HomeMy Public PortalAbout2008-07-11 Special Meeting197 BAL HARBOUR VILLAGE COUNCIL MEETING MINUTES SPECIAL MEETING - JULY 11, 2008 A Special Meeting of the Bal Harbour Village Council was held on Friday, July 11, 2008, at the Bal Harbour Village Hall Council Chambers (655 — 96th Street, Bal Harbour, Florida). 1. CALL TO ORDER/ROLL CALL: The meeting was called to order at 8:16 a.m. by Assistant Mayor Rosenfield. The following were present: Assistant Mayor Jean Rosenfield Councilman Joel S. Jacobil Councilman Martin Packer Councilman Jaime M. Sanz Alfred J. Treppeda, Village Manager Ellisa Horvath, CMC, Village Clerk Mitchell A. Bierman, Village Attorney Absent: Mayor Howard J. Berlin As a quorum was determined to be present, the meeting commenced. 2. PLEDGE OF ALLEGIANCE: The Pledge was led by Village resident Dina Cellini. 3. ORDINANCE FIRST READING/PUBLIC INPUT: The following Ordinance was read, by title, by Mrs. Horvath: AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, AMENDING THE VILLAGE CODE BY AMENDING CHAPTER 19 "TRAFFIC AND MOTOR VEHICLES" BY AMENDING SECTION 19-4 "PARKING IN P OFF-STREET PARKING DISTRICT AND ON HERMAN B. FULTZ BRIDGE" BY ESTABLISHING RULES FOR PARKING WITHIN THE DISTRICT INCLUDING PROHIBITING OVERNIGHT PARKING; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN CODE; AND PROVIDING FOR EFFECTIVE DATE. Assistant Mayor Rosenfield opened the public hearing. Dina Cellini, 211 Bat Cross Drive, spoke in favor of passing the Ordinance. She questioned the maximum time limit for parking and spoke against restricting the time limit to 30 minutes. Mr. Treppeda reported that the Florida Department of Transportation previously mentioned three hours, but noted that nothing is provided in an agreement yet. Mr. Bierman explained that the Ordinance can be changed to include language at the second reading, regarding the amount of time for the maximum time limit. There being no additional comments, Assistant Mayor Rosenfield closed the public hearing. 1 Councilman Jacobi arrived during Ms. Cellini's comments. Bal Harbour Village Special Council Meeting Minutes 07/11/2008 1 198 Councilman Packer spoke in favor of passing the Ordinance, based on comments received from residents and the Village's past experience. A motion was offered by Councilman Packer and seconded by Councilman Sanz to approve the Ordinance on first reading The motion carried unanimously (4-0), with the roll call vote as follows: Assistant Mayor Rosenfield ape; Councilman Jacobi ape; Councilman Packer ape; Councilman Sanz ape; Mayor Berlin absent 4. PUBUC COMMENT: Babak Raheb, 128 Balfour Drive, requested that the Resolution that was tabled regarding his lawsuit be placed on the September agenda for the Council's consideration. A motion was offered by Councilman Sanz and seconded by Councilman Jacobi to place the Resolution regarding the Raheb litigation on the September Council Agenda. The motion carried (3-1), with Councilman Packer voting nay. 5. ADJOURN: There being no further business, a motion was offered by Councilman Jacobi and seconded by Councilman Sanz to adjourn.
