THIS INDENTURE, made and entered into this 18th day or --
September, 1947, by and between TYBEE BEACH COMPANY, a Corporation of the
State of Georgia, with its office and principal place of business in Savannah,
Georgia, as party of the first part, and JOHN J. OWEN and JOSEPH A. O'LEARY,
Co- partners trading as HARRIS BLOCK COMPANY, of Chatham County, Georgia, as
parties of the second part:
VVITNESSETH:
THAT the said party of the first part, for and in
consideration of the sum of Ten Dollars ($10.00) to it in hand paid by the
parties of the second part, at and before the sealing and delivery ofthese
presents, the receipt whereof is hereby acknowledged, has remised, released,
and quitclaimed, and by these presents does remise, release and forever quit
claim unto the said parties of the second part, their heirs, and assigns, all
the right, title, interest, claim or demand the said party of the first part
has or may have had in and to the following described property, to -wit:
jTJ1 that certain tract or parcel of land situate, lying
and being in Chatham County, Georgia, in the Town of Savannah Beach, and
known upon a map or plat of said Town as TYE PORTION OF FIFTH AVENUE LYING
BETWEEN THE NORTHERN AND SOUTHERN BOUNDARIES OF LOT ONE HUNDRED FORTY-
FOUR (144), WARD THREE (3), EXTENDED WESTWARD, and bounded as follows: On
the North by the Northern boundary of Lot One hundred forty -four (144),
Ward Three (3), extended Westward, on the East by Lot One hundred forty -
four (144), Ward Three (3), on the South by the Southern boundary of Lot
One hundred forty -four (144), Ward Three (3), extended Westward, and on the
West by lands of Tybee Beach Company.
TO HAVE AND TO HOLD the said property with all the
appurtenances thereunto belonging to the said parties of the second part,
their heirs and assigns, in fee simple forever, freed from the claims of
the said party of the first part or any person claiming by, through or
under it.
IN WITNESS WHEREOF, the said party of the first part
has caused these presents to be executed in its corporate name and on
its behalf by its duly authorized officers, and its corporate seal duly
attested hereto attached, on the day and year first above written.
