NOW, THEREFORE, BE IT RESOLVED by tine Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. 'file proposal from Betts Environmental 8e Alternative Fuel Services for the above described UST survey services, as outlined in Betts' proposal dated February 5, 2014, at a total cost not to exceed $7,500.00 is hereby approved; 2. This action is approved as an award of a professional services contract pursuant to the Borough's Fair and Open Process as provided for and in accordance with applicable law. 3. It is our understanding that the borough has acquired approximately 14 properties for the redevelopment project. Betts will perform a survey of the properties in order to assess how many USTs may be present on these properties and to evaluate potential costs to properly close the USTs. Betts is proposing to complete the following tasks as part of this UST survey. Scope of Work Task 1: NJDEP File Review An Open Public Records Act (OPRA) record request will be submitted to the NJDEP Office of Record Access (ORA) for each of the properties in question. A review of available NJDEP site remediation and UST files will be conducted at NJDEP offices in Trenton, or if the number of files is limited, copies of the files will be ordered and then reviewed. Task 2: Local File Review Betts will review all available Borough files. It is assumed that the Borough vdll provide all available files and records that it has in its possession relative to the subject properties. These could include files maintained by the Borough Tax, Building, Engineering, Planning, Health and Fire Departments. Available historical information sources may include historic Sanborn fire insurance maps. historic aerial photographs, City Directories and oilier resources which may be discovered during our review, Task 4: Site Visit Betts representatives will conduct a site visit to visually survey the properties in order to identify evidence of current or former UST systems including fill and vent pipes. Task 5: Geophysical Survey A ground penetrating radar (GPR) survey and electromagnetic (EM) survey are highly recommended. In this type of situation these methods provide the most effective means to identify potential USTs. These surveys could be conducted concurrently with the site visit (Task 4) and would be conducted on each of the properties to detect buried steel tanks and other electrically conductive metal objects. Task 6: Letter Report and Preliminary Cost Evaluation Betts will prepare a brief letter report summarizing the results of the various UST survey tasks described above. To the degree practicable, this letter will also include a preliminary cost estimate or range of possible costs to address the closure and/or remediation of any current or historic UST systems identified on these properties. Soil and ground water sampling (not included in this proposal) may be necessary to more fully evaluate possible contamination and remediation costs related to any current or former UST systems. Estimated Costs Betts will conduct the proposed scope of work outlined above on a time and material basis. The estimated cost for Tasks 1 through 4 and Task 6 is $4,700. The estimated cost for recommended Task 5 (Geophysical Survey) is $2,400. Remuneration This estimate is based on existing site conditions, as well as our experience in similar projects. Although we believe this amount is an accurate assessment of the costs to be incurred during this Page 2 of 4 phase, the actual project implementation may reveal conditions which require additional work, If it appears that project deliverables may differ from what was anticipated and described in this proposal, we will contact you regarding possible changes and /or increases in cost, and obtain your approval to proceed. Limitations Under no circumstances shall Betts Environmental & Alternative Fuels be liable for ally incidental, indirect, special or consequential damages, even if advised of the possibility of the same. The total liability of Betts Environmental & Alternative Fuels under this contract shall be limited to the total amount paid by the client to Betts Environmental & Alternative Fuels. This limitation of liability clause shall not apply to any damages resulting from injury to persons or death.
