SECTION 1. The Preliminary PUD Plan submitted by Central Missouri Professional
Services, on file as Case No . P1301 0 in the Jefferson City Plann ing Division, is hereby approved
for the land referenced above .
SECTION 2. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan .

NOTICE OF PUBLIC HEARINGS ON PLANNING AND ZONING MATTERS
The City Council of the City of Jefferson, Missouri, will hold a public hearing on the following planning and
zoning matter on Monday, August 19, 2013 at 6:00 p.m. in the Council Chamber of the John G. Christy
Municipal Building, 320 East McCarty Street, Jefferson City, Missouri.
1. 2500 TANNER BRIDGE PLACE-PRELIMINARY PUD PLAN. A Preliminary PUD Plan has
been submitted for a 4,500 sf restaurant with outdoor seating and event space. The property consists of
part of the North Half of the Northeast Quarter of Section 25, Township 44, Range 12, particularly
described as follows: Beginning at the northwest corner of said half; thence east along the north line
thereof, to a ravine; thence southeasterly along said ravine to the westerly line of a public road; thence
southerly along the westerly line of said road, to a point 180 feet northerly of the south line of said north
half (measured along the westerly line of said road); thence northwesterly, on a direct line to a point on

Case No. P1301 0 -2500 Tanner Bridge Place; Preliminary PUD Plan. Request filed by
Stephen Karr, property owner, on behalf of Johnny Graham, applicant, for a Preliminary PUD
Plan for a new restaurant. The property is located on the northwest corner of Lorenzo Greene
Drive and Tanner Bridge Place and is described as part of the North Half of the Northeast Quarter
of Section 25, Township 44 North, Range 12 West (Central Missouri Professional Services,
Consultant).
Mr. Barron described the proposal and explained that property has two separate zoning districts.
He stated that part of the property is zoned PUD Planned Unit Development and a large portion of
the property is zoned RS-2 Single Family Residential. Mr. Barron explained that the applicant is
requesting approval of a Preliminary PUD Plan in order to construct a 4,500 square foot restaurant
with outdoor seating and outdoor special event space on the PUD zoned portion of the property. He
stated that the applicant is proposing to construct a driveway built to city street stand~rds to serve
as a future connection to the rear of the property that is zoned RS-2. Mr. Barron explained that an
underlying zoning of C-1 Neighborhood Commercial is proposed. He stated that the main floor
would be used as restaurant space and the lower level would be used as a banquet/special event
space and storage. Mr. Barron explained that the existing house on the PUD zoned portion of the
property will be demolished to accommodate the proposed restaurant. He stated that no bufferyard
is proposed due to the designation of the neighboring property at 2506 Tanner Bridge Place as
commercial on the Development Plan Map of the of the Comprehensive Plan.
Mr. Mihalevich left at 5:30 p.m.
Mr. John Graham, 1215 Dry Creek Road, spoke regarding this request and explained that he has
traveled and worked in different restaurants across the country. He decided to return to Jefferson
City and open a restaurant. He will use locally sourced produce when available, and would like to
have a community centered type of feel. The building design would have a feel of an old barn with
large stone fireplaces, and hours would typically be evening service Tuesday through Saturday with
Sunday brunch.

Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding
this .re~uest. Mr. Bates distributed t.h~ following visuals: (1) layout of the proposed restaurant; (2)
Prehmmary PUD Plan; and (3) prehmmary floor plan and architectural rendering. He clarified that
the lower level should be referred to as the terrace level as opposed to the basement level. Mr.
Bates stated that the proposed restaurant will be built high enough so that there will be no issues
with stormwater drainage. He explained that a buffeyard will not be an issue due to the transitional
nature of the property.
Mr. Gary Belshe, 2506 Tanner Bridge Place explained that his property is immediately adjacent to
the subject property. He stated that Mr. Bates misrepresented him to some extent to where there
are no plans to develop his property in any kind of manner. Mr. Belshe explained that he is not
opposed to the proposed development but has two concerns: (1) He does not want Tanner Bridge
Place to be cut off and become an alleyway. Mr. Belshe requested that the applicant protect the
integrity of the street; and (2) his privacy will be eliminated by not having any type of buffer. He
stated that a portion of the parking lot will be within approximately 30 feet of his back door. Mr.
Belshe asked the Commission to require an adequate bufferyard between the two properties as his
property is considerably higher than the Karr property.
Mr. James Brady, 1308 Hoffman Drive, spoke regarding this request and explained that he is not
opposed to the proposed development. His concern is traffic impact due to Lorenzo Greene Drive
being a very high speed road. He stated that Veits Restaurant has added to the traffic to the area.
Mr. Brady inquired whether the stop signs at the intersection of Lorenzo Greene Drive, Tanner
Bridge Road and Tanner Bridge Place are sufficient.
Correspondence in favor of this request was received from Mary K. Vaughn, et.al, 2530 Tanner
Bridge Road.
In response to the concerns voiced by Mr. Belshe and Mr. Grady, Mr. Barron explained that the
City Code requires a traffic impact study for any new development that generates 100 or more peak
hour vehicle trips. He stated that the proposed development will not exceed that number so a traffic
impact study is not required. Mr. Barron explained that the existing intersection has been reviewed
by City Staff and is not a traffic concern. He stated that a future street would not affect access to the
other property from Tanner Bridge Place. Mr. Barron explained that under the normal zoning
guidelines, bufferyards are required between opposing zoning districts. For example if a property is
zoned C-1 Neighborhood Commercial and the neighboring property is zoned single family
residential a Type B bufferyard would be required. He stated that the narrowest version of a Type B
bufferyard consists of a 1 0 foot wide strip of land with small canopy trees planted every 20 feet.
Mr. Barron gave the Planning Division staff report. Mr. Wade gave the Engineering Division staff
report.
Mr. Vaughan inquired whether the proposed restaurant will sit higher in elevation than the
neighboring property. Mr. Bates explained that Mr. Belshe's property is approximately 20 feet
higher than the west side of the subject property. He stated that it was not their intent to
misrepresent Mr. Belshe's position. Mr. Bates acknowledged that they concur with staff comments
and r~commendations and to establish a Type B bufferyard.
Mr. Barron requested to add the following condition: Establishment of a Type B bufferyard along
the property line adjacent to 2506 Tanner Bridge Place.
Mr. Nunn moved and Mr. Vaughan seconded to recommend approval of the Preliminary PUD
Plan subject to the following conditions:
A. Establishment of a Type B buffeyard along the southerly portion of the adjacent property line;
B. Compliance with the comments and technical corrections of the Planning and Engineering
Divisions.
The motion passed 6-0 with the following votes:

a. This approximately 22.7 4 acre site is currently comprised of a combination of
PUD and R.S-2 zoning districts. The submitted preliminary PUD plan proposes a
3,000 s.f. restaurant and banquet area to be constructed in the PUD zoned area.
The site is currently being utilized as a residential area with a house situated in the
PUD zoned area. The restaurant being proposed will be contained in a 100' x 30'
two story structure with outdoor patio seating. The main floor would be utilized
as a restaurant area and the basement floor would be reserved for banquet space.
The owner anticipates the restaurant would operate Tuesday through Saturday
4:00pm to 12:00 am, Sunday 8:00 am to 2:00pm. The facility would also
potentially operate as a coffee shop on days of operation from 6:00 am to 11:00
am. In addition to the restaurant and banquet space, an outdoor space will be
available to accommodate weddings, special events, and potentially a farmer's
market area. It is anticipated that the weddings, special events, and farmer's
market will utilize tents.
b. Site plans/development plans will be submitted as required. A preliminary PUD
plan is attached with this application.
c. No subdivision will be platted as part of this development; however development
of the remaining tract of land may require a plat or dedication of right of way in
the future. A strip of property 60 feet wide is being preserved within the site
plans for possible platting of a future street to access the rear of the property.
d. There are no covenants, conditions or restrictions included as part of this
development.
e. A traffic impact study is not anticipated for this type of development.
f. Signing plans have not been finalized at this time, however, it is expected that the
owner will submit for a conditional use of right of way to locate a sign along
Lorenzo Green Drive. Signage is proposed to adhere to the requirements of the
C-1 neighborhood commercial zoning district.
g. A landscaping plan will be provided with development plans and will adhere to
the City of Jefferson Zoning Code requirements.
h. Outdoor lighting will adhere to the City of Jefferson Zoning Code requirements
for properties zoned C-1.
i. Filing fees are attached and are calculated as follows:

Nature of Request
The applicant is requesting approval of a Preliminary PUD Plan in order to construct a 4,500 sf restaurant

Zoning History
The property has been zoned PUD since its incorporation into the City in 1987.
Location
The subject property is located on the west side of Lorenzo Greene Drive near the intersection of Route B

Staff Analysis
Parking: The parking requirement for a restaurant is 1 space per 100 sf of gross floor area and outdoor
seating area. The building consists of 4,500 sf of floor area and about 1,200 sf of outdoor seating space,
for a total parking requirement of 57 spaces. The Preliminary PUD Plan shows 57 spaces.
Permitted Uses: An underlying zoning of C-1 Neighborhood Commercial is proposed for the purpose of
establishing permitted uses with the addition of outdoor special event area/farmers market as a permitted
use.
Building Design: The building consists of a two story structure, with 3,000 sf on the main floor and
1,500 sf on the lower floor. The main floor would be used as restaurant space and the lower level would
be used as a banquet/special event space and storage.
Signs: Signage is proposed to meet the requirements for the C-1 zoning district. The applicant
anticipates that a permissive use of right-of-way application would be made to the City Council to locate
a sign on the Lorenzo Greene right-of-way.
Lighting: Outdoor lighting is proposed to meet the requirements of the C-1 zoning district.
Future Road: A 60' strip of property is being preserved within the site plan to serve as a future access to
the rear of the property. The 60' strip is proposed to serve as a driveway (built as a street) until platted.
Staff Recommendation
Staff recommends approval of the proposed Preliminary PUD Plan. Much of Lorenzo Greene Drive is
already developed in a commercial manner and the property is identified as commercial on the
development plan map of the Comprehensive plan. A restaurant would be compatible with the existing
and proposed uses of the area. ·

ENGINEERING STAFF RECOMMENDATION-
Preliminary comments have been addressed on the latest submittal of the plan. Engineering Staff
supports approval of this request.
Existing Infrastructure
* Infrastructure need to serve this development exi~s. in the vicinity.
-A future City regional detention basin is planned upstream of this property.
-Sanitary sewer exists to serve this property. .
-Utilities that will be needed to serve this development can be extended from Lorenzo
Greene Drive/Tanner Bridge Place.
-Sidewalk does not exist in the vicinity.
-No extension of streets are needed to serve the property currently, however future street
extension may be necessary to serve the remainder of the property.

Storm Water Drainage
* All storm water drainage from the site is being directed to the main draw/drainage
channel along Lorenzo Greene Drive.
-In lieu of detention for this property, the plan has shown the 25' rip~an corridor to
remain undisturbed and the plan also indicates the 60' stream setback along the
drainage channel beside Lorenzo Greene Drive. Future regional detention has been
planned by the City upstream of this property.
-Both the existing and future Burns and McDonnell Storm Water Master Plan floodplain.
areas have been sh:own on the plan. The proposed restaurant has been sited outside
these areas.
-The development does not lie within the FEMA designated floodpiain, according to the
latest maps dated November 2, 2012.
Sanitary Sewer
* The development is currently served by sanitary sewer. No additional main extension
will be necessary at this time.

Sidewalk
Sidewalk is required in accordance with the Jefferson City Sidewalk Plan along Lorenzo
Greene Drive, however it has been noted that a sidewalk deferral will be requested during
final plan submittal.
-Future sidewalk will be required along a future roadway if the remaining property ever is
developed. The proposed plan considers this in the area of the entrance and access to
Tanner Bridge Place.
Street Access /Traffic Impact
A specific traffic impact study is not required for this plan. Trip Generation projections
for a "Restaurant" use on a Saturday peak hour indi~ate 62 total peak hour trips
generated, less than the 100 trips that would indicate a study being necessary.
-Main access to the development will be from Tanner Bridge Place.
-No additio;nal traffic improvements are anticipated in conjunction with this proposal.
Fire Hydrants/Street Lights/Utilities
* Some facilities exist in the area. Additional facilities will need to meet current City
Standards and requirements.
-Future lighting for the future roadway should be considered.
-Fire hydrants will be needed in accordance with City requirements.
-Other utility services will be needed to serve the proposed facility.

These are comments from the children of the late Mattie Klepper, co-owners of the property at the house
address of2530 Tanner Bridge Road, Jefferson City Missouri, regarding the above request and the hearing to be
held on July 18, 2013 at 5:15p.m.
We wish to state that we have no objections to the proposed Preliminary PUD Plan for a new restaurant at the
above address. In fact, we are encouraged by this plan, as we have hopes of attracting prospective buyers of our
property to consider this location to have commercial potential, as well. We encourage the Jefferson City
Planning and Zoning Commission to support and recommend to city council this proposal. We feel that
approval of this PUD Plan by the Jefferson City Council would be a move in the right direction for these
properties to have increased value, both to their current owners, as well as to the community. Finally, we would
like to have our comments go on record to show our support for this potential venture.
