Commercial as a zoning classification allows for the construction of off - premises freeway oriented signs and is in compliance with State law regulating such signs. 4. This item has appeared before the City Council on two previous occassions, (June 19, and July 3) however the Council chose to continued the matter for submission of additional information on the sign companies. Issues And Analysis Upon completion of the I 105 freeway it is the City Council's desire to lease City owned properties to sign companies for the placement of off - premises freeway oriented signs. Staff has been working with sign companies, as well as the State Department of Transportation; in soliciting information on signage regulations in order to develop an ordinance which will comply with State Law. Originally, staff invited (8) eight sign companies to participate in an informal bid. (A formal bid in this situation was not required as the properties were not acquired with funding from an assessment district). However, the City Council chose to continue the matter for submission of additional information on the sign companies. As a result of the Council's decision, Staff held a formal bid, inviting (13) thirteen sign companies (see exhibit B ) to participate. Of the thirteen companies invited, only two companies submitted proposals. Staff believes that the reason for the low turn out, is because the Century Freeway has been designated a landscaped freeway. Regency Outdoor Advertising Inc.'s proposal was rejected by the City Clerk because the offer was not sealed and did not contain the appropriate number of bid copies. For the record, Regency's offer was $120,000.00 per year, far below Robert's proposal. Robert's Outdoor Advertising is offering the City $36,000.00 per structure or $216,000.00 per year, payable monthly. This would be based on a twenty -year ground lease with a five year review by the City. In addition the company is offering a contribution of $60,000.00 to the City's General Fund to cover all administrative expenses upon instituting the project. (See exhibit D) Recommendation Staff respectfully request that the City Council approve Robert's proposal and adopt the agreement drafted by the City Attorney's office; to lease land to Robert's Outdoor Sign Company for construction of billboards on City owned properties along the I 105 freeway. Sands intends to be a 'Jane -of -all- Trades." In the past, Sands worked as a cos- metologist, draftswoman, courier and painter until she found her niche in con- struction. Today she is a laborer on the Century Freeway for Kasler Corpora- tion. Working on I -105 Project #32 in Hawthorne since August, Sands and a team of laborers have been stripping forms, sand blasting, chipping, helping pour concrete, "vibrating" to level con- crete and using a "wacker" to compact sod as well as other tasks. Sands got her start in construction at the Century Freeway Pre- Appren- ticeship Training Program ( CFPATP). A 28- year-old Los Angeles resident, sands took advantage of the seven - week program last year. She learned about CFPATP from the Century Freeway Women's Employ- ment Program (WEP), a program which actively recruits women for Cen- tury Freeway construction. NVEP Makes A Match WEP helped Sands get into the laborers' union last year Afterwards, she attended laborers school for three weeks and worked on several projects in the Los Angeles area. One year later, WEP Outreach Su- pervisor Suataute Anoa'i received a call from Kasler requesting an experienced female laborer. Sands had just reported that she was available for work and Anoa i knew it was a "good match." Sands, who earns $16.19 an hour plus other benefits, enjoys working as a laborer because of the wide variety of tasks -- from pipe laying to cement work to traffic control.
