Presents the following Ordinance Seconded by Councilman
AN ORDINANCE TO AUTHORIZE SECURING POSSESSION
AND /OR ACQUISITION
OF ADBANDONED PROPERTY
WITHIN THE BOROUGH OS' CARTERFTACCORDING TO LAW
WHEREAS, The Borough of Carteret duly authorized the establishment of an
Abandoned Property List pursuant to N.J.S.A. 55:19 -55; and
WHEREAS, the Governing Body has determined that it is necessary to utilize the
authority authorized by law to seek possession and control, and/or full acquisition in fee,
of property determined by the duly designated Borough Officer to be abandoned, and so
placed on the Borough's Abandoned Property List, all according to law, in order to
address the legislatively recognized deleterious effects of abandoned properties upon the
quality of life and neighborhood property values in the Borough.
NOW THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Borough
of Carteret, the following actions are hereby authorized to the fidlest extent permitted by
law:
SECTION 1. The securing of possession and control of properties on the Borough's
Abandoned Property List as authorized by N.J.S.A. 55: 19 -84 et seq. for
purposes of taking action(s) deemed necessary to remove said properties
from the Abandoned Property List.
SECTION 2. The acquisition of any and all properties on the Borough's Abandoned
Property List by any of the following methods, (i) consummation of a
purchase and sale contact which is the product of direct negotiations with
the owners of such properties, (ii) by a gift, grant, or contribution by any
owner of such properties, or, if necessary, (iii) by condemnation of any
such property, as authorized by law, including N.J.S.A. 55: 19 -56 and
N.J.S.A. 55: 19 -102 and the Eminent Domain Act, for said purposes
authorized by law.
SECTION 3. The Borough Attorney, and/or other special legal counsel, and the
appropriate Borough Official(s) and Officer(s), are hereby authorized and
directed to perform or carry.out or cause to be performed or carried.out,
any studies, rehabilitation plans and specifications, surveys, tests,
soundings, borings, appraisals, title searches and title report reviews as
reasonably necessary to determine the value of any of the properties, the
location and quality of any of the properties and any environmental
matters associated with any of the properties and to undertake any: action
necessary or appropriate to acquire possession and control of, or title to,
of the aforementioned real properties as provided for above.

SECTION, 4. The Borough Attomey, and/or his designee, are authorized to negotiate
with any of the properties' owners, and the Borough Attorney, and/or
other special legal counsel, in consultation with other Borough Officials,
Officers and/or Professional Consultants, are authorized to file and pursue
any summary possession and/or condemnation action, as deem necessary
to carry our the purposes of this ordinance.
SECTION 5. The Mayor and Borough Clerk and such other officers as may be necessary
are hereby authorized to undertake any actions and execute and deliver
any paper, form, or document necessary or appropriate to' acquire
possession and/or title to said properties by any of the methods set forth in
Sections 1 and 2 of this ordinance..
SECTION 6. All ordinances and/or parts of ordinances inconsistent herewith are
repealed to the extent of any such inconsistency.
SECTION 7. This ordinance shall take effect upon publication as provided by law.
