MINUTES OF THE SELECT BOARD REGULAR SESSION MINUTES
DATE : September 21, 2020
TIME : 5 : 30 PM
PLACE : Remote Teleconference
ALL PARTICIPANTS ARE PARTICIPATING REMOTELY : Chair Chaffee, Selectperson Bingham , Selectperson
deRuyter, Selectperson Whitney, Selectperson Chatelain ( 5 : 45 ) , Town Administrator Peter Lombardi ,
Assistant Town Administrator Donna Kalinick, and Executive Assistant to the Town Administrator Robin
Young
Call to Order & Declaration of a Quorum & Meeting Participation Statement
Chair Chaffee called the meeting to order at 5 : 32pm , conducted a roll call vote of attendance and declared a
quorum present .
Recording Statement
Chair Chaffee read the required remote and recording statement . Chair Chaffee stated that the Board would be
going into executive session to discuss strategy with respect to litigation if an open meeting may be
detrimental to the litigating position of the public body and the chair so declares : Brewster Inn , Inc . d/ b/a j
"Woodshed " (Alcohol Beverages Control Commission ), and to return to open session .

Selectperson Bingham moved that the Board go into executive session at 5 : 36 pm to discuss strategy with
respect to litigation if an open meeting may be detrimental to the litigating position of the public body and
the chair so declares : Brewster Inn , Inc . d / b/a "Woodshed " ( Alcohol Beverages Control Commission ), and to
return to open session . Selectperson Whitney second . Selectperson Whitney-yes, Selectperson deRuyter-yes, 3
Selectperson Bingham -yes, Chair Chaffee -yes . The Board vote was 4-yes, 0- No and each member declared
that no other person is present and/or able to hear the discussion at the remote location . a

Anticipated Resumption of Open Session at 6 : 00 PM - Public Announcements and Comment : Members of
the public may address the Select Board on matters not on the meeting' s agenda at the Chair' s discretion .
Under the Open Meeting Law , the Select Board is unable to reply but may add items presented to a future

Select Board Announcements and Liaison Reports
Selectperson Bingham thanked the Town Voters for their attendance the 2020 Town Meeting . Selectperson
Chatelain announced a Planning Board meeting on Wednesday September 23 , 2020 at 6 : 30pm where several
important items will be discussed .

Town Administrator' s Report
The outdoor dining order has been extended to 90 days beyond the end of the State of Emergency . The State
Department of Health has announced a new public impact survey that the Town will distribute . The State has
also further delayed collection of the meals and lodging tax for eligible businesses until next spring . The
Town is set to receive the quarterly disbursement in a week or so . The deferment makes it challenging to
know if there will be revenue shortfalls and what they are due to . it will make it difficult to forecast FY22
receipts . The Cape Cod Reopening Task Force will be meeting again next week . Brewster has 128 positive
Covid cases, with 2 new cases in the past week; only 5 in total in the past 7 weeks . The Council on Aging is
now offering expanded services, such as limited transportation and online programming . The Recreation fall
programming is full . They have changed soccer to a clinic version , as opposed to Town versus Town . The
Library is still offering curbside pickup . A new rental assistance fund for residents has been announced .
Applications for the Covid relief fund will be released shortly . The free cash was certified at a little over 4
million dollars . There was a significant roll over balance from FY19 . The certified number did not include the
capital and other expenditures voted at town meeting . With those items deducted , the current balance is
about 2 . 6 million dollars . There is approximately 1 . 7 million on the Capital Plan for FY22 . Further long range
planning with be watched to see how things go with the Covid49 pandemic . Mr . Lombardi reviewed the
revenue figures used for building the FY20 budget; short term rental expansion revenues were not allowed
to be counted in building the budget He gave kudos to all department heads who were able to reduce
spending during the spending freeze and budget forecasts . Mr . Lombardi reviewed some of the DPW

projects that are going on throughout the town .

release of those that are able .
Discuss and Vote on Select Board Letter to Governor Baker Requesting the Release of State Information
Technology Bond Bill Funds
Chair Chaffee noted that the Assembly of Delegates sent a similar letter to Governor Baker on September 15,
2020 . Citing a lack of technology that a lot of Cape residents have access to, the releasing of the funds would
help support needed expansion on infrastructure . Selectperson Bingham moved to approve to the sign the
letter to Governor Baker, Requesting the Release of State Information Technology Bond Bill Funds,
Selectperson Whitney second . A roll call vote was taken . Selectperson Whitney-yes, Selectperson Chatelain -
yes, Selectperson deRuyter-yes, Selectperson Bingham -yes, Chair Chaffee -yes . The Board vote was 5 -yes, 0-
No .
6 : 15 Public Hearing — Fiscal Year 2021 Tax Rate Classification Hearing, Discussion V Deputy and Vote,
Collector James Gallagher
Chair Chaffee opened the Fiscal Year 2021 Tax Rate hearing at 6 : 15pm . Deputy Assessor James Gallagher
reviewed the legal requirement for holding a classification hearing, logistics of the hearing and what the
outcome of the hearing results is . He gave an overview of the presentation included in the meeting packet to
the Select Board , including the options on the tax rate and recommendations on which options to consider
from the Board of Assessors . Chair Chaffee opened the discussion to the Select Board . The Select Board all
agreed to support the Board of Assessors recommendation of a single tax rate with a residential factor of 1
and do not see an advantage to a residential exemption at this time . Selectperson Chatelain noted that the
Board intended to review the tax relief options for citizens in a more extensive review this fall . Selectperson

Bingham moved to approve to continue the use of a residential factor of 1 , to not grant an open space
discount, to not grant a residential exemption , and to not grant a small business exemption , Selectperson
Whitney second . A roll call vote was taken . Selectperson Whitney-yes, Selectperson Chatelain -yes, 3
Selectperson deRuyter-yes, Selectperson Bingham -yes, Chair Chaffee-yes . The Board vote was 5 -yes , 0- No .

Discuss Feedback on FY21 -22 Select Board Strategic Plan Priority Goals and Vote to Finalize Plan
Following up on the summer retreat, Mr . Lombardi assembled the individual feedback on the priority goals
of the Select Board . There were 11 goals in total that were clear high priority for the upcoming fiscal year, 4 3
goals were identified as low priority by a majority of the Board . Selectperson deRuyter suggests adding
changes to the Community Preservation Committee funding formula to the higher priority set . It was agreed
by the Board to make it the 12th high priority goal . The 4 lower priority goals were reviewed . Selectperson
Chatelain noted they are not being removed from the list but could be held off for discussion until next year .
Mr . Lombardi noted that even if some are not included in the plan that they most likely will be continued to
be worked on throughout the year . Responsible parties and timelines will be designated to each item and {
brought back to the Board .

Discuss Consensus Town Administrator Performance Evaluation Results and Vote on FY21 Salary
Mr . Lombardi ' s work anniversary was in April 2020 . The Select Board have each performed an evaluation and
met with Mr . Lombardi individually . In the meeting packet, there is a compilation of the feedback and
evaluation scores . Select Board deRuyter liked the evaluation form for review and feels the Town of Brewster
is in a better place having Mr . Lombardi working for and living in it . The ability to increase his salary is limited
by the contract they entered into with Mr . Lombardi which will expire in 2022 . Selectperson deRuyter stated
that the Board should make it a priority to execute a new contract . The rest of the Select Board echoed
Selectperson deRuyter sentiments, and thanked Mr . Lombardi . Selectperson deRuyter moved to accept the
review as presented , and to approve the Town Administrator' s FY21 salary increase in line with the
Personnel Bylaw, Selectperson Bingham second . A roll call vote was taken . Selectperson Whitney-yes,
Selectperson Chatelain -yes, Selectperson deRuyter-yes , Selectperson Bingham -yes, Chair Chaffee -yes . The
Board vote was 5 -yes , 0- No .
