ORDINANCE REESTABLISHING THE
CUMULATIVE CAPITAL DEVELOPMENT FUND
Under Indiana Code 36-9-15.5
BE IT RESOLVED by the City Council of the City of Richmond of Wayne County, Indiana that a
need now exists for the reestablishment of a Cumulative Capital Development Fund for all uses as set
out in IC 36-9-15.5.
BE IT FURTHER RESOLVED that this Council will adhere to the provisions of Indiana Code 36-
9-15.5. The proposed fund will not exceed $0.0500 on each $100 of assessed valuation. Said tax rate
will be levied beginning with taxes for 2018 payable in 2019.
BE IT FURTHER RESOLVED that proofs of publication of the public hearing held on the 16`h day
of April, 2018, and a certified copy of this ordinance shall be submitted to the Department of Local
Government Finance of the State of Indiana as provided by law. This Cumulative Fund is subject to
the approval of the Department of Local Government Finance.

ORDINANCE NO. 12-2009
AN ORDINANCE RE-ESTABLISHING THE CITY OF RICHMOND
CUMULATIVE CAPITAL DEVELOPMENT FUND
WHEREAS, the City of Richmond, Indiana accepted and passed Ordinance 72-1984
establishing the Richmond Cumulative Capital Development Fund, and;
WHEREAS, Indiana Code 36-9-15.5 allows municipalities to establish and continue a
Cumulative Capital Development Fund, and;
WHEREAS, the City of Richmond finds that such a fund is necessary and prudent for the
financial well being of the municipality, and;
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as
follows:
1. That the City of Richmond hereby re-establishes the Cumulative Capital
Development Fund beginning in the year 2010.
2. The ad valorem property tax levy will continue with the revenues from the levy
being retained in the City of Richmond Cumulative Capital Development Fund.
3. The maximum rate of levy under Section 2 will not exceed $.05 per $100 of
Assessed Valuation each year.
4. The Funds accumulated in the City of Richmond Cumulative Capital
Development Fund will be used for:
IC 8-16-3 The construction, maintenance and repair of bridges,
approaches and grade sections;
IC 36-8-14 The purchase, construction, renovation or addition to
buildings used by the fire department and for the purchase or
rental with option to purchase of police radio equipment;
IC 8-22-3-25 The acquisition of real property and the construction,
enlarging, improving, remodeling, repairing or equipping or
Buildings, structures, runways or other facilities for use in
connection with the airport operated by the City of Richmond;
IC 36-9-4-48 The acquisition of buses and the planning, establishment and
Maintenance of routes and schedules;
IC 36-9-16-2 The purchase, construction, equipment and maintenance of
buildings for municipal purposes, including the acquisition of
land and improvements thereon, the demolition of such
improvements and preparation of such land and the
acquisition, improvement or construction of land or rights -of -
way to be used for public ways to be used as a public way or
other means of ingress or egress to land acquired for the
construction of a municipal building;
IC 36-9-16.5 The acquisition of land or rights -of -way to be used for public
ways or sidewalks and the construction and maintenance of
public ways of sidewalks;
IC 36-9-16-3 The purchase of lease of land, buildings or rights -of -way for
the use of any utility acquired or operated by the City of
Richmond. The purchase or lease of motor vehicles for the
use of the police or fire department, including ambulances
and firefighting vehicles with the necessary equipment,
ladders and hoses. The purchase or lease of equipment
needed by the City of Richmond for any public transportation
use;
IC 36-10-3-21 The purchase or acquisition of land, with or without
buildings, for park or recreation purposes and the building,
remodeling and repair of park and recreation facilities;
IC 36-9-17 The construction, repair or improvement of streets, alleys,
sidewalks, curbs and gutters.
Notwithstanding Section 4 of this Ordinance, funds accumulated in the
Cumulative Capital Development Fund may be spent for purposes other than the
purposes stated in Section 4, if the purpose is to protect the public health,
welfare or safety in an emergency situation which demands immediate action.
Money may be spent under the authority of this section only after the Mayor
issues a declaration that the public health, welfare or safety is in immediate
danger that requires the expenditure of money in the fund.
6. This fund takes effect upon approval of the Department of Local Government
Finance.

AN ORDINANCE CREATING A CUMULATIVE CAPITAL DEVELOPMENT FUND FOR THE CITY OF
RICHM D, INDIANA.
WHEREAS, P.L. 44-1984 allows municipalities to establish a uwnicipal Cumulative
Capital Development Fund; and
WHEREAS, the City of Richmond, Indiana finds that such a fund is necessary and
prudent for the financial well being of'.the municipality;
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana;
SECTION 1. That there is hereby established a Cumulative Capital Development Fund.
SECTION 2. That an ad valorem property tax levy will be imposed and the revenues
from the levy will be retained in the Cumulative Capital Development
Fund.
SECTION 3. That the maximum rate of levy under Section 2 will not exceed;
a. 05 per $100 Assessed Valuation for 1985
b. �6 per $100 Assessed Valuation for 1986
c. per $100 Assessed Valuation for 1987
SECTION 4. That the funds accumulated in the Cumulative Capital Development
Fund will be used for-
I.C. 8-16-3 The construction, maintenance and repair of bridges, approaches
and grade sections;
I.C. 36-8-14 The purchase, construction, renovation or addition to buildings
used by the fire department and for.the purchase or rental with
option to Vurchase fire -fighting equipment and the purchase of

improving, remodeling, repairing or equipping of buildings,
structures, runways or other facilities for use in connection

I.C.36-9-48 The acquisition of buses and the planning, establishment and

I.C.36-9-16-2 The purchase, construction, equipment and maintenance of buildings
for municipal purposes, including the acquisition of land and
improvements thereon, the demolition of such improvements and
preparation of such land and the acquisition, improvement or

Indiana, that the Common Council of the City of Richmond, Wayne County, Indiana,
will meet in the Council Chambers, Municipal Building, Richmond, Indiana an

Said Cumulative CapitalDevelopment Fund shall be used for any or all of the
following purposes permitted by law:

I.C. 36-8-14 The purchase, construction, renovation or addition of fire department
buildings and for the purchase of fire fighting equipment and police
radio equipment,
I.C. 8-22-3-25 The acquisition of real property and the construction, repairing'
or equipping of buildings, structures, runways or other facilities
for use in connection with airport operations,
I.C. 36-9-48 -The purchase of buses for public transit,
I.C. 36-9-16-2 The purchase, construction and maintenance of municipal buildings
including land acquisition,
I.C. 36-9-16-3 and I.C. 36-9-16-5 The acquisition of land, rights -of -way and
construction of public ways or sidewalks,
I.C. 36-9-16-3 and I.C. 36-10-3-21 The purchase of land and buildings for park
or'recreation purposes and the building, remodeling and repair of
park and recreation facilities,
I.C. 36-9-16-3 The purchase of motor vehicles for the police or fire department
and the purchase of equipment for any public transportation use, and
I.C. 36-9-17 The construction, repair or improvement of streets, alleys, sidewalks,

Said Cumulative Capital Development Fund shall levy an additional tax, outside the
limits imposed by the Indiana,Code 6-1.1-18.3 tax control program, on all taxable
personal and real property in Richmond, Indiana to provide funds for said
Cumulat ve Capitai Development Fund, -said tax to be died in 1984, payable
in 198 , and .payable annually thereafter. -

The Common Council of the City of Richmond, Indiana, met in regular session in the
Council Chambers in the Municipal Building of said City July 16, 1984

The Clerk presented proof of publication of Notice to Taxpayers printed in the
Richmond Palladium Item, a newspaper of general circulation in the City of
Richmond, Indiana, on the dates of June 29 and July 6, 1984
Said notices stated that a public hearing would be held on the day of
July , by the Common Council to consider (iv tax levy
as provided for in Ordinance No. 72-1984 , within the City of Richmond,
Indiana. The proof of publication and posting of notices were examined and
found to be correct and in order. Councilman Hankinson moved the proof
of publication and posting of notices be received and ordered filed, seconded
by Councilman Parker and an voice vote the motion was carried.
The Clerk read on second reading Ordinance No. 72-1984
President Elstro announced Ordinance No. 72-1984 was on public hearing.
After hearing all persons present, Ordinance No. 72-1984 was placed on

WHEREAS, there has been filed with the State Board of Tax Cmimis-
sicners of the State of Indiana a certified copy of the resolution
adopted by the proper legal officers of the City of Richmond, Wayne
County, State of Indiana, establishing a cumulative capital development
fund, together with proofs of publication of notice thereof, all under
and pursuant to the provisions of the laws of the State of Indiana.
Now, therefore, the proper legal officers of the City of Richmond,
Wayne County, State of Indiana, are hereby requested by the State Board
of Tax Ctn nissioners to publish the following notice.
PUBLISH THE FOLLOWING ONLY
To the taxpayers of the City of Richmond, Wayne County, State of
You are hereby notified that on the -16th day of July, 1-984, the
Common Council of the City of Richmond, Wayne County, State of Indiana,
pursuant to notice heretofore given, and under and by virtue of I.C.
36-9-15.5, duly adopted a plan whereby a cumulative capital development
fund was established to provide for the following:

The fund will be provided for by a tax levy on all taxable Taal and
personal property in the taxing unit for a period of three (3) years.
The tax rate on each one hundred dollars ($100.00) of taxable property
will be $.05-for 1984 taxes payable in 1985, $.10- for -1985 taxes payable
iiri986, and $.15 for 1936Qtaxes payable in 1987, d�:�,
Fifty (50) or more taxpayers in the taxing unit who will be affected
by the tax levy, may file a petition with the County Auditor of Wayne
County, not later than thirty (30) days after the publication of this
notice, setting forth their objections to the proposed levy. Upon
filing of the petition, the County Auditor shall immediately certify the
same to the State Board of Tax Commissioners, which Board will fix a
date and conduct a public hearing on the proposed levy before issuing
its approval or disapproval thereof.
