HomeMy Public PortalAboutResolution 87-1357 PCRESOLUTION NO. 87- 1357PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DENYING CONDITIONAL USE PERMIT NO. 87 -849 AND ZONE VARIANCE NO. 87 -859 The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for a Condi- tional Use Permit to allow the development of a three (3) unit apartment project; and a Zone Variance to permit the first story and second story portions of an apartment building within five (5) and ten (10) feet respectively of the interior side property line for a lot located at 6015 Rosemead Boulevard, the Planning Commission does not find: CONDITIONAL USE PERMIT 1. That the site for the proposed use is adequate in size, shape, topographs and circumstances; and 2. That the site has sufficient access to the streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use; and 3. That the proposed use will not have an adverse effect on the use, enjoyment or the valuation of adjacent property or upon the public welfare. ZONE VARIANCE 1. That there are exceptional or extraordinary cir- cumstances or conditions applicable to the prop- erty involved or the intended use of such property, which do not generally apply to other properties in the same zone; and 2. That such variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other properties similarly situated, which is denied to the property in question; and 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the adjacent property; and 4. That there are special circumstances as provided in Section 65906 of the California Government Code. • Resolution No. 87 -1357 Page 2 Section 2. This project has been determined to be categorically exempt from environmental review in accordance with the State CEQA Guidelines. Section 3. Accordingly, the Conditional Use Permit and Zone Variance is denied. Section 4. The Secretary shall certify to the adoption of this Resolution.
