Johnston arrived at 7:45 p.m. Trotter was also present. Wirsing made a motion to approve the 2/24/99 minutes as written. Second by Bucheister. Open Forum None. Pablic H~.~..ring -Minor Subdivision, Vi.,b,..:a Village Townhomes Swatzell made a motion to open the public hearing. Second by Shapiro. L.L. Kourse, the applicant, was present. Trotter gave the Board some background in;~~...ation. L.L. is subdividing a structure that is an existing duplex. All technical changes have been amended on the plat. The outstanding issues relate to the Town Attorney's commerts regarding the townhome documerrtation. The Commission asked several questions. After a discussion Wirsing made a motion come out of the public hearing. Second by Shapiro. Wirsing made a motion to approve Victoria Village Townhomes with the following conditions: 1. The lienholder needs to sign off on the declarations and the applicant needs to submit the signed original for recording. 2. The applicant needs to submit a signed copy of the bylaws. 3. A signed warranty deed needs to be submitted for recording, as opposed to a quit claim deed which was submitted Second by Coulson. Staff Choice Trotter advised the Commission that KFC has been purchased and the new owner will be op;,.~;.~...g a KFC/Taco Bell. He recently requested and received approval for a sign code variance from the Town Board There is a joint Town Board/Planning Commission public hearing scheduled for 5/5/99. The public hearing is on proposed amendments to the subdivision regulations, town code, and business district regulations. Trotter advised everyone that town clean up day is on 5/14 and 5/15. There was some discussion on the Safeway grand opening and also the Alco/Duckwall retail store that will be moving into the old Safeway. Tr~~«;.. passed out a four page letter that was sent out to all property owners in Fraser. The c...~b~.~l~ of the I::ILo. included information on paving, clean up days, and a water meter survey. Trotter advised the Commission that the public would be receiving weekly paving updates. This information shall also be sent to all Planning Commissioners and Town Board members. Commission Choice The Commission discussed the paving project. They also requested a Maryvale update. No real news to report on that issue. The water augmentation plan has been aYr. ,. /ed by the court. The Maryvale developers have indicated they may try to submit a sketch plan for a portion of the upper east side. No other business.
