HomeMy Public PortalAbout069-2006 - General - The adoption of NIMSORDINANCE NO. 69-2006 A GENERAL ORDINANCE AMENDING THE CITY OF RICHMOND CODE TO ADD A NEW CHAPTER PERTAINING TO THE ADOPTION OF THE NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS) AS THE STANDARD FOR INCIDENT MANAGEMENT; REPEALING CONFLICTING ORDINANCES. WHEREAS, on February 28, 2003, the President issued Homeland Security Presidential Directive (HSPD) — 5 that directed the Department of Homeland Security, in cooperation with representatives of federal, state, and local government, to develop a National Incident Management System (NIMS) to provide a consistent approach to the effective management of situations involving natural disasters, man-made disasters or terrorism; and WHEREAS, the final NIMS was released on March 1, 2004; and WHEREAS, the NIMS contains a practice model for the accomplishment of the significant responsibilities associated with prevention, preparedness, response, recovery, and mitigation of all major and national hazards situations; and WHEREAS, the HSPD-5 requires that state and local governments adopt the NIMS as a precondition to the receipt of federal grants, contract and activities related to the management and preparedness for certain disaster and hazard situations; and WHEREAS, Governor Mitch Daniels issued an Executive Order adopting the use of NIMS as the model for preparing for, responding to and recovering from emergency incidents and disasters within the State of Indiana; and WHEREAS, during the course of 2005-2006, City of Richmond began the implementation of NIMS, as well as training incident thereto, and desires now to formally adopt NIMS by ordinance; NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond that the City of Richmond hereby add Chapter 100 as follows: CHAPTER 100: EMERGENCY MANAGEMENT 100.01 Purpose 100.02 Official Incident Response System 100.03 Training, Exercise, and Use of NIMS 100.98 Severability 100.99 Effective Date 100.01 PURPOSE (a) The President in Homeland Security Directive (HSPD) - 5, directed the Secretary of the Department of Homeland Security to develop and administer a National Incident Management System (NIMS), which would provide a consistent nationwide approach for Federal, State, local, and tribal governments to work together more effectively and efficiently to prevent, prepare for, respond to and recover from domestic incidents, regardless of cause, size or complexity. (b) The collective input and guidance from all Federal, State, local, and tribal homeland security partners has been, and will continue to be, vital to the development, effective implementation and utilization of a comprehensive NIMS. (c) It is necessary and desirable that all Federal, State, local and tribal emergency agencies and personnel coordinate their efforts to effectively and efficiently provide the highest levels of incident management. (d) To facilitate the most efficient and effective incident management, it is critical that Federal, State, local, and tribal organizations utilize standardized terminology, standardized organizational structures, interoperable communications, consolidated action plans, unified command structures, uniform personnel qualification standards, uniform standards for planning, training, and exercising, comprehensive resource management, and designated incident facilities during emergencies or disasters. (e) The NIMS standardized procedures for managing personnel, communications, facilities and resources will improve the State's ability to utilize federal funding to enhance local and state agency readiness, maintain first responder safety, and streamline incident management processes. 100.02 OFFICIAL INCIDENT RESPONSE SYSTEM. The National Incident Management System (NIMS) dated March 1, 2004, is hereby approved and adopted as the standard for incident management within the City of Richmond. 100.03 TRAINING, EXERCISE, AND USE OF NIMS. That all incident managers and response organizations under the jurisdiction and control of the City of Richmond shall train, exercise and use NIMS in their response operations. 100.98 SEVERABILITY. If any section, clause or portion of this ordinance is declared invalid by a court of competent jurisdiction, the remainder shall not be affected thereby and shall remain in full force and effect. 100.99 EFFECTIVE DATE. This ordinance shall become effective immediately upon passage by the Common Council. Passed and adopted this _7th_ day of _Au ust 2006, by the Common Council of the City of Richmond, Indiana.
