Chair Chaffee stated that the Board would be going into Executive Session to discuss strategy with respect to
litigation as an open meeting may have a detrimental effect on the litigating position of the Towns Brewster v .

Selectperson Bingham moved that the Board go into executive session at 5 : 47 pm to discuss strategy with
respect to litigation as an open meeting may have a detrimental effect on the litigating position of the Town ;
Brewster v . Eversource and to return to open session , Selectperson Whitney second . Selectperson Whitney-yes,
Selectperson Chatelain -yes, Selectperson deRuyter-yes, Selectperson Bingham -yes, Chair Chaffee -yes . The
Board vote was 5 -yes, 0- No and each member declared that no other person is present and/or able to hear

Joint Interview and Appointment of Interim Member to the Plannine Board
One applicant submitted a letter of interest to serve the Board ' s interim vacancy until the May election .
Chair Wallace called the Planning Board meeting to order at 6 : 08 pm . The applicant Amanda Bebrin , a local
realtor, has lived in Brewster year- round for 5 years . She volunteers for United Way, and has a similar role in
that organization , vetting applications for housing . She is very passionate about Town government and
would like to be more involved . Selectperson Bingham asked Ms . Bebrin if she was aware of the time
commitment to the Planning Board , which she is and will commit to . The Planning Board members each were
able to ask Ms . Bebrin questions for the interview process .
Selectperson deRuyter moved to appoint Amanda Bebrin as an Interim Member of the Planning Board ,
Selectperson Bingham , second . Select Board Roll - call Vote : deRuyter-yes , Bingham -yes, Whitney-yes,

Chair Chaffee announced that Amanda Bebrin has been appointed as an interim member of the Planning
Board by a vote of 5 - 0- 0 from the Select Board and a vote of 5 -0 - 0 from the Planning Board .

Selectperson Bingham moved to approve the consent agenda as recommended by administration ,
Selectperson Chatelain second . Select Board Roll - call Vote : deRuyter-yes , Bingham - yes, Whitney-yes,

Update on Early and Mail -in Voting Options for Upcoming Fall Elections
Colette Williams, Town Clerk, updated the Board on the Governor' s order from July 6, 2020 Chapter 115 acts
of 2020 which expanded the early voting by mail . All registered voters in the Town of Brewster were mailed
an application where they can opt to vote by mail for the primary and/or November elections .
Approximately 3 , 5004, 000 of those have been returned . When a new voter is registered , the Town Clerk will
mail them a ballot . In - person early voting hours for the State Primary will be located at Town Hall August 22
through August 28, 2020 . In - person regular voting will be held on September 1 , 2020 at the Brewster Baptist
Church . For the State General Presidential November election , in - person early voting hours will be located at
the Town hall beginning October 17 , 2020 until October 30, 2020 . In - person regular voting will be held on
November 3 , 2020 at the Brewster Baptist Church . These dates and hours will be posted on the website and
on BGTV Channel 18 . Other major updates include that the return envelopes for the maikin ballots are
postage paid from the Town . Once the ballot is returned , residents are not allowed to vote in - person . Also ,
at the check- in/out table for in - person voting, the poll pads should be certified by Election Day for electronic
use . Selectperson deRuyter asked if a voter misplaces a card they received in July, what they can do to get
another one . It is posted on the website for citizen ' s to download and send it in . Selectperson Bingham asked
about the recent situations with the Post Office, and if that could impact the voting . Colette Williams has no
update on that situation . The Board thanked Ms . Williams for her hard work .

Discuss and Vote on Hardship Request for Commercial Razor Clam Minimum Mid -Year Harvest
Requirements
One of the elements of the 2020 Commercial Razor Clam harvest program was a mid -year harvest
requirement . If a permit holder was unable to meet those minimums, they could petition their hardship to
the Select Board . There are 3 hardship requests for the Board to take action on . Chris Miller and Ryan Burch
were on the call to assist with any questions . Selectperson Bingham noted that only 3 requests were made, 1
of the 6 that did not meet the requirement . The 3 that did not submit a letter of request will have their
licenses revoked . Selectperson Bingham would only like to grant the hardship request to Alison Joy .
Selectperson Whitney concurs . Selectperson Chatelain asked how many people were on the wait list for a
license . There are 4 people on the waitlist . Selectperson Chatelain is in support of Alison Joy, and is open to j
granting a waiver for the other two given the circumstances this year . Donna Kalinick noted that an
additional email was received from Alison Joy . An email from Leo Marseglia was sent during the meeting . j
Chair Chaffee supports Alison Joy ' s hardship, Thomas Joslin suffered a shoulder injury in March and a similar
situation occurred with Mr . Marseglia . She supports granting a hardship to all three applicants . Selectperson
deRuyter asked how many shellfishers did meet the requirements . 14 of the harvesters did , 6 did not .
Selectperson Bingham would like to add the caveat that they must get 300 pounds by the end of the year to

be granted a license for 2021 . The minimum harvest was 620 pounds for the year . Ryan Burch clarified that
the mid -year requirement was either 15 days harvesting or 300 pounds, and the yearly requirement by
January 31 , 2021 is 620 pounds or 10 bushels . The minimums were created to ensure the license holders
were actively fishing, and not preventing others on the waitlist from shellfishing . Ryan Burch feels that
language should be added to ensure all 3 applicants are actively fishing the rest of the year . The total annual
minimum of 620 pounds needs to be met to ensure they receive a license for next season . Mr Lombardi does
not feel they need to add addition restrictions due to the wording of the regulations . Selectperson Whitney
moved to approve the hardship extension for Alison Joy, Leo Marseglia , and Thomas Joslin , Selectperson

Vote to Clarify New Effective Date of Local Plastic Bag Ban
The local ban was supposed to go into effect on June 1, 2020 . The Board declared at a previous meeting a 6
month delay on the local ban . Selectperson Bingham hopes it does not have to be deferred again . January 1 ,
2021 was the agreed upon date in agreeance with the Recycling Commission . Selectperson Bingham moved
to institute the single use plastic bag ban as of January 1 , 2021, Selectperson Chatelain second . Select Board
Roll - call Vote : deRuyter-yes, Bingham -yes, Whitney-yes, Chatelain -yes, and Chaffee -yes . Vote : 5 - 0- 0 .
Update on Latest Coronavirus Developments and Review of Current State & Local Guidance/ Directives
Mr . Lombardi gave an overview of the State restrictions, and County level restrictions . Phase three has been
ongoing over a month . A new executive order for out of state travel was put into place for travelers to
quarantine for 14 days or produce a negative Covid test upon arrival . The State is starting to look at other j
initiatives, the FY21 budget, and Federal relief. The state aid numbers are being based on the FY20 actual
numbers . The Cape Cod Reopening Task Force is still actively meeting . Trend data is starting to plateau and
head in a downward direction . The number of hospitalizations remains very low . In the past 2 weeks, 12 new
cases were documented in Brewster . The Health Department has been proactive with conversations with the
restaurant community . Town offices have been open for 4 weeks, and all feedback received has been
its . The outdoor dining modification policy implemented by the

Town has had 9 applicants . The beaches are proving to be challenging but the Town continues the Beach
Ambassador program to educate beach goers . The Ambassador' s produce a weekly report and observation
summery for internal Town review . Parking was reduced at Breakwater Beach twice , down to 31 spaces .
Demand on the beaches has been high , as was anticipated . Signage is being posted at some of the more
crowded and smaller beaches in the event staffing is not able to be at those locations . Restricting day passes
and further restriction of parking are options in the event any situations arise . The Council on Aging building
remains closed , but more virtual programing is being considered . School re - opening has been a major focus
over the past couple of weeks . Attendance days have been reduced , and a reopening model plan for Nauset
Regional Schools has been drafted to be considered at a school committee meeting on Thursday August 6, j

2020 . Upon approval , the plan will be submitted to the State . The Select Board had no questions for Mr .
Lombardi . Chair Chaffee read a comment from Dr . Deborah Burkes in regards to the Cov1d49 virus .
Update on FY20 Revenue Actuals
The Finance Director, Mimi Bernardo and Treasurer/Tax Collector Lisa Vitale joined the Board . The FY20
General Fund revenues exceeded the projections by more than $ 500, 000 . 00 . Mr . Lombardi reviewed the
line items of the revenues . The Town is continuing to collect revenues post July 1 , 2020 which will be applied
to FY21 revenues . The Finance team revised the FY21 budget based on the actual figures . One additional
revenue reduction was made to the budget, reducing penalties and interests to $ 100, 000 . 00 . Individual line
item transfers with in the budget will be discussed at the next Select Board meeting, with no major changes
pending . The Select Board thanked the Finance team for their hard work and dedication .
Vote to Open 2020 Town Meeting Warrants, Vote on Proposed Changes and /or Additions to Warrant
Articles and Vote to Close Warrants
Town staff and key town officials will meet later in the week for a planning discussion for the Town Meeting .
An outdoor meeting to be held on a Saturday is a potential consideration . Selectperson Chatelain moved to

Administration to individually speak to the petitioners . Selectperson Whitney noted Article 26 would be able
to be postponed until the spring Town Meeting . Mr . Lombardi feels this article is timely, but a related
petitioner' s article is also included in the warrant . Pending their response to postponing, the Town can
