AN ORDINANCE OF THE CITY OF IONA, IDAHO;
AMENDING SECTION 11-11-6 OF THE IONA CITY CODE
RELATING TO THE USE OF ACCESSORY BUILDINGS;
MAKING CERTAIN CLARIFICATIONS THERETO;
PRESERVING PRIOR ORDINANCE; PROVIDING FOR
METHODOLOGY; PROVIDING FOR SEVERABILITY AND
ESTABLISHING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO THAT:
Section 1. Amendment of Section 11-11-6 of the Iona City Code: Section 11-
11-6 of the lona City Code is amended as follows:
11-11-6: ACCESSORY BUILDINGS:
(A) Accessory buildings shall not be located in any required front yard area or closer to
the street than the front face setback line.
(B) Accessory buildings greater than two hundred (200) square feet in total area shall
not be located closer than five (5) feet from any side or rear property line.
Accessory buildings less than two hundred (200) square feet
in total area shall not be located closer than
twethree (23) feet from any side or rear yardproperty line.---Those-exeeed>ng
(C) Accessory buildings greater than two hundred (200) square feet in total area shall
requirenot be installed or constructed unless a building permit ,
is obtained, provided however accessory
structures in the Agriculture (A) zone may be constructed without a building permit
regardless of size.
Section 2. Methodology. Text that is underlined in the preceding sections
means new text added to the former Ordinance or City Code Section, and text that is
stricken through means text that is being deleted from the former Ordinance or Code
Section. Text that is moved from one location in the former Ordinance or Code Section to
another location is similarly shown as underlined text.
Section 3. Severability. The sections and subsections of this Ordinance are
severable. The invalidity of any section or subsection shall not affect the validity of the
remaining sections or subsections.
Section 4. Preservation of Prior Ordinance. The sections of the City Code
repealed or amended by this Ordinance shall be preserved to the extent necessary to allow
the arrest, prosecution and punishment of any person who violates such provisions prior
to the effective date hereof.
Section 5. Effective Date. The water rates set forth in Section 1 above shall be
effective with respect to all customer accounts billed after the effective date of this
Ordinance. This Ordinance shall become effective upon its passage, execution and
publication in the manner provided by law.

Falls, Bonneville County, Idaho, publishers of The Post Register, a newspaper of general
circulation, published Tuesday through Sunday at Idaho Falls, Idaho; said Post Register being a
consolidation of the Idaho Falls Times, established in the year 1890, The Idaho Register,
established in the year 1880, and the Idaho Falls Post, established in 1903, such consolidation
being made on the First day of November, 1931, and each of said newspapers have been published
continuously and uninterruptedly, prior to consolidation, for more than twelve consecutive months
and said Post Register having been published continuously and uninterruptedly from the date of such
consolidations up to and including the last publication of notice hereinafter referred to.
That the notice, of which a copy is hereto attached and made a part of this affidavit, was

PUBLIC HEARING NOTICE
NOTICE IS HEREBY GIVEN,that the Planning and
Zoning Commission for the City of lona will con-
duct a public hearing on March 8,2017 at 6:30 pm
at the lona-CommUnity Center,Which Is located at
3548 North Main Street, lona, Idaho.The purpose
of the hearing is to consider amending Title 11,
Chapter 11, and Section 6 of the lona City Code
regarding clarification relative to side and rear
property lines when constructing accessory build-
ings.
NOTICE IS FURTHER GIVEN that a second public
hearing will be conducted before the lona City
Council at 7:15 p.m.on March 21,2017 at the said
Community Center,also for final review.
The public is invited to attend and public com-
ment is encouraged. Written ents will e acepted and considered, providedthey
deliv-
ered no later than three full business days prior to
the hearing. Such comments must be physically
delivered to the Office of the City Clerk at 3548
North Main Street, Iona, Idaho. Comments may
