HomeMy Public PortalAbout076-2006 - Zoning - Rezone 1401 Chester Blvd.dORDINANCE 76-2006 A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM 0-1 to C-2 Whereas, the Zoning Map designates certain property commonly known as 1401 Chester Boulevard and legally described on Exhibit A, consisting of 11.501 acres, as 0-1 as outlined on Exhibit B; and Whereas, it is desirable to change the above described real estates' zoning designation to a C-2 Commercial District in order to allow the owners of said property to develop said property after the move of the hospital. NOW THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation for the above described property is changed to a C-2 Commercial District. Passed and Adopted this 5th day of September , 2006, by the Common Council of the City of Richmond, Indiana. Hutton) Attest: S/S Karen Chasteen City Clerk (Karen Chasteen) LAND DESCRIPTION For City of Richmond/Reid Hospital Tract 3 11.501 Acres Situated in the Southwest Quarter, Section 28 and the Northwest Quarter, Section 33, both being in Township 14 North, Range 1 West, City of Richmond, Wayne Township, Wayne County, Indiana, being part of a 31.24 acre tract as described in Deed Record Book 330, Page 591, as recorded in the Wayne County Recorder's Office, being more particularly described as follows: Commencing at a brass plug in concrete found at the northwest corner of the Northwest Quarter of said Section 33, in U.S. Highway No. 27 (Chester Boulevard); thence South 00'00'00" West 372.90 feet along the west line of said Quarter, in said road, to a point at the southwest corner of a tract of land deeded to Reid Memorial Hospital, as recorded in Deed Record Book 209, Page 387; thence South 88' 15'00"East 190.50 feet along the south line of said Reid tract, to the POINT OF BEGINNING for the tract herein described; thence North 00'00'00" East 531.00 feet, parallel with the west line of said Quarter along the east line of said Reid tract, and entering into the Southwest Quarter of Section 28, to an iron pipe found on the south line of a tract of land deeded to Reid Memorial Hospital, as recorded in Deed Record Book 121, Page 258-260; thence for the following 5 calls along the south lines of said Reid tract: thence North 72'55'00" East 330.00 feet, to a mag nail set; thence North 81'5T00" East 430.16 feet, to a mag nail set; thence North 60'21'00" East 327.03 feet, to an iron pipe found; thence North 53'31'00" East 382.96 feet, to an iron pipe found; thence North 38'32'00" East 40.00 feet, to an iron rod set (all iron rods set are 5/8" rebar with plastic cap stamped "RLS 20400025"); thence South 34'55'38" East 140.00 feet, leaving said south line, to a point in the Whitewater River; thence South 50'27' 16" West 1400.00 feet, re-entering into the Northwest Quarter of Section 33, to a point, in said river; thence South 06'00'00" West 115.00 feet, to a point on the south line of Lot 412 on the Official Map of the City of Richmond; thence North 88' 15'00" West 350.00 feet, to the point of beginning, containing 11.501acres, more or less, there being 7.149 acres, more or less, in the Southwest Quarter, Section 28, and 4.352 acres, more or less, in the Northwest Quarter, Section 33, as shown on Drawing No. E-937, dated 27th June 2006, being subject to all legal easements of record.
