Sumrall moved, and Comm. Shapiro seconded the motion to approve the minutes of the September 28, 2005 meeting as presented. Motion carried: 6-0 3. Oven Forum a) Business aot on the agenda -None 4. Public HeariagslActioa Items a) Rendezvous -Amended Final Planned Development Plaa East Mountain, a Portion of Filing 1 continued from September 28, 2005 b) Rendezvous -Preliminary Plat East Mountain, Filing 5 continued from September 28, 2005 Comm. Sumrall moved, and Comm. Brent seconded the motion to open both the Public Hearings referenced above. Motion carried: 6-0. Planner Trotter reviewed these items, as they are intertwined. Following review, Comm. Sumrall moved, and Comm. Watson seconded the motion to close the Public Hearings. After discussion, Mayor Cook moved, and Comm. Watson seconded the motion to approve the Amended FPDP for a portion of East Mountain Filing 1 and the Preliminary Plat for East Mountain Filing 5 subject to the following conditions: Planning Commission Minutes 10/26/05 Page 2 1. Add plat note that states lots 1-27 are for single-family residences. Or simply change the site data table to read "total number of single family lots." 2. Add density/ acre information to site data table. Acre is spelled wrong. 3. Add reception # of previous FPDP and leave a blank for the amended FPDP that is to be recorded. 4. Add basis of bearing/ description /control point. 5. The setback language on the plat should be the same as that on the amended FPDP. 6. There is a typo in the title of the plat ("preplat vs replat") . 7. The notes refer to Tract C alternatively as a private roadway and as private open space. It can not be both. Change the language in plat note #9 to state that tract C will also be an access easement and will not be gated. 8. Open space numbers and percentages need to be clarified by the applicant to ensure compliance with the PDD. 9. Sheet 2 of 5 references "Traffic control to be determined" at the end of the private road. We should have this detailed on the construction plans. In addition, this language is written over the Tract D notation, making it difficult to read. 10. FPDP general note #7 needs to be clarified. 11. Density transfer needs to be added to the site data chart on sheet 4 of 7 on the FPDP. 12. On the construction plans, change the contact at Water Quality Control Division to Andy Poirot. 13. Add Allen Nordin on Town of Fraser contact. 14. Calculate total snow storage and add to plat. 15. Show location of community trail in 4E on plat and FPDP. 16. Approval by Town Engineer. 17. Approval by Town Attorney. Sumrall moved, and Comm. Watson seconded the motion to open both the Public Hearings referenced above. Motion carried: 5-0. Planner Trotter reviewed these items, as they are intertwined. On the construction plans, change the contact at Water Quality Control Division to Andy Poirot. 2. Add Allen Nordin on Town of Fraser contact. 3. There is a typo in plat note # 4. Side is spelled wrong. In addition, the setback language on the plat should be the same as that on the amended FPDP. 4. Single is spelled wrong on the site data table. 5. It is not clear whether Tract A is one contiguous parcel. If it is not, there should be separate tract designations. Also, the plat states that Tract A is open space, yet it includes parking areas for the TH and the private road. This should be clarified. 6. The parking for the TH does not appear to meet the town regulations. 7. Friendship should be listed as a public ROW. 8. Add a plat note that states that Wildflower Lane is a private drive with a public access easement and will not be gated. 9. Add reception # of previous FPDP and leave a blank for the amended FPDP that is to be recorded. 10. State statutes require provisions for accessible dwelling units within multi family developments. The applicant will need to conform compliance with these requirements. 11. Show location of trail in 4E on the plat and FPDP. 12. Calculate total snow storage and add to plat. 13. Clarify open space percentages. 14. The applicant shall provide two (2) copies of the proposed restrictive covenants, townhome declarations, property owners' association, articles of incorporation and bylaws. 15. The density transfer resulting from EMF5 needs to track with the site data chart on sheet 3 of 5 on the FPDP. 16. Approval of Town Engineer. 17. Approval of Town Attorney. Motion carried: 5-0 Planning Commission Minutes 10/26/05 Page 4 e) Annual Update to the Town of Fraser Three Mile Plan Following brief review for the benefit of new Commissioners, Comm. Watson moved, and Comm. Shapiro seconded the motion to approve the Plan pursuant to the 2003 Comprehensive Plan, with no change, and recommend approval to the Town Board. Motion carried: 5-0 5. Staff Choice The annual Town Holiday Gathering will be held, following a brief Board meeting, the evening of Wednesday, December 21. Details to be announced. 6. Commissioners' Choice There was discussion of how much of the documentation from the Town Attorney and Town Engineer should be passed along to the Commission. Planner Trotter summarizes their comments in the information she puts together for the Commission. The Commission decided to leave it to the discretion of the Planner. Comm. Shapiro moved, and Comm.
