HomeMy Public PortalAbout035-2017 - General Ordinance Amending Chapter 73 - Bicycles - STRICKENORDINANCE NO. 35-2017 A GENERAL ORDINANCE AMENDING CHAPTER 73 OF THE RICHMOND CITY CODE WHEREAS, Chapter 73 of the City of Richmond code regulates the operation of Bicycles within the City; and WHEREAS, it is desirable to update said Chapter to provide for the safety and well- being of the citizens of and visitors to the City of Richmond. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the city of Richmond, Indiana that the following section of Chapter 73 be amended to read as follows: SECTION 73.00 Definitions 73.01 Effect of Regulations 73.02 Traffic Laws Apply 73.03 Obedience to Traffic -control Devices 73.04 Riding Positions 73.05 Riding on Roadways and Bicycle Paths 73.06 Riding on Sidewalks 73.07 Speed 73.08 Emerging from Alley or Driveway 73.09 Carrying Articles 73.10 Parking 73.11 Bicycle Registration 73.12 Equipment 73.13 Bicycle Dealers 73.14 Rental Agencies 73.15 Penalty (Ord. 98-1995) 73.00 DEFINITIONS The definitions set forth in Section 70.01 apply throughout Chapter 73. 73.01 EFFECT OF REGULATIONS (a) It is a violation for any person to do any act forbidden or fail to perform any act required in this chapter. (b) The parent or guardian of any child shall not authorize or knowingly permit any child or ward to violate any of the provisions of this chapter. (c) These regulations applicable to bicycles shall apply whenever a bicycle is operated on any highway or on any path set aside for the exclusive use of bicycles subject to those exceptions stated herein. (Ord. 1781-1960) 73.02 TRAFFIC LAWS APPLY Every person riding a bicycle on a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this state declaring sections of the road applicable to vehicles or by the traffic ordinances of this city applicable to the driver of a vehicle, except as to special regulations in this chapter and except as to those provisions of laws and ordinances which by their nature can have no application. (Ord. 1781-1960) 73.03 OBEDIENCE TO TRAFFIC -CONTROL DEVICES (a) Any person operating a bicycle shall obey the instructions of official traffic - control signals, signs, and other control devices applicable to vehicles, unless otherwise directed by a police officer. (b) Whenever authorized signs are erected indicating that no right or left or U- turn is permitted, no person operating a bicycle shall disobey the direction of such sign, except where the person dismounts from the bicycle to make the turn. In this event the person shall then obey the regulations applicable to pedestrians. (Ord. 1781-1960) 73.04 RIDING POSITIONS (a) A person propelling a bicycle shall not ride other than astride a permanent and regular seat attached thereto. (b) No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. (Ord. 1781-1960) 73.05 RIDING ON ROADWAYS AND BICYCLE PATHS (a) Every person operating a bicycle on a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction. (b) Persons riding bicycles on a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles. (c) Wherever a usable path for bicycles has been provided adjacent to a roadway bicycle riders shall use the path and shall not use the roadway. (Ord. 1781-1960) 73.06 RIDING ON SIDEWALKS (a) No person shall ride a bicycle on a sidewalk within the central business district, except in those portions of sidewalk designated by the Board as "Bicycle Routes," which shall be appropriately signed and marked as portions of the bicycle routes. (b) The Board is authorized to erect signs on any sidewalk or roadway prohibiting the riding of bicycles thereon by any person and when the signs are in place no person shall disobey the signs. (c) No person 15 or more years of age shall ride a bicycle on any sidewalk in any district, except when operating the bicycle in the course of his business, trade, or employment, or except in those portions of sidewalks designated by the Board as "Bicycle Routes," which shall be appropriately signed and marked as portions of the bicycle routes. (d) Whenever any person is riding a bicycle on a sidewalk, the person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing a pedestrian. (Ord. 1781-1960; Ord. 3152-1976) 73.07 SPEED No person shall operate a bicycle at a speed greater than is reasonable and prudent under the conditions then existing. (Ord. 1781-1960) 73.08 EMERGING FROM ALLEY OR DRIVEWAY The operator of a bicycle emerging from an alley, driveway, or building shall on approaching a sidewalk or the sidewalk area extending across any alleyway, yield the right-of-way to all pedestrians approaching on the sidewalk or sidewalk area, and on entering the roadway shall yield the right-of-way to all vehicles approaching on the roadway. (Ord. 1781-1960) 73.09 CARRYING ARTICLES No person operating a bicycle shall carry any package, bundle, or article which prevents the rider from keeping at least one hand on the handlebars. (Ord. 1781-1960) 73.10 PARKING No person shall park a bicycle on a street other than on the roadway against the curb or on the sidewalk in a rack to support the bicycle or against a building or at the curb, in such manner as to afford the least obstruction to pedestrian traffic. (Ord. 1781-1960) 73.11 BICYCLE REGISTRATION (a) The owner, if 18 years or older, or the parent or guardian of a minor who is the owner of a bicycle and who resides within the City shall have the bicycle registered with the Police Department, within 30 days after its acquisition. (b) The provisions of this section shall apply to all persons acquiring bicycles hereafter, whether the bicycles are new or used and regardless from whom acquired. These provisions shall apply any time there is a change of ownership, including those instances when the bicycle has been registered to the previous owner. Registration shall take place one time as to any bicycle for each owner. (c) Registration shall include the imprinting, stamping, or otherwise placing of a registration number on each bicycle and the keeping of appropriate records by the Police Department as to identification of the bicycles and their ownership. No fee shall be charged to the owners for registration. (Ord. 2875-1974) 73.124 EQUIPMENT (a) Every bicycle when in use at night shall be equipped with a front lamp which shall emit a white light visible from a distance of a least 500 feet to the front and with a red reflector on the rear of a type which shall be visible from all distances from 50 feet to 300 feet to the rear when directly in front of lawful upper beams of headlamps on a motor vehicle. A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in addition to the red reflector. (b) No person shall operate a bicycle unless it is equipped with a bell or other device capable of giving a signal audible for a distance of at least 100 feet, except that a bicycle shall not be equipped with nor shall any person use on a bicycle any siren or whistle. (c) Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheel skid on dry, level, clean pavement. (Ord. 1781-1960) 73.142 BICYCLE DEALERS Every person engaged in the business of buying or selling new or secondhand bicycles shall make a report to the Chief of Police of every bicycle purchased or sold by the dealer, giving the name and address of the person from whom purchased or to whom sold, a description of the bicycle by name or make, the frame number, and the number of license plate, if any, found thereon. (Ord. 1781-1960) 73.143 RENTAL AGENCIES A rental agency shall not rent or offer any bicycle for rent unless the bicycle is equipped with the lamps and other equipment required in this chapter. (Ord. 2125-1965) 73.154 PENALTY (a) Any person violating this chapter shall be fined $525.00. (b) It shall be the duty of the police officers of the City to issue tickets for violations of this chapter. The tickets shall include the name of the person, his or her address, the section number of this Chapter which was violated or the violation number shown on the reverse side of the ticket, and the date, time and place of the violation. (c) All fines imposed by this chapter shall be paid to the City Clerk. (d) Any fine not paid within 14 days of the date shown on the ticket shall be increased by a late fee of $10.00. (d) Failure to pay a fine within 30 days of the date shown on the ticket shall result in an enforcement action being filed in Wayne Superior Court No. 3 - Small Claims Division.
