APPROVAL TO ENTER INTO A RESERVATION AND COMMITMENT AGREEMENT BETWEEN THE CITY OF LYNWOOD AND HABITAT FOR HUMANITY OF GREATER LOS ANGELES (HFH), A QUALIFIED COMMUNITY HOUSING DEVELOPMENT ORGANIZATION (CHDO) FOR THE DEVELOPMENT OF AFFORDABLE OWNERSHIP HOUSING AND TO APPROVE HFH AS A CITY DESIGNATED CHDO Comments Habitat for Humanity of Greater Los Angeles is a public benefit nonprofit 501 (c)(3) organization founded to help ease the burden of State, County, and Local Housing Authorities through the construction, acquisition, and sale of housing for households of very low- to moderate - income. Habitat for Humanity of Greater Los Angeles has previously developed housing in Lynwood, with assistance from both HOME and redevelopment funding, and has developed or rehabilitated over 350 homes in the greater Los Angeles area Recommendation Staff recommends that the City Council adopt the attached resolution entitled, "A RESOLUTION OF THE LYNWOOD HOUSING AUTHORITY OF THE CITY OF LYNWOOD AUTHORIZING THE MAYOR TO EXECUTE A HOME PROGRAM RESERVATION AND COMMITMENT AGREEMENT BETWEEN THE CITY OF LYNWOOD AND HABITAT FOR HUMANITY OF GREATER LOS ANGELES (HFH) TO DEVELOP AFFORDABLE OWNERSHIP UNITS AND TO APPROVE HFH AS A CITY DESIGNATED CHDO ". Commissioners Castro, Rodriguez, Santillan -Bess, Alatorre and Morton were present. Also present were Executive Director Haley, Authority Counsel Galante, Authority Secretary Quinonez and Treasurer Hernandez. Authority Secretary Quinonez announced that the Agenda had been posted in accordance with the Brown Act. Withers, Director of Community Developme SUBJECT: Approval to Enter into a Reservation and Commitment Agreement between the City of Lynwood and Habitat for Humanity of Greater Los Angeles (HFH), a Qualified Community Housing Development Organization (CHDO) for the Development of Affordable Ownership Housing and to Approve HFH as a City Designated CHDO Recommendation: Staff recommends that the Lynwood Housing Authority adopt the attached resolution entitled, "A RESOLUTION OF THE LYNWOOD HOUSING AUTHORITY OF THE CITY OF LYNWOOD AUTHORIZING THE CHAIR TO EXECUTE A HOME PROGRAM RESERVATION AND COMMITMENT AGREEMENT BETWEEN THE CITY OF LYNWOOD AND HABITAT FOR HUMANITY OF GREATER LOS ANGELES (HFH) TO DEVELOP AFFORDABLE OWNERSHIP UNITS AND TO APPROVE HFH AS A CITY DESIGNATED CHDO ". Background: Habitat for Humanity of Greater Los Angeles is a public benefit nonprofit 501 (c)(3) organization founded to help ease the burden of State, County, and Local Housing Authorities through the construction, acquisition, and sale of housing for households of very low- to moderate - income. Habitat for Humanity of Greater Los Angeles has a strategic plan that contains five primary goals: 1. Increasing house production and improving building methodologies 2. Mobilizing new capital and developing strategies to support long -term sustainability 3. Building the leadership of the organization, its stakeholders and partners AGEND 4. Leading the transformation of systems that impact affordable housing ITEM 5. Building and enhancing organizational infrastructure and capacity Habitat for Humanity of Greater Los Angeles has previously developed housing in Lynwood, with assistance from both HOME and redevelopment funding, and has developed or rehabilitated over 350 homes in the greater Los Angeles area. Habitat has proven their ability to deliver quality housing with minimal resources. Discussion & Analysis This agreement will commit FY 2010 -2011 HOME CHDO funds in the amount of $315,913 and FY 2011 -2012 HOME CHDO funds in the amount of $304,087 for a total of $620,000, to Habitat for Humanity of Greater Los Angeles to develop affordable single family owner occupied housing units. The attached model agreement has been previously reviewed and approved by HUD and serves as an administrative tool to meet the program regulations related to the reservation and commitment of funds. In order to reserve or commit funds to Habitat for Humanity, the City would need to approve the attached resolution. The effectiveness of the agreement will be contingent upon the subsequent approval of an appropriate loan/ development agreement for the development of the owner occupied residences. The loan /development agreement will contain provisions which authorize the expenditure of HOME funds and will impose appropriate conditions for the use of HOME funds. Fiscal Impact: There is no fiscal impact to the General Fund. The commitment will allow the City to expend HOME funds and meet all required deadlines set forth by HUD for HOME funds. A RESOLUTION OF THE LYNWOOD HOUSING AUTHORITY OF THE CITY OF LYNWOOD AUTHORIZING THE CHAIR TO EXECUTE A HOME PROGRAM RESERVATION AND COMMITMENT AGREEMENT BETWEEN THE CITY OF LYNWOOD AND HABITAT FOR HUMANITY OF GREATER LOS ANGELES (HFH) TO DEVELOP AFFORDABLE OWNERSHIP UNITS AND TO APPROVE HFH AS A CITY DESIGNATED CHDO WHEREAS, the City of Lynwood administers housing activities pursuant to HUD /HOME guidelines located at Title 24 CFR, Part 92; and WHEREAS, in accordance with HUD guidelines, the City of Lynwood is required to reserve and commit 15% of its annual allocation of HOME funds to a qualified Community Housing Development Organization (CHDO); and WHEREAS, The City of Lynwood proposes to enter into a HOME Program Reservation and Commitment Agreement with Habitat for Humanity of Greater Los Angeles, a qualified CHDO, to assist the City in carrying out the HOME requirements of providing affordable housing opportunities to low and very low income residents; and WHEREAS, The City proposes to commit FY 2010 -2011 HOME CHDO funds in the amount of $315,913 and FY 2011 -2012 HOME CHDO funds in the amount of $304,087 for a total of $620,000, to Habitat for Humanity of Greater Los Angeles. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. The Lynwood City Council approves the HOME Program Reservation and Commitment Agreement ( "Agreement') with Habitat for Humanity of Greater Los Angeles, subject to the approval of the form of the agreement by the City Attorney. The agreement will be contingent upon the approval of an appropriate development Agreement between Habitat for Humanity of Greater Los Angeles and the City of Lynwood Successor Agency to authorize the use of HOME funds and impose appropriate conditions for the use of such funds, Section 2. The City hereby commits $620,000 of HOME CHDO funds to Habitat for Humanity of Greater Los Angeles, Section 3. The above mentioned funds shall be used for the development of affordable owner - occupied housing pursuant to HUD HOME regulations, Section 4. Mayor is hereby authorized to execute the agreement. Section 5. This Resolution shall go into effect immediately upon its adoption PASSED, APPROVED AND ADOPTED this 19th day of June, 2012.
