TOWN OF FRASER 0/( AN ORDINANCE AMENDING ORDINANCE NO. 53 ENTITLED "AN ORDINANCE AND MAP ESTABLISHING ZONING DISTRICTS IN THE TOWN OF FRASER, COLORADO; REGULATING AND RESTRICTING THE USE OF BUILDINGS, STRUCTURES AND LAND; THE LOCATION, HEIGHT, BULK AND SIZE OF BUILDINGS AND OTHER STRUCTURES; GOVERNING THE AREA OF YARDS, COURTS, OPEN SPACES AND PLACES SURROUNDING BUILDINGS AND STRUCTURES; LOT SIZES AND PERCENTAGE THEREOF THAT MAY BE OCCUPIED; CONTROLLING THE DENSITY OF POPULATION; DIVIDING THE ZONED AREA INTO DISTRICTS FOR ZONING PURPOSES; ADOPTING A MAP OF SAID AREA AND THE ZONING DISTRICTS CONTAINED THEREIN, SHOWING BOUNDARIES AND THE CLASSIFICATION OF SUCH DISTRICTS; ESTABLISHING A BOARD OF ADJUSTMENT AND APPEAL PROCEDURES; PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT OF SAID ZONING PROVISIONS; DEFINING CERTAIN TERMS USED HEREIN; PRESCRIBING PENALTIES FOR THE VIOLATION HEREOF; AND REPLACING ALL ORDINANCES IN CONFLICT HEREWITH, BY CHANGING THE NUMBER OF UNITS PERMITTED IN A SINGLE BUILDING IN R-4 LOW DENSITY ZONING DISTRICTS. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO: 1. That Article II of Ordinance No. 53 as amended by Ordinance No. 69 establishing an R-4 Zone entitled "Zoning District, Zoning Map and District Boundaries," Section 1 entitled "ESTABLISHMENT OF DISTRICTS" shall be amended by: Changing the paragraph identified as "R-4 Low Density Multi-Family Residence" to read as follows: "R-4 Low Density Multi-Family Residence. This District is for low density multi-family dwellings, where not more than four (4) units are desired within a building or on a single parcel of land." 2. That Article III of Ordinance No. 53 as amended by Ordinance No. 69 entitled "District Regulations", Section 2A entitled "R-4 Residential District," Subsection A-2 shall be amended to read as follows: "Multi-family dwellings, not to exceed four (4) dlflelling units within a building or on a single parcel of land." 3. All other provisions of Ordinance No. 53 shall remain as originally written and said Ordinance shall be and hereby is readopted as amended. It is the intent of this Board that this amendment shall not waive any rights or claims of the Town of Fraser for any violations of Ordinance No.53 which may have occurred prior to this amendment. 4. This Ordinance is hereby declared to be severable and should any part, section, sentence, clause, phrase, or word of this Ordinance for any reason be held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance and for this purpose, it is hereby declared that the Board of Trustees of the Town of Fraser, Colorado would have passed this ordinance and each part, section, subsection, sentence, clause, phrase or word thereof, irrespective of the fact that anyone or more portions hereof be declared invalid.
