Also participating remotely : Ryan Bennett, Town Planner and Lynn St. Cyr, Senior Department Assistant. The Chair read the Notification : This meeting will be conducted by remote participation pursuant to Governor Baker's March 2020 orders suspending certain Open Meeting Law provisions and imposing limits on public gatherings. No in-person meeting attendance will be permitted. If the Town is unable to live broadcast this meeting, a record of the proceedings will be provided on the Town website as soon as possible. The Town has established specific email addresses for each board and committee so the public can submit comments either before or during the meeting. Representative : Duane Moulton of Grid Builders LLC for property located at 0 Pine Bluff Road and shown on Assessor' s Map 52 , Lot 42 in the Residential Medium Density and Residential Rural zoning districts . The Applicant requests to modify conditions related to the chain link fence required by Site Plan Review Approval #2019- 17 as issued pursuant to Section 179-63 of the Brewster Zoning Bylaw, Documents . 09/ 10/ 19 Proposed Grading Plan and Proposed Details • 11 / 13/ 19 Approved Site Plan • 11 / 18/ 19 Site Plan Review Approval #2019- 17 • 07/ 15/20 Planning Board Application 08/21 /20 Department Review Comments i Daniel Serber of Next Grid Patriots LLC and Duane Moulton of Grid Builders LLC participated remotely on behalf of the Applicant. Meghan Driscoll and C . Boyle were also present remotely on behalf of the Applicant . i Moulton stated that the fence originally approved , a 6 ' vinyl coated fence , does not meet the National Electrical Code ( NEC ) . A taller fence of 7' needs to be installed due to proximity of the panels to the fence and a vinyl coated fence is not acceptable pursuant to the NEC as it will not work for grounding . Moulton noted that the Brewster Building Inspector and the Applicant's electrical engineer have discussed the proposed modifications . Serber stated that the fence originally proposed was a mistake in the original filing and the proposed modification is to correct for that mistake . Serber stated that if the Town would like the fence to remain at 6 ' , the Applicant can move the fence back away from the equipment. Moulton stated that the fence cannot be coated with a vinyl material but a black Rustoleum product will be used . I Hoffmann read department comments into the record . j Hoffmann stated that she appreciated that the Applicant has met on site with the abutters . Hoffmann stated that she visited the site and the shiny chain link fence is very noticeable . Hoffmann asked to discuss other conditions not related to { the fence that were not in accordance with the approved site plan . Bennett stated that although the modification application does open the entire site for review , the Applicant has requested a change to the fence only . Wallace stated that the Building Commissioner still needs to conduct a final inspection . Hoffmann stated that she noticed that the location of the concrete pad is different than shown on the approved site plan , there are electrical poles in the driveway not shown j PB Minutes 08/26/20 Page 1 of 2 i I f i 1 on the approved site plan , and the plantings do not appear to be complete . Hoffmann also stated that she did some research and a paint specific to a galvanized fence needs to be used so that it can be easily maintained . She expressed concern that rusting may occur. Moulton responded that the Applicant will employ a fence company that has experience with these types of projects to paint the fence . The fence company has recommended the Rustoleum product that will be used . Hoffmann asked for clarification on the need for changes to the fence and Moulton stated that a vinyl fence is too thin and cannot be grounded and because the fence is in close proximity to the array it needs to be grounded . Serber clarified a previous comment he made to clarify that he did not meet with abutters on site but at the original meetings before the Planning Board . Barrett stated she would like to include a condition in the decision that the paint be maintained . Serber suggested he would revise the Operation and Maintenance Plan originally submitted to include fence maintenance . Bennett suggested that the decision be modified to include this condition . Taylor asked Hoffmann to clarify her earlier comment about the plantings and Hoffmann stated that the Leyland Cypress have not been planted in all locations as indicated on the site plan , specifically on the north and east fence line . Moulton j responded that the Applicant has not yet completed planting as the panels were being stored on site while being installed . Moulton stated that hydro-seeding and the additional plantings are forthcoming . Degen , Hillis- Dineen , and Bebrin agreed that the decision should include a condition for maintenance of the painted fence . Bennett asked the Applicant for a suggestion for maintenance of paint on the fence that could be used as a condition . Moulton responded that the site will be inspected three times annually and that the fence will be inspected annually for wear to black color and any visible silver can be coated as part of the Operation and Maintenance Plan . Barrett stated that the paint should also be re-applied with fading not just as silver shows . Moulton stated that fading will occur. Hillis- Dineen stated that rust could be an issue as well and that needed to be considered in the condition . Wallace suggested that any part of the fence that does not have black paint be re- painted . Hoffmann asked about the requirements shown on the approved site plan that have not been met and Bennett suggested that the Board include a condition in the decision that the Applicant provide an as- built plan prior to issuance of a Certificate of Occupancy . St . Cyr stated that there was no public comment received for this application . Motion by Degen to Approve Modification of Site Plan Review Approval #2019 - 17 with the Conditions , as discussed , that the fence will be 7 ' and painted black , fence will be inspected annually and repainted as need , and an as -built plan will be provided before issuance of a Certificate of Occupancy. Second by Taylor. Vote . Hoffmann -aye , Barrett-aye , Bebrin -aye , Taylor-aye , Degen -aye , Hillis -Dineen -aye , and Wallace-aye . Vote : Hoffmann -aye , Barrett-abstained , Taylor-aye , Degen -aye, Hillis -Dineen -aye , Bebrin - abstained , and Wallace -aye . Vote : 5-0 -2 . Motion by Hillis -Dineen to adjourn .
