November 9, 1998
Town Barn
The Hillsborough Town Board held a Closed Session to discuss potential Litigation with
Town Attorney on November 9, 1998 in the Town Barn. Present for the Closed Session were
Mayor Horace H. Johnson, Sr., Commissioners Richard Simpson, Catherine Martin, Frances Dancy,
Kenneth Chavious, and Evelyn Lloyd. Staff Present were Town Manager Eric Peterson, Town
Clerk Donna Armbrister, Finance Director Sherry Carter, and Town Attorney Nick Herman.
Town Attorney Nick Herman updated the Board on the status of the Reservoir Litigation
cases.
Nick Herman also reported to the Board that one case may be satisfied if structural
changes are made at one section of the Reservoir. The changes would allow the only home
condemned for the project to be saved. This could potentially save the Town $150,000
depending on the cost of structural improvements. He asked that the Board authorize him to
meet with the Wooten Company to explore this possibility.
Upon a motion by Commissioner Chavious, seconded by Commissioner Martin, the
Board moved to return to Open Session by a vote of 5-0. The motion was declared passed.
