a) Development Permit -Continued Public Hearing

Mayor Cook moved, and C.~..,~~~. Shapiro seconded the motion to open the
public hearing on the Development Permit Fraser Quickstop/Car Wash 300
Eisenhower Ave. Motioa carried: 6-O.
Proof of publication given.
TP Trotter outlined the project for the commission.
Signed Special Use P~~.~,it from Fraser Quickstop received by staff.
A list of conditions recommended for approval was given to the Commission. All
conditions wtie outlined for the Commission by TP Trotter.
Chair Sumrall asked for clarification of condition # 2.
Noise was addressed. Gary Mills has given staff a study of decibel report for the
dryers. The use of On-Board dry~~~ was discussed as a means to reduce the noise.
Hours of operation were discussed

Signage, colors of siding & roof were described, color samples were given to the
Commission.
Signage was described to the Commission also.
Nat Havens addressed the Commission concerning the impact of the car wash
noise on his property. Previous decisions by the Commission have already caused
an impact on his property.
C~~~u~~. Shapiro moved, and Comm. Brent seconded the motion to close the public
hearing on the Devel~.Y~~~ent P.:~~~~it Fraser Quickstop/Car Wash 300 Eisenhower
Ave. Motion carried: 6-O.
C.,~~u~~. Smith moved, and Mayor Cook seconded the motion to approve the
Development P~~~~~it Fraser Quickstop/Car Wash 300 Eisenhower Ave. with the
following conditions:
1. Off-site snow storage is required, verified by letter from property owner.
2. The development permit shall have a condition that states the applicant
shall not store any on-site snow iri the public right-of-ways, including,
but not limited to, streets, alleys and sid.;~alks. The snow shall be
stored on the Fraser Quickstop property in the location specified per the
approved site plan. When the snow reaches the height of the fence (6'),
the applicant shall haul the snow to the off-site location. If the applicant
does not conduct snow management iri conformance with the arr~oved
plan and the ~~Y,2sentations made by him and/or his consulting team at
the PC meetings iri June, July, August land September 2007, the Town
shall notify the applicant in writing. The applicant shall have 48 hours
after notification to haul the snow away, after which time any snow
encroaching in a public right of way shall be hauled away by the Town,
or its designee, at the owner's expense. In the event that the property
~W~~er fails to reimburse the T~w~~ for costs incurred, the development
permit may be revoked, and/or a lien may be placed against the
property.
3. The devel..r...ent p.:~ ~~~it shall have a condition that states that a
maximum of 15 cars associated with the auto repair/tire shop shall be
allowed to be parked on the property. The ma~tmum number of 15
includes vehicles being repaired, waiting to be repaired and those waiting
to be picked up. 5 vehicles are permitted to be parked iri the garage and
10 vehicles are p~.~ ~~~itted to be parked on site in the parking lot. If the
maximum number of vehicles is exceeded, the Tuw~~ shall notify the
applicant iri writing. The applicant shall have 5 business days after
notification to ~ ~~~~ove the excess vehicles after which time the vehicles
shall be towed away by the T..~~~~~ at the owner's expense. In the event
that the property ~+~~~er fails to reimburse the T.,w~~ for costs incurred,
the devel.,Y..~ent permit may be revoked, and/or a lien may be placed
against the property.
4. The devel.,N...ent p~.,.,it shall have a condition that states that "No
vehicular stacking is allowed on Eisenhower, and no parking is p~.~~~~itted
in the alley."
5. The dumpster enclosure shall be re-sized to 16' X 16' and in working
condition per the site plan
6. Sand/oil separator to be approved by the FSD prior to issuance of
building permit. Sand/oil separator shall be cleaned as necessary and at
a mimtmum annually. A copy of the report shall be submitted to the
TvwiY and the Fraser Sanitation District.
7. Plan/profile sheet of water & sewer to be submitted and approved prior
to issuance of building p~~ ~~~it.
8. Delivery trucks shall load and unload on-site according to the location on
the site plan. Under no circumstances shall delivery trucks obstruct
traffic and/or the public right-of--ways, including streets, alleys and
sidewalks.
9. Add the following general note to the construction notes: "All
construction, materials and worlunanship, shall conf~.~.. to the T.~wii of
Fraser Minimum Design Criteria Water Utility Construction Standards
(Apri12007); T.,w~~ of Fraser Street and Roadway Minimum Design
Criteria and Construction Standards (April 2007); and Fraser sanitation
District Sanitary Sewer Design Standards and Specifications (March
2007)." In addition, delete all references to the City of La Junta.
10. All pending signs shall be sh.r~,~~ on a site plan with the actual sign sizes
indicated.
11. All documents to be approved by the Tvw~~ Engineer.
12. Amend note #3-(delete "use existing water tap, no required"), #8-(add
"H-20 traffic rated" after 325o gal.) and # 11- adds FSD and delete # 14.
13. The car wash soaps permitted are only those speci$ed in Exhibit A. Any
deviation from these specifications requires review and approval by the
Town of Fraser and the Fraser Sanitation District.
14. The Town of Fraser reserves the right to review the soap chemical
specifications to ensure compliance with ordinance #262 and amended
by ordinance #317.
15. Applicant shall remove the existing curb at car wash access point and
replace with a curb cut prior to issuance of a C.O.
16. Additional conditions pertaining to: elevations, 6x12 pitched roof, roof
materials and color, same as existing roof; color of the building- 4 ft.
bungalow red, remainder adobe tan; landscaping requia~~~~ent- area
below the sign is to be landscaped yearly; re-roof the fire shop at the
same time; hours of operation- same as the business.
17. On board dryers to be installed and doors to remain closed during the
entire cycle. Building footprint may be shortened by 5ft. on the north
side of the property. Motion carried: 6-O.

Comm. Brent moved, and Comm. Smith seconded the motion to open the
public hearing on the Final Plat/The Village at Grand Park General Store Grand
Park Planned Development District reception # 2005-012709. Motion carried:

TP Trotter gave proof of publication.
Revised plat was emailed to the Commissioners.
TP Trotter reviewed the 2005 Planned Deve1.,Y~~~ent District and the Final Plat
of July '06. History of the project outlined for the Commission. Clari$cation of
parking, snow storage and open space needed.
Town in receipt of a building permit. Will not be issued until outstanding
conditions mentioned in August 30+h memo to the applicant and requested at
the Planning Commission meeting are received and reviewed by T.~~~~ Staff,
Town Engineer and T.,~w~i Attorney.
Layla Rosales outlined the concept and colors for the Commission.
Commissioners gave their ~,~ Terence to the siding- corrugated metal used for
the gas canopy and car wash and brick. Asphalt roof color will be driftwood.
Commissioners are agreeable to the color palette.
Car wash information needs to be submitted to T.~~~~~ staff.
A copy of the Standard Feature Plan was distributed to the Commissioners.
Issues raised at staff level surrounding the plan were outlined for the
Commission.
STANDARD FEATURE PLAN
SIDEWALK MAINTENANCE AGREEMENT
FOR THE VILLAGE AT GRAND PARK GENERAL STORE
THIS STANDARD FEATURE PLAN AND SIDEWALK MAINTENANCE
AGREEMENT FOR THE VILLAGE AT GRAND PARK GENERAL STORE is made and
entered into this day of , 2007, by and between GRAND PARK
DEVELOPMENT LLC, a Colorado limited liability company ("Grand Park") and the
TOWN OF FRASER, a Colorado municipal corporation ("Fraser").
1. Grand Park will be responsible for the purchase and installation of
sidewalks, streets, curbing, lighting, landscaping and trash cans in The
Village at Grand Park General Store (the "General Store") pursuant to the
plan attached hereto as Exhibit A, to be installed in Fraser's dedicated
rights-of--way.
2. After final acceptance pursuant to the separate Subdivision
Improvements Agreement for the General Store, Fraser will maintain and
replace as necessary the streets, curbing, and sidewalks to the same
quality as when those items were granted final acceptance.
3. Once the lighting, landscaping and trash cans are installed and Grand
Park delivers proof that all costs associated with those items have been
paid, they will be accepted by Fraser for maintenance.

4. Fraser will perf..~ ~~~ maintenance and replacement of the improvements
and dedicated rights-of--way as follows:
a. Light bulbs will be replaced in the light fixtures when the original
bulbs are burned out.
b. Light posts will be replaced when damaged or destroyed.
c. Landscaping will be maintained by Fraser staff, including irrigation
and additional plantings.
d. Trash cans will be emptied on Mondays, Wednesdays, Fridays,
Saturdays and Sundays.
e. Trash cans will be replaced by Fraser when damaged or destroyed.
f. Fraser will plow the dedicated streets in accordance with the same
schedule it follows for the downtown area of Fraser.
g. Fraser will remove snow from the dedicated sidewalks when the snow
depth is 3" or greater.

Ms. Rosales recommended removing the Standard Feature Plan in connection
to this Y~..~ect. The Standard Feature Plan may be brought back with future
developments.

Comm. Smith moved, and C~,~~u~~. Brent seconded the motion to approve the
Final Plat/The Village at Grand Park General Store Grand Park Planned
Development District reception # 2005-012709 with the following conditions:
1. Plat note changes per 8-30 memo from staff to the applicant need to
incorporated in the final plat.
2. Clarification and compliance of parking, snow storage and open space
needed as an exhibit.
3. AYY~oval of Town Attorney and Town Engineer.
4. We are in receipt of landscape architectural construction documents for Grand
Park Town Center -Phase 1, Pad #6. We have reviewed this document
concurrently with the final plat. In the past, the Town had conversations with
Jack Bestall about a "standard feature plan." We had asked for information to be
submitted detailing what this plan would be and what level of service would be
expected by all. In reviewing the revised plat notes, we feel that perhaps a
"standard feature plan" isn't necessary. Everything that will be dedicated to the
Town will be maintained by the Town, to the same level of service that currently

exists in other areas of Town. As such, we would like to propose that you
consider the following plat note changes to be incorporated into a revised plat:
Plat note #2:
The foregoing purposes must be reviewed and approved by the Association and
the Founder and must conform to the Town Center Final Plan, Devel~Y~ent
Permit, and any and all applicable design guidelines and design review processes,
and be in accordance with Town Codes and subject to Town of Fraser approval
(add this to the note). Not withstanding the foregoing, a 5' wide pedestrian
corridor shall be maintained on the sidewalk. at all times. The Town has no
obligation or liability with respect to those improvements within the easement
area that ace installed or constructed by the Association or individual tenants
(add this to note).
Delete the rest of the existing plat note #2.
Delete plat note #5. Motioa carried: 5-O.
