Commissioners: Vesta Shapiro, Steve Sumrall, Scott Brent, Fran Cook, and Peggy Smith. Staff: Tvwii Planner Catherine Trotter, Town Clerk Lu Berger Others: See Attached Chair Coulson called the meeting to order at 6:33 p.m. 1. Roll Call 2. Approval of March 28, 2007 regular meeting minutes. Comm. Shapiro moved, and C..~~u~~. Smith seconded the motion to aYN.ove the minutes as amended. Motion carried: 6-O. 3. Open Forum a) TP Trotter expresses her appreciation to Motor Coulson for her years of service, as she has tendered her letter of resignation effective after this meeting. Warren Watson has also tendered his resignation effective immediately. 4. Public Hearing/Action Item a) Amended Final Plan Cozens Meadow at Grand Park Applicant =Grand Park Devel..Y~~~ent, LLC. b) Final Plat Cozens Meadow at Grand Park/Amendment No. 1 Applicant =Grand Park Development, LLC. Comm. Cook moved, and C~~~u~~. Sumrall seconded the motion to open the public hearing on Amended Final Plan Cozens Meadow at Grand Park & Final Plat Cozens Meadow at Grand Park/Amendment No. 1 concurrently. Motion carried: 6-O. Grand Park has submitted an amended final plan and an amended final plat for Cozens Meadow at Grand Park. The applicant has requested these amendments in order to rename streets, increase the size of lots #4-24 and to allow Accessory Dwelling Units (ADU's). TP Trotter gave the Commission a history of the ADU discussion iri Grand Park. Comm. Sumrall addressed some of the components of the Conditional Use P.,~ ~~~it, including the fact that the conditional use permit may be revoked, if necessary. The applicant does not want the ADU to count towards their overall entitlements regarding density. Comm. Cook asked how the applicant will deL.:~~,.ine where the ADU's will be placed. Applicant explained the ADU's will be an available option to a buyer when the purchaser picks out their home plan. TP Trotter gives the commission an overview of the current parking restrictions and snow storage and how that affects the ADU. Creation of ADU's by homeowners in the future is addressed. Size of units addressed and the need for the applicant to come before the Board is discussed. Grand Park would like the ADU conditional use permit to be processed administratively and not be subject to public hearings unless the size limitations are exceeded. Plat note & plan will need to be revised. Plat amendments are as follows: the lots along the meadow have been made deeper. 20ft. rear setback on lots adjacent to wetlands. aft setback on some of the lots is now 20ft. Comm. Cook moved, and Comm. Shapiro seconded the motion to close the public hearing on Amended Final Plan Cozens Meadow at Grand Park & Final Plat Cozens Meadow at Grand Park/Amendment No. 1. Motion carried: 6 -O C..~~u,~. Sumrall moved and Comm. Cook seconded the motion approve the Amended Final Plan Cozens Meadow at Grand Park & Final Plat Cozens Meadow at Grand Park/Amendment No. 1 with the following recommendations: • Will need to amend the plat to add signature lines for all property owners (including the T., ~~~~) & lien holders. The T.r~~.. will require an updated title commitment prior to recording the plat to ensure all property owners have signed the plat. • Plat & plan notes will need to be revised regarding ADU's and the administration of such conditional uses. Applicant to wordsmith the notes and get revisions back to staff. • Reciprocal use easement for side & rear setbacks to be added to plat, allowing homeowners to use the complete Eft between units. • ADU's will not affect the density. • AYY~oval of all documents by the Tvw~~ Engineer and Tuwir Attorney. Shapiro seconded the motion to open the public hearing on Final Plat & As-Built Plat, Nedele Tuw~~homes Subdivision. Motion carried: 6 -O TP Trotter summarized the project. Nick Nedele has submitted a final and as- built plat fora 2 unit townhome project located on Wapiti Drive. The structure was originally constructed as a duplex and the applicant is trying to subdivide the property in order to sell each unit separately. Each unit has 3 bedrooms, a 2 car garage and 1 on-site parking space. Comm. Cook moved, and Comm. Shapiro seconded the motion to close the public hearing on Final Plat & As-Built Plat, Nedele Townhomes Subdivision. Motion carried: 6 -O Comm. Cook moved and Comm. Brent seconded the motion aNY~ ove the final plat with following recommendations: • The applicant needs to submit a warranty deed conveying the common elements to the HOA. Deed to be aY~. oved by Town Attorney. • Add Lienholder to legal documents per title commitment. • Delete and/or modify plat notes per Rod McGowan's memo to remove disclaimers Ti ~.~~~ surveyor. • Change density/acre in the site data chart. d) Final Plat/As-Built Plat Mink Lane T., w ,homes Ptarmigan Subdivision Comm. Brent moved, and Comm. Cook seconded the motion to open the continued public hearing on Final Plat/As-Built Plat, Mink Lane Townhomes, Ptarmigan Subdivision. Motioa carried: 6 -O. PUBLIC FIEARIlVG WILL BE RE NOTICED Herb Meyring will be at the May PC meeting requesting a variance because the subdivision does not have 55% open space. Herb was not iri attendance, will be back before the commission on May 23, 2007. Comm. Shapiro moved, and Comm. Smith seconded the motion to close the public hearing on Final Plat/As-Built Plat, Mink Lane T.,w~~homes, Ptarmigan Subdivision. Motion can3ed: 6 -O. 5. Staff Choice- TP Trotter thanked Motor for her years of service. 6. Commissioners' Choice Brent- who chairs the Commission with Comm. Coulson's resignation?
