Opa -locka Municipal Complex 780 Fisherman Street, 2"d Floor Opa- locks, FL 33054 1. CALL TO ORDER: Mayor Myra L. Taylor called the meeting to order at 5:05 p.m. on Thursday, September 10, 2015 in the Auditorium at Sherbondy Village, 215 President Barack Obama (Perviz) Avenue, Opa- locka, Florida. 2. ROLL CALL: The following members of the City Commission were present: Vice Mayor Timothy Holmes, Commissioner Luis B. Santiago, Commissioner Joseph L. Kelley, and Mayor Myra L. Taylor. Also in attendance were: City Manager Roy Stephen Shiver, Jr., City Attorney Vincent T. Brown, and City Clerk Joanna Flores. Commissioner Terence K. Pinder was not in attendance. 3. INVOCATION: The Invocation was delivered by Mayor Myra L. Taylor. 4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was recited in unison. 5. FIRST READING ORDINANCESIPUBLIC HEARING: a). AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, ADOPTING THE FINAL MILLAGE RATE PURSUANT TO SECTION 200.065, FLORIDA STATUTES, FOR FISCAL YEAR 2015 -2016, COMMENCING OCTOBER 1, 2015 THROUGH SEPTEMBER 30, 2016; SETTING FORTH PUBLIC HEARING DATES; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR REPEAL OF ALL PRIOR ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. Sponsored by C.M. The above ordinance was read by title by Clerk Flores. Faye Douglas, Budget Administrator read Section 2 of the ordinance into the record as follows: "The City Commission of the City of Opa -locka herby adopts and establishes the First Budget Hearing Minutes — 09/10/2015 1 millage rate of the City of Opa -locka for Fiscal Year 2015 -2016, commencing October 1, 2015, through September 30, 2016, at 8.9000 mills, which is $8.9000 per $1,000.00 of assessed property value within the City of Opa- locka. This represents a 15.86% increase over the rolled -back rate of 7.6818 mills. Mayor Taylor opened the floor for a public hearing. There being no persons to speak, the public hearing was closed. It was moved by Commissioner Kelley, seconded by Commissioner Santiago to discuss the ordinance. There being no discussion, the motion passed first reading by a 4 -0 vote. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, APPROVING AND ADOPTING THE CITY'S BUDGET FOR THE FISCAL YEAR 2015 -2016, INCLUDING THE GENERAL, SPECIAL REVENUE, PROPRIETARY, CAPITAL AND DEBT SERVICE FUND BUDGETS, COMMENCING OCTOBER 1, 2015, THROUGH SEPTEMBER 30, 2016; PROVIDING FOR THE EXPENDITURE OF FUNDS ESTABLISHED BY THE BUDGET; AUTHORIZING THE CITY MANAGER TO TAKE CERTAIN ACTIONS; PROVIDING FOR APPROPRIATION OF ALL BUDGET EXPENDITURES; PROVIDING FOR FEES CONSISTENT WITH APPROPRIATION AND AMENDMENT; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. Sponsored by C.M. The above ordinance was read by title by Clerk Flores. Mayor Taylor opened the floor for a public hearing. There being no persons to speak, the public hearing was closed. It was moved by Commissioner Santiago, seconded by Commissioner Kelley to discuss the ordinance. Commissioner Kelley said at the Regular Commission Meeting the City Manager indicated that he did not prepare this budget and he was looking at making changes and of course those changes will have to take place in the scope of the 8.9 mills. He would like to hear from the City Manager because there are some things in the budget book that he has concerns with. He said his biggest question is working to restore the employee's salary and he is concerned about the educational training line item for each department because he always think you should spend dollars on training for employees so it will be beneficial in the future and those line items are low or non - existent which is a great First Budget Hearing Minutes — 09/10/2015 2 concern to him. He said for the record he would like to do what they can to make the employees whole with the pay cuts and furlough they endured. Manager Shiver said the budget was not prepared by him; in fact he made an effort to meet with Department Directors and others to try and ascertain the data in the budget. There are some things that he found in the budget that is incorrect; there are some things that should be in the budget, but there not. He mentioned at the Commission Meeting that Larry Spring is a seasoned Government Finance Professional that will join the city to walk through the departments. There is some significant reorganization that will streamline and create efficiencies that he believe will answer a lot of questions. There are issues with the pay cuts that were done to the negotiated bargaining units which are incorrect and improper. With regards to the PBA contract, he received a letter today which was a nice demand letter to restore the cuts retroactive to June. It will be very challenging for any organization to successfully defend a unilateral cut to a bargaining unit contract. That has to be addressed immediately and the restoration that Commissioner Kelley spoke about will probably have to be done before October I" if he cannot get them to agree. He does not want an arbitration issue or grievances filed that will then trigger something more costly to the city. He is scheduled to meet with the Directors to speak to them in more detail about each Departments budget. It has been practices in the past for Directors to ask for things and prepare and present a budget and the Manager's Office have cut those budgets, some have been warranted and some have not been warranted. It is extremely important for the Department Director to have a handle on what their budget is going to be. Over the next week he hopes to be able to prepare enough information for the Commission to have a workshop by Thursday so they can discuss and deal with specific issues. He asked to meet with the Commission individually before the next meeting so he can prepare a final budget. Commissioner Kelley said he will support the legislation just on the frame work because any conversation at this time will be premature. Commissioner Santiago asked the City Manager is it his understanding that he found something in the budget that is incorrect? Manager Shiver said there are several things in the budget that is inconstant. He is not saying that something was done wrong, but he does want to borrow money. This is the first of two required Public Hearings; this budget has some issues that he need to look at. Commissioner Santiago asked, who is in charge of the budget? Manager Shiver said the buck stops with him and that's why he wants to make sure the information he provide to the Commission is correct. Vice Mayor Holmes said he cannot support this budget at this time because he does not know what truth is in this budget. Mayor Taylor said she looks forward to the one on one meeting. There being no further discussion, the motion passed first reading by a 3 -1 vote.
