THIS ADDEN UM, (Number 1 to Contract No. 105-2017) is made and entered into this
1*�/ day of 2017, by and between Richmond, Indiana, a municipal
corporation acting througli its Board of Public Works and Safety with its office at 50 North 5`h Street,
Richmond, Indiana, 47374 (hereinafter referred to as "City"), and Mikesell Excavating, Inc., 652
New Garden Road, New Paris, Ohio, 45347 (hereinafter referred to as "Contractor").
WHEREAS, City and Contractor entered into Contract No. 105-2017 on August 10, 2017, which
Agreement retains Contractor to provide services in connection with demolition of
certain properties for the City's Blight Elimination Program (`BEP" per Indiana
Housing and Community Development ("IHCDA") Guidelines; and
WHEREAS, The parties to said Agreement wish to add the additional properties (bid out as Round
2, Bid 5, Group M, and previously bid concurrently with the Round 1, Bid 6, Group
22 properties approved in said Agreement, with said bid properties also awarded by
the City on August 3, 2017) located in Richmond, Indiana, to said Agreement under
the same terms and conditions as set forth in Contract No. 105-2017.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained,
including the above stated recitals, City and Contractor hereby agree as follows:
The City and Contractor executed and entered into Contract No. 105-2017, on
August 10, 2017. Pursuant to Contract No. 105-2017, Section XIII Miscellaneous,
the Agreement may be altered or amended in whole or in part at any time by filing
with the Agreement a written instrument setting forth such changes signed by both
parties. As set forth above, the Parties are adding the Round 2, Bid 5, Group M
properties as follows, with said demolition and services to be performed by
Contractor in a manner consistent with Contract No. 105-2017:

2. Section III Compensation of said Agreement shall be altered in order that City shall
pay Contractor an additional amount of Ninety Thousand Six Hundred Dollars and
Zero Cents ($90,600.00) for the additional services, with said final contract amount to
be increased to a total amount not to exceed One Hundred Fifty-two Thousand Seven
Hundred Hundred Dollars and Zero Cents ($152,700.00).
City and Contractor expressly agree that all other terms, conditions, and covenants
contained in Contract No. 105-2017, shall be applicable to the work performed
pursuant to this Addendum, unless such term, condition or covenant conflicts with
this Addendum Number 1, in which case this Addendum Number 1 shall be
controlling.
4. Both parties hereby agree that with the exception of the additional property
demolition services to be provided and increased contract amount, Contract No. 105-
2017 shall remain intact and unchanged and in full force and effect.
Both parties agree that any person executing this Contract in a representative capacity
hereby warrants that he or she has been duly authorized by his or her principal to
execute this Addendum.
