HomeMy Public PortalAbout2012.126 (06-19-12)RESOLUTION NO. 2012.126 • RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AWARDING • CONTRACT TO AMERICAN ASPHALT SOUTH, INC. AS THE APPARENT LOWEST RESPONSIBLE BIDDER, IN THE AMOUNT NOT -TO- EXCEED $496,520.00, FOR THE SLURRY SEAL IMPROVEMENT PROJECT, PROJECT NUMBER 4011.67.906; AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT; AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO MAKE THE NECESSARY FUNDS APPROPRIATION AND TRANSFER. WHEREAS, the Slurry Seal Improvement Project (Various Locations), Project No. 4011.67.906 ; is scheduled for completion during fiscal year (FY) 2011 -2012 and is financed with $340,000 of Prop. 1 B Bond funds and $200,000 of Measure R funds; and WHEREAS, Public Works staff advertised the project on May 18 20 and 31 of 2012 in two newspapers of general circulation, printed and published in the City, per Lynwood Municipal Code Section 6 -6.7; and WHEREAS, twenty -two contractors received project plans and contract documents; and WHEREAS, the bid opening took place in the Office of the City Clerk on June 7, 2012, and five contractors submitted bids; and WHEREAS, the Director of Public Works / City Engineer has ascertained that American Asphalt South, Inc. is the apparent lowest responsible bidder at $496,520; and WHEREAS, a reference check has revealed that this contractor has the necessary experience and contractor's license for this type of project, and WHEREAS, the project total for the construction phase of the project cost estimate is $620,650 and therefore the project is under - budgeted by approximately $80,000; and WHEREAS, staff has identified un- appropriated General funds that can be advanced to supplement the project budget; and WHEREAS, the Measure R Bond funds that will be available in August 2012 will reimburse the General Fund for the said amount. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. That the contract for the Slurry Seal Improvement Project (Various Locations), Project No. 4011.67.906, be awarded to American Asphalt South, Inc. for its low bid of $496,520. Section 2. That the Mayor is hereby authorized to execute the agreement between the City of Lynwood and American Asphalt South, Inc. Section 3 . That the City Council of the City of Lynwood authorizes the City Manager or designee to make the following funds appropriation and transfer: FROM Un- appropriated General Funds 'R . TO Slurry Seal Improvement Project Project 4011.67.906 $80,650 Section 4 . That the Measure R Bond Fund shall reimburse the General Fund with $80,650 once the bond funds are available. Section 5. That the City Clerk shall certify as to the adoption of this Resolution. Section 6. That this Resolution becomes effective immediately. PASSED, APPROVED and ADOPTED this 19 day of June, 2012.
