23. INSTALLATION OF A FLASHING AMBER /RED PEDESTRIAN SIGNAL LIGHT
ON THE 3500 BLOCK OF MARTIN LUTHER KING BLVD.
Comments:
On Wednesday, September 26, a pedestrian fatality occurred on
the 3500 block of Martin Luther King Boulevard. Comments
from the Sheriff's Office indicate the need for a pedestrian
signalled controlled light for the safety of the residents
along the King Blvd corridor and residents of Brenton Ave who
frequently cross the boulevard at the marked crossing of king
Blvd. No statistics are yet available, but numerous
pedestrian /vehicle accidents and near misses have occurred
at the marked crosswalk.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD,
CALIFORNIA, OPPOSING ANY LEGISLATION ON REGIONAL GOVERNMENT
AND PROPOSING THAT CITIES ORGANIZE THE NECESSARY AGENCIES AT
THE LOCAL REGIONAL LEVEL
WHEREAS, the Lynwood City Council has previously
approved Resolution 9164 proposing amendments to AB 4242; and
WHEREAS, upon futher consideration, the Lynwood City
Council hereby retracts Resolution 9164; and
WHEREAS, the following bills have been presented and
not passed by the Legislature:
AB 4242 (W.Brown) -
AB 969 (Bergeson) -
SB 2391 (McCorquodale)-
AB 4235 (Farr) -
SB 1332 (Presley) -
Would have created regional development
and infrastructure agencies
Would have enacted the Southern
California Association of Governments law
Would have authorized the creation of
regional fiscal authorities with the
ability to raise revenues
Would have created the State planning
agency
Would have created the Subregional
Planning Act; and
WHEREAS, an in -depth review of all legislation
relevant to Regional Governance has revealed a totally
unsatisfactory array of dictates; and
WHEREAS, the cities in the Southeast Los Angeles
County are opposed to Regional Government dictated without City
Government input;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Lynwood, California, as follows:
SECTION 1. That the Council of the City of Lynwood is opposed to
all the above -named bills, and, any proposed legislation that
would impact local activities by regionalizing them;
SECTION 2. That the City of Lynwood proposes that all
regionalization activities be propagated by the cities
themselves.

Dear Mr. Rea;
I am in-receipt of your letter requesting input on the potential safety hazard existing
outside Lynwood Villa located at 3540 Century Blvd (Martin Luther King Jr. Blvd) in
Lynwood. As an evaluator for Community Care Licensing, I am responsible for monitoring'
the care and supervision provided to the elderly residents at this community care facility
One of my primary concerns is the safety of the accomodations afforded to these almost
ninety residents.
During my visits to this facility, I have noticed the safety hazard at the crosswalk which
I�!s from directly in front of Lynwood Villa to the large shopping area across the street.
D::E ic the conditions around this crosswalk, several residents have almost been hit while
attempting to cross the street.
First, the paint on the crosswalk itself has faded and is not noticeable by motorists.
Second, there is no sign indicating the presence of a crosswalk on the sidewalk in the
southern direction on Century Blvd. Third, even if a sign were placed here it would probably
be obscured by the thick foliage of the trees which line the street.
I am aware that it might not be appropriate to place another stop light at this crosswalk,
Ibu T T u'suld like to recommend some alternative measures in order to make this a safer
c - , _lk for the elderly residents. First, the crosswalk should be restriped so that it is
amore noticeable to motorists. Second, the trees should be trimmed and a sign indicating the
- presence of a crosswalk be installed in both directions of Century Boulevard. Third, the
installation of flashing caution signs in both directions of this street will also help
to make it a safer crosswalk. In addition, speed bumps or a similar device can be installed on
the pavement in front of the crosswalk in both directions in order to warn motorists of the
presence of the crosswalk.
As you are aware, our elderly residents do enjoy going out and visiting the neighborhood
businesses. The suggestions I have made, if implemented, will enable them to cross
to the shopping center in a safe manner. I have enclosed some pictures of the area near
the crosswalk. I have also enclosed a picture of the sidewalk directly in front of the
entrance to the facility. You will note that the tree roots have raised the sidewalk and
a pedestrian can easily trip on this sidewalk. Perhaps this can be repaired at the same time.
Your assistance in this matter will be appreciated.

9. THORSON AVENUE
Comments:
As directed by the City Council in its meeting of September
18, 1990, staff has prepared an analysis of various
alternatives to improve Thorson Avenue.
Recommendation:
Staff recommends that the City Council review the different
alternatives and provide direction to staff.
10. WATER WELL #5 REFURBISHMENT
Comments:
On June 6, 1989, the City Council authorized staff to conduct
an informal bidding to refurbish Water Well #5. The well
refurbishing work is now completed at a total cost of $
67,813.05.
Recommendation:
It is recommended that the City Council adopt the attached
resolution accepting the completion of Water Well #5
refurbishment.

11. CHRISTMAS DECORATION PROJECT FISCAL YEAR 1990 -91 (PROJECT 5-
5110)
Comments:
This project is listed in the 1990 -91 fiscal year budget and
$50,000 of Street Lighting funds have been appropriated.
Twenty thousand dollars will be used by the Park and
Recreation Department and the remaining $30,000 by Public
Works Department. Since this project is small in nature, it
could be completed more expeditiously and efficiently through
informal bids.
Recommendation:
Staff recommends that the City Council adopt the attached
resolution authorizing staff to obtain informal bids for the
$30,000 portion of the project.

Comments:
The City Council is requested to set a date to conduct a
public hearing to ascertain whether a nuisance is being
maintained at 3516 Mulford and 11400 California Avenue.
Recommendation:
It is recommended that the City Council adopt the attached
resolution declaring its intention to conduct a public
hearing to ascertain whether a nuisance is being maintained
on certain real property.

The City Council of the City of Lynwood met in a regular session -
in the City Hall, 11330 Bullis Road on the above date at 7 :30 p.m.
Mayor Henning in the chair.
Councilmembers Heine, Rea, Richards, Wells, Henning answered the
roll call.
Also present were City Manager Gomez, City Attorney Barbosa,
and City Clerk Hooper.
City Clerk announced the agenda had been duly posted in accordance
with The Brown Act.
It was moved by Councilmember Heine, seconded by Councilmember
Wells to approve minutes of Regular Meeting, August 16, 1990,

The following action was taken:
RESOLUTION NO. 90 -151 entitled: "A RESOLUTION OF THE CITY
COUN IL OF THE CITY OF LYNWOOD APPROVING THE APPLICATION FOR
PEDESTRIAN FUNDS AUTHORIZED UNDER SB821." was presented.
RESOLUTION NO. 90 -152 entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF LYNWOOD AMENDING THE BUDGET OF THE SIDEWALK
PROJECT WITH SB 821 FUNDS." was presented.
RESOLUTION NO. 90 -154 entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE UPGRADE OF THE
STREET LIGHTING SYSTEM ON FOURTH AVENUE, NORTH OF JOSEPHINE

Mayor Henning requested item 11 - Street Conduit Acceptance of
San Project San Miguel, Alpine and Norton Avenues Project No.
5- 5088/5089/5090, FY 1989 -90 and questioned the storm drain
and catch basins not being completed.
Public Works Director Murga stated they were now ready to be
done and the project could be done about $10,000 cheaper on an
informal bid.
After discussion,

DISCUSSION ITEMS:
City Manager Gomez discussed lease agreement with the Lynwood
Unified School District and stated the going rate for similar
properties was $2,500 per month.
Councilmember Richards requested that any discussion or transactions
on this matter be done in Closed Session. It was unanimously
agreed to hold item over to Closed Session.

Councilmember Richards spoke on request from Ross Phipps to hold
carnival, and questioned if city receives any type of fees from
privately sponsored
Was informed $200 per day Business License fee and Fire Clearance
Fee of $25.00 per day.
Councilmember Richards suggested staff look into charging a
mandatory clean -up deposit and an enheightened processing fee
to cover increased law enforcement services. Would like to see
added premium go into a special youth fund. Requested staff bring
information back to Council.
Councilmember Wells expressed concerns about the dates and hours
being requested for the carnival as this is a residential area
and also during the week while school would be in session. Feels
it should be held Friday, Saturday and Sunday from 11 :00a.m. to
10:00P.m.
Councilmember Richards requested a pre - cleanup and post - cleanup
fee.
f Councilmember Heine spoke on the numerous carnivals being in the
city and questioned if a limit during a certain time frame could
be imposed.
L- Councilmember Rea spoke regarding the high prices being charged
by the carnival rides. Questioned putting limit or ceiling on
amoun that could be charged for rides.

to approve carnival request from Ross Phipps for September 7,8,
and 9, 1990, during hours 11 :00 a.m. to 10:00 p.m.

Margaret Araujo„ 3621 Cedar, discussed the high cost of rides at
the recent carnival. Also spoke on performance of rappers at
festival; the roll of city commissioners; trash bin overflowing
behind Baskin Robbins; and the beautiful appearance of the
M & D property.
Andy Partida, 3334 Tenaya, spoke of numerous illegals living at
house near his home and the problems they are causing. Also
spoke of people who go through the trash containers and pull all
of the trash out onto the streets. Also spoke of illegal parking; —
reparing of sidewalks and curbs; and trees that need trimming.
Mayor Henning requested Code Enforcement and the Sheriffs Depart-
ment to see that the area is cleaned up.
Margaret Araujo, questioned the trolley going down her street and .
a feasibility study not being done.
Mrs. Sinclair, 3331 Tenaya, spoke of problem with people doing
car repairs next to her home. ®®
Charles Montgomery,, 5446 Olanda, spoke of the need for a
committee to review the parks and recreation procedures for
volunteers.
Mayor Henning requested information to come back from Director
Parks and Recreation Mattoon.
Louis Ross, 11600 Long Beach, spoke of his attempts to develope
his commercial property and questioned the zoning of his property
for redevelopment.

Heine to recess to Closed Session at 8:23 p.m.

City Attorney Barbosa stated Council heard personnel matter, no
need for action at this time.
COUNCIL ORAL AND WRITTEN COMMUNICATION:
Councilmember Richards spoke on the Unity Festival. Also spoke
of citizens getting involved in community activities and the
need for neighbors to become acquainted.
Councilmember Wells spoke of the need to clean up the Baskins
Robbins site.
Councilmember Heine spoke on the Baskin Robbins site being cleaned
up. Also spoke of the number of people who are living in garages
and the problems it is causing in the school district. Requested
City Manager bring ordinance or whatever to stop this sort of
problem.

Councilmember Rea spoke of the Block Watch Program being one of
the strongest of any cities. Discussed newspapers having Lynwood
appear to be a negative city, but there is a lot of good work
going on in the city. Also spoke of the gang activity that is
going on all over the state.
Mayor Henning stated he would like to see the Alpha Beta and Viva
Markets parking lots cleaned up. Also stated the city of Lynwood
doesn't need more motels but needs nice eating places like Denny's.
Also instructed staff to protest the Census Bureau count.

Project Manager Gonzales spoke on legislation and laws available
to the City in dealing with the problems of illegal garage
conversions.
Councilmember Heine expressed concerns about numerous children who
are living in garages.
Councilmember Rea spoke on staff providing backup material to show
proof that people are really living in illegal conversions. Feels
more study needs to be done before people are put out into the
streets and become homeless which creates another problem.
Councilmember Richards spoke of absentee owners renting single family
units at exhorborant prices causing many families to move in
together in order to pay the rent.

Councilmember Wells spoke on absentee home owners allowing
numerous families to move in together in a single family unit.
Councilmember Rea questioned Code Enforcement procedures when
multiple families are found living in single family unit.
Councilmember wells stated she is not willing to have a lot of
apartments built in the city. Feels the city needs to get in
touch with State Legislatures about this problem.
Councilmember Rea stated a policy should be set to make arrangements
{ for those families who would be displaced.

PURPOSE:
To recommend that the City Council review the various
alternatives to improve Thorson Avenue, from Carlin Avenue to
Olanda Street.
BACKGROUND:
At the regular Council meeting of September 18,
presented an item to the City Council to vacate
Thorson Avenue, from Carlin Avenue to the first
Carlin Avenue. Council instructed staff to bri
alternatives to improve Thorson Avenue, instead

ANALYSIS:

In addition, the City Attorney is investigating if locked gates
could be placed at the entrances to the area and provide the
property owners with keys to the gates. Area residents could be
also contacted to gather their preferences as to the possible
solutions.
RECOMMENDATION•
Staff recommends that the City Council review the different
alternatives and provide direction to staff.

SUBJECT: ACCEPTANCE OF WATER WELL #5 REFURBISHMENT
PURPOSE:
To recommend that the City Council adopt the attached resolution
accepting the completion of Water Well #5 refurbishment.
BACKGROUND:
On March 21, 1989, the City Council authorized Staff to proceed
with the refurbishment of Water Well 15.
Water Well 15 has been inactive since 1983 due to failures of
various well mechanical components. The refurbishment of this
well encompasses the installation of a new pump /motor, inspection
and recondition of the pump column, tube and bowl assembly. It
also includes the installation of a deep well control check
valve, various well reconditioning operations, and the upgrading
of the telemetry system.
The well work started on March 21, 1989 and was completed on
August 31, 1990. The well's refurbishing cost totaled $67,813.05.
Well #5 is now in production at its pumping capacity of 800
Gallons Per Minute (GPM).
ANALYSIS•
On August 31,1990 the final inspection on the project was per-
formed by staff, all items have been completed to the satisfac-
tion of the Director of Public Works. The redevelopment of Well
#5 is therefore complete.
RECOMMENDATION•
It is recommended that the City Council adopt the attached Reso-
lution accepting the completion of Well #5 redevelopment.

PURPOSE
To recommend that the City Council adopt the attached resolution
authorizing staff to obtain informal bids for this project.
BACKGROUND
This project is shown under the 1990 -91 CIP list, with a budget
of $50,000 from the Street Lighting fund. Twenty thousand
dollars of the budget will be used by the Recreation and Park
Department to purchase banners. The remaining $30,000 will be
used by the Public Works Department to install two sets of poles,
one set north of the intersection of Long Beach Boulevard and
Norton Avenue and the other south of the intersection of Long
Beach Boulevard and Mulford Avenue. The work will also involve
the installation of electrical conduits, wiring, service
cabinets, and Christmas ornamental banners.
ANALYSIS
Since this project is small in nature and involves the subdivi-
sion of the work into several trades, such as, electricians,
cement masons, conduit installers, etc., the Public Works Depart-
ment's portion of the project could be completed more expedi-
tiously and effectively through informal bids. This would re-
quire a 4/5 Council vote, as set forth by Section 6 -3.13 (c) in
the Lynwood Municipal Code.
RECOMMENDATION
It is recommended that the City Council adopt the attached reso-
lution authorizing staff to obtain informal bids for the $30,000
portion of the project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD AUTHORIZING STAFF TO OBTAIN INFORMAL
BIDS FOR THE CHRISTMAS DECORATION PROJECT 5 -5110
WHEREAS, the City Council desires to continue maintain-
ing City facilities in a proper and efficient manner; and
WHEREAS, the above mentioned project is listed in the
Capital Improvement Project list for the F.Y. 1990 -91 Budget; and
WHEREAS, $50,000 has been appropiated through Street
Lighting funds for this project; and
WHEREAS, $30,000 portion of this fund will be used to
install poles, electrical conduit, wiring and service cabinets;
and
WHEREAS, said portion of the project can be completed
more expeditiously and effectively if done through an informal
bid process; and
WHEREAS, under Section 6 -3.13 (c) of the Lynwood Munic-
ipal Code, Council can authorize implementation of projects
through informal bids by a 4/5 vote.
NOW, THEREFORE, the Cilty Council of the City of Lyn-
wood does hereby find, proclaim, order and resolve as follows:
Section 1. That the City Council hereby authorizes
staff to obtain informal bids for the $30,000 portion of the
Christmas Decoration Project, 5 -5110.
Section 2. This resolution shall take effect immedi-
ately upon its adoption.

A NUISANCE IS BEING MAINTAINED ON CERTAIN
REAL PROPERTY.
WHEREAS, the City Manager of the City of Lynwood has
recommended that this City Council find that certain premises
within the City of Lynwood may be maintained in such a way as to
constitute a nuisance; and
WHEREAS, certain procedures are set forth in Chapter
3 -13 of the City Code of the City of Lynwood, pursuant to which
nuisance may be abated;
WHEREAS, the conditions on said property which may
constitute a nuisance are:
1. Apartment building partially constructed, open to
transients. Currently being used for sleeping
purposes by unknown individuals.
2. Graffitti on both building. (11400 California and
3516 Mulford Avenue)
3. Inoperable truck stored at the site.
4. Overturned truckbed in the rear of the site.
5. Junk trash and debris throughout site.
6. Overgrown vegetation througout site.
7. Broken windows in structure located at 11400
California Avenue.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
Lynwood does hereby resolve as follows:
Section 1. Based upon the aforesaid recommendation
of the City Manager, this Council hereby finds and determines
that the following described property may be presently be
maintained in such manner as to constitute a nuisance. Such
property is described as Lot 010 of Tract 6173 Page 08 generally
known as 11400 California and 3516 Mulford Avenue, City of
Lynwood.
Section 2. The method(s) by which said conditions
could be abated include:
1. Secure abandoned building by temporarily boarding
it up.
2. Remove and maintain structures free of graffitti.
3. Remove inoperable truck from the site.
4. Remove truck bed from the site.
5. Remove all junk, trash and debris from site and
maintain site on an on -going bases.
6. Remove and maintain property free from overgrown
vegetation.
7. Replace all broken windows at 11400 California

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD DECLARING ITS INTENTION TO
CONDUCT A PUBLIC HEARING TO ASCERTAIN WHETHER
A NUISANCE IS BEING MAINTAINED ON CERTAIN
REAL PROPERTY.
WHEREAS, the City Manager of the City of Lynwood has
recommended that this City Council find that certain premises
within the City of Lynwood may be maintained in such a way as to
constitute a nuisance; and
WHEREAS, certain procedures are set forth in Chapter
3 -13 of the City Code of the City of Lynwood, pursuant to which
nuisance may be abated;
WHEREAS, the conditions on said property which may
constitute a nuisance are:
1. Dilapidated house open to transients. Broken
windows, hazardous electrical wiring and
electrical connections.
2. Graffiti on building.
3. Junk, trash and debris throughout property.
4. Overgrown vegetation throughout property.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
Lynwood does hereby resolve as follows:
Section 1. Based upon the aforesaid recommendation
of the City Manager, this Council hereby finds and determines
that the following described property may be presently be
maintained in such manner as to constitute a nuisance. Such
property is described as Lot 11 of Tract 6173, Page 08 generally
known as 11410 California Avenue, City of Lynwood.
Section 2. The method(s) by which said conditions
could be abated include:
1. Secure building by temporarily boarding it up.
2. Remove all the graffiti on the structures, and
maintain structures clean of graffiti.
3. Remove all junk, trash and debris from property
and maintain said property.
4. Remove and maintain property free from overgrown
vegetation.
BE IT FURTHER RESOLVED THAT THIS COUNCIL therefore
declares its intention to conduct a public hearing, pursuant to
Chapter 3 -13 of the City Code of Lynwood to ascertain whether the
above described conditions constitute a public nuisance, the
abatement of which is appropriate under public power of the City
of Lynwood, and,
THE CITY COUNCIL hereby fixes the hours of 7:30 p.m.,
November 6, 1990, as the time and the City Council Chambers,
11330 Bullis Road, as the place for said public hearing; and the
City Clerk is authorized and directed to serve and post certi-
fied copies of the resolution in the manner set forth in Section
3 -13.5 of the Lynwood City Code.

open flame cooking in rear of 11410 California. Appliance
repair business, no business license and junk, trash and
debris.
3. 1- 25 -89 -- Final Notice to Dr. Floyd regarding above

I am writing to you behalf of residents liVii7" on the street of
Mulford Avenue in the city of Lynwood,reason being that we are fustrated
by the unsanitary conditions of an unfinished apartmant complex centered
on Mulford Avenue,.surrounding our homes. The complex is bein used as
a means of a dumping sight and has attracted members of gan to pollute
the complex with graphity including obscenity. We as parents are concernad
about the people solicitatig drugs and prostitution in front of our children
and our homes. We are afraid for our children to play outside, because of
the kind of people coming and going out of the complex. The police have
not taken care of the problem and reflects a bad aspect on the city.
This letter is signed by most of the resident of Lymrccd residents on
Mulford Avenue, as a petition to let the city take care of the complex.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD DECLARING ITS INTENTION TO
CONDUCT A PUBLIC HEARING TO ASCERTAIN WHETHER
A NUISANCE IS BEING MAINTAINED ON CERTAIN
REAL PROPERTY.
WHEREAS, the City Manager of the City of Lynwood has
recommended that this City Council find that certain premises
within the City of Lynwood may be maintained in such a way as to
constitute a nuisance; and
WHEREAS, certain procedures are set forth in Chapter
3 -13 of the City Code of the City of Lynwood, pursuant to which
nuisance may be abated;
WHEREAS, the conditions on said property which may
constitute a nuisance are:
1. Apartment building partially constructed, open to
transients.
2. Graffiti on building.
3. Junk, trash and debris throughout property.
4. Overgrown vegetation throughout property.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
Lynwood does hereby resolve as follows:
Section 1. Based upon the aforesaid recommendation
of the City Manager, this Council hereby finds and determines
that the following described property may be presently be
maintained in such manner as to constitute a nuisance. Such
property is described as Lot 12, of Tract 6173, Page 08 generally
known as 11416 California Avenue, City of Lynwood.
Section 2. The method(s) by which said conditions
could be abated include:
1. Secure building by temporarily boarding it up.
2. Remove all the graffiti on the structures, and
maintain structures clean of graffiti.
3. Remove all junk, trash and debris from property
and maintain said property.
4. Remove and maintain property free from overgrown
vegetation.
BE IT FURTHER RESOLVED THAT THIS COUNCIL therefore
declares its intention to conduct a public hearing, pursuant to
Chapter 3 -13 of the City Code of Lynwood to ascertain whether the
.above described conditions constitute a public nuisance, the
abatement of which is appropriate under public power of the City
of Lynwood, and,
THE CITY COUNCIL hereby fixes the hours of 7:30 p.m.,
November 6, 1990, as the time and the City Council Chambers,
11330 Bullis Road, as the place for said public hearing; and the
City Clerk is authorized and directed to serve and post certi-
fied copies of the resolution in the manner set forth in Section
3 -13.5 of the Lynwood City Code.

SUBJECT: UNDEVELOPED LOT GENERALLY KNOWN AS LOT 09, TRACT /
6173, PAGE 08 (IN REAR OF 11016 CALIFORNIA AVENUE)
OBJECTIVE•
To have the City Council adopt a resolution declaring the
intention to conduct a public hearing to determine if a public
nuisance is being maintained on the subject property. The
hearing date shall be November 6, 1990, in the Council Chambers.
FACTS
1. 3- 24 -88 -- 1st. Notice of Violation to Dr. Floyd. Secure
building remove junk, trash and debris from property.
Discussed matter with Dr. Floyd who promised to clean,
secure and fence the property.
2. 12- 6 -88 -- 2nd Notice of Violation to Dr. Floyd regarding
open flame cooking in rear of 11410 California. Appliance
repair business, no business license and junk, trash and
debris.
3. 1- 25 -89 -- - Final Notice to Dr. Floyd regarding above
violations.
4. 1- 26 -89 -- Receive petition from residents of neighborhood.
5. 3- 16 -89 -- 3rd Notice of Violation to Dr. Floyd regarding
broken windows, junk, trash and debris. Electrical wiring,
opened building and graffiti.
6. 4- 12 -89 -- Final Notice letter written to Dr. Floyd .
7. 5- 3 -90 -- Case referred to City Prosecutor.
8. 5- 15 -90 -- Office Conference scheduled with Dr. Floyd for May
22,1990. Dr. Floyd canceled conference on May 21,1990.
9. 5- 30 -90 -- Office Conference held no resolution. Conference
rescheduled for June 12, 1990.
10. 6/5/90 -- Received another petition signed by 39 residents of
the area.
11. 6/12/90 -- Dr. Floyd canceled office conference.
12. 7/31/90 -- 15 pictures of the site. Preparation of Intention
to Conduct a Public Hearing.
13. 8- 1 -90 -- Five pictures taken. Conditions remain the same.
14. 9 -26 -90 Inspection conducted - no major changes in
condition.
BACKGROUND:
Staff receives approximately five to ten calls per week regarding
this site. In view of all failed attempts to obtain compliance
from the owner, the requested action by the City Council is the
only alternative left to the City to obtain compliance. Staff has
ample documentation substantiating our attempts to obtain
compliance from the owner on record.

RECOMMENDATION•
Staff respectfully request that after consideration, the City
Council adopt the attached resolution entitled:
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD, DETERMINING THAT A NUISANCE IS
BEING MAINTAINED ON CERTAIN PROPERTY AND
DIRECTING THE ABATEMENT THEREOF."

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD DECLARING ITS INTENTION TO
CONDUCT A PUBLIC HEARING TO ASCERTAIN WHETHER
A NUISANCE IS BEING MAINTAINED ON CERTAIN
REAL PROPERTY.
WHEREAS, the City Manager of the City of Lynwood has
recommended that this City Council find that certain premises
within the City of Lynwood may be maintained in such a way as to
constitute a nuisance; and
WHEREAS, certain procedures are set forth in Chapter
3 -13 of the City Code of the City of Lynwood, pursuant to which
nuisance may be abated;
WHEREAS, the conditions on said property which may
constitute a nuisance are:
1. Junk, trash and debris throughout property.
2. Overgrown vegetation throughout property.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
Lynwood does hereby resolve as follows:
Section 1. Based upon the aforesaid recommendation
of the City Manager, this Council hereby finds and determines
that the following described property may be presently be
maintained in such manner as to constitute a nuisance. Such
property is described as Lot 09 of Tract 6173, Page 08 generally
known as undeveloped lot in rear of 11416 California Avenue, City
of Lynwood.
Section 2. The method(s) by which said conditions
could be abated include:
1. Remove all junk, trash and debris from property
and maintain said property.
2. Remove and maintain property free from overgrown
vegetation.
BE IT FURTHER RESOLVED THAT THIS COUNCIL therefore
declares its intention to conduct a public hearing, pursuant to
Chapter 3 -13 of the City Code of Lynwood to ascertain whether the
above described conditions constitute a public nuisance, the
abatement of which is appropriate under public power of the City
of Lynwood, and,
THE CITY COUNCIL hereby fixes the hours of 7:30 p.m.,
November 6, 1990, as the time and the City Council Chambers,
11330 Bullis Road, as the place for said public hearing; and the
City Clerk is authorized and directed to serve and post certi-
fied copies of the resolution in the manner set forth in Section
3 -13.5 of the Lynwood City Code.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the City of Lynwood held on the second day of October, 1990.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD, CALIFORNIA, AMENDING SECTIONS 13 -10.1 AND
13 -10.4 OF THE LYNWOOD MUNICIPAL CODE RELATING TO
SIDEWALK EXCAVATIONS
THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1: Section 13 -10.1 of the Lynwood municipal
Code is hereby amended to read as follows:
13 -10.1 Permit Required. No person shall commence any
work or place any obstruction in or upon any public street,
including parkways and sidewalks, unless a special permit
therefor has been obtained from the City Engineer. (Code 1972
s28 -55) No permit shall issue which would permit on excavation
in a public street less than two(2) years old unless the
applicant can clearly demonstrate that the public health and
safety require that the contemplated work be permitted. This
prohibition shall not apply to public agencies or public
utilities when repairs must be made to failed conduits or when a
new service connection, which could not have been anticipated,
must be made.
SECTION 2: Section 13 -10.4 of the Lynwood Municipal
Code is hereby amended to read as follows:
13 -10.4 Fees.
a. A nonreturnable filing fee in
by resolution of the City Council shall be
the City Engineer, upon the filing of each
permit required by this section to cover c
investigations, filing fees over and above
street permits.
b. In addition to the fee prescribed in paragraph a.,
fees established by resolution of the council shall be charged
for street repairs, establishment of lines and grades for street
improvements and inspection costs for new construction or repairs
of curbs, sidewalks, gutters, pavement, driveways and sanitary
sewers.
c. In addition to the fees charged in paragraph b., if
a permit is issued to excavate any public street less than two
(2) years old, the applicant shall be charged an additional fee
established by resolution for each month, or fraction therefor,
remaining of the two (2) years restricted period.
d. The fees prescribed in this subsection shall not
apply to City contracts, 1911 Act improvements or work undertaken
by the various City departments.

SECTION 3: The City Clerk shall certify to the passage
of this ordinance and shall cause same to be published once in
the Lynwood Press within fifteen days after its passage and said

difference between book value depreciation not
recovered and reserved in cash and the full cost of replacementy
which also shall be calculated and considered a cost so as to
recover such unrecovered costs between book value and cost of
replacement over the remaining life of the asset.
d. General overhead, expressed as a percentage, distributing
and charging the expenses of the City Council, City Manager,
Accountig Department, Attorney's Office, Communityipr Y Treasurer, city
omotion,
organization. Personnel Office, and all
other staff and support service provided to the entire City
Overhead shall be prorated between tax- financed services and
fee - financed services on the basis of said percentage so that
each of taxes and fees and charges shall proportionately defray
such overhead costs.

Section 33.6 - Provision of Data
Pursuant to Section 54992 of the California Government
Code, the City Manager shall, at least ten (10) days prior to the
required public meeting set out in said Government Code Section,
make available to the public data indicating the cost, or
estimated cost required to provide the services set out in
Government Code Section 54990 and 54991.
Section 33.7 - Appeal to City Council
and Any person who feels that any fee or charge determined

been reviewed within the review schedule as set out in Section
(4), may appeal in writing to the City Council.
No fee for which an appeal has been filed shall take

receipt of such appeal, and heard at the next ensuing Council
meeting. Such appealed fee or charge shall take effect
immediately upon hearing by the City Council unless ordered
otherwise by ordinance amending this Chapter.
Section 2. SEVER ABILITY
If any portion of this Chapter is found to be
unconstitutional or invalid, the City Council hereby declares
that it would have enacted the remainder of this Chapter
regardless of the absence of any such invalid part.
Section 3 REPEALER
Al Resolutions, Cityd Motions, and all o actions e of i all ,

Boards and Commissions in conflict herewith are hereby repealed.
The fees and charges established by this Chapter shall supersede
all previously established fees or charges for the same regulation,
product or service, and all such previous fees and charges are
hereby repealed on the effective date of the executive order of
the City Manager provided in Section (4) hereof.
Section 4 EFFECTIVE DATE
This ordinance shall take effect and be in force thirty
(30) days after its passage.

All fees and charges set pursuant to this Chapter and Section
shall take effect ten (10) days after the City Manager signs an
executive order stipulating that all provisions of this Chapter
have been complied with, and no written appeal has been filed.
The Schedule of frequency of rate adjustments may be varied
by the City Manager to adjust revenues sufficient to meet debt
service coverage requirements of any bond, certificate, or
ordinance, resolution, indenture, contract, or action under which
securities have been issued by the City which contain any
coverage factor requirement.
