Chairperson Linda Dodge called the regular meeting to order.
Commission present were Jensen, Klancke, Buchheister, Day,and
McCoskrie. Also present were Brown and winter.
First item of business was Fine Tree Plaza. Don Smith
representing this project reviewed obtaining a subdivision
exemption from the town and the conditions under which the
subdivision could take place. an agreement to the following
would need to be agreed to.
1. Fine Tree receiving a zoning right to build up to 18,000
sq. ft. of commercial, which is a share of the allowed use to
this pod to the Maryvale agreement.
2. This subdivision or development would not trigger any of
the required development of recreational facilities as provided
for in the annexation agreement, however, should the FineTree
development build any rec. facilities, Maryvale will be credited
for them.
3. Finetree shall be exempt from Articles IV and V, with
regards to triggering any of these obligations.
4. Park dedication requirements will be at 2.47 as is the
remaining Maryvale property obligation.
Finetree must first purchase the property by means of a
subdivision and then they can proceed to annex, deannex etc. as
was earlier discussed. Subdivision exemption plat is not ready
for tYiis meeting for review. Smith advised that the subdivision
exemption conditions will be contained in a resolution document
approving the exemption and conditions.
Board held discussion on a road right a way problem for Kings
Crossing road that will be solved at a later time.
Jensen made a motion to approve the subdivision exemption subject
to plat review by staff and allow this to pass to town board,.2nd
Klancke, carried.
Klancke did question an agreed method to collect the parks fees.
smith said he would agreed to add this to the agreement and pay
out at building permit stage. Board agreed to this.
No further business, meeting adjourned at 8:30 p.m.
