HomeMy Public PortalAboutM 2012-05-01 - CCLYNWOOD CITY COUNCIL REGULAR MEETING May 1, 2012 The City Council of the City of Lynwood met in a regular meeting in the Council Chambers, 11330 Bullis Road on the above date at 6:05 p.m. Mayor Morton presiding. Council Members Castro, Rodriguez, Santillan -Beas, Alatorre and Morton were present. Also present were City Manager Haley, City Attorney Galante, City Clerk Quinonez and City Treasurer Hernandez. City Clerk Quinonez announced that the Agenda had been duly posted in accordance with the Brown Act. Item #6. PRESENTATIONS /PROCLAMATIONS • Sheriff Captain Joseph M. Gooden — Update on Law Enforcement Issues Captain Gooden gave an update on law enforcement issues. He commented on a Lynwood Patch article on recent homicides in the City and he stated that 75% of the four murders in Lynwood could have been prevented and the Sheriff's Department is doing their best to keep homicide down. He stated that Lynwood is down in all categories of crime. He thanked Lynwood officials for attending the Leadership Academy graduation. He announced that the Century Station won 1St place in the station category for the Baker to Vegas run and he presented a slideshow of photos from the race. He presented a commendation to Deborah Jackson for her participation in the race event. City Council Members Reporting on Meetings Attended (Gov. Code Section 53232.3(D)) Mayor Pro Tern Alatorre stated that he attended an ad hoc committee meeting of the Water Replenishment District. Mayor Morton stated that he and Council Member Rodriguez attended Senator Lowenthal's Women of Distinction Celebration. He recognized Paulette Bradley, Lucy Avalos and Lorene Reed. He announced that the Los Angeles Vector Control District has put out an alert on the Asian Tiger Mosquito and he showed a video. Item #7. COUNCIL RECESS TO: CITY OF LYNWOOD AS THE SUCCESSOR AGENCY TO THE LYNWOOD REDEVELOPMENT AGENCY 6:31 p.m. LYNWOOD PUBLIC FINANCING AUTHORITY 6:38 p.m. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) Harry Gibbens asked the City Council to address the gopher problem at the parks and public areas. PUBLIC ORAL COMMUNICATIONS Irene Garcia commented on the City's red light cameras. She asked the Council to eliminate the red light camera program. She also commented on excessive tire repair costs which the City pays. She recommended that staff change their own tires. Joaquin Mesinas provided pictures of City employees picking up trash to the City Clerk. He commented on budgeting priorities and asked the Council to support employees with the proper equipment so they could do their job. He also commented on Plaza Mexico's vacant lot on the corner of State Street. Reyna Rios commented on a parking ticket she received. She asked the City to pay more attention to resident's complaints. Ana Maria Barraza congratulated Mayor Morton and Mayor Pro Tern Alatorre on their positions. She commented on the junk around the City and stated that the Council should properly equip the employees. She asked the Council to focus on the meeting instead of interrupting or texting during the meeting. Maria Viera commented on the junk around the City and asked the Council to properly equip the employees. She commented on the department heads and their car allowance. Mr. Porfirio commented on a garage inspection on his residence and on parking tickets he received. James Chapman commented on harassment by code enforcement officers against his business. He stated that he feels alienated and as if the City is trying to drive his business out of the City. Mayor Pro Tern Alatorre commented on the resident's complaint about tire services. He also commented on the employees using trailers instead of heavy duty trucks. Council Member Castro commented on the residents' complaints about employees not being properly equipped. She asked about what the AQMD funds were used for. City Manager Haley stated that an electric vehicle and a charging station were being purchased with the AQMD funds. Council Member Castro also commented on residents advocating on behalf of employees. Lastly, she stated that no City funds are used for the City wide weight loss competition. She directed staff to provide the Council with a report on Mr. Chapman's complaints. Council Member Rodriguez also asked for a full report on Mr. Chapman's complaints. He commented on touring the City with residents. He stated that he was amazed to see how much litter is on the street. He asked that employees report these large trash items for pick up immediately. Council Member Santillan -Beas asked for a report on any equipment that is failing. She commented on the Cash for Chunkers program and stated that no City funds were used for the program. She asked for a green memo report on Mr. Chapman's and Mr. Porfirio's cases. She commented on the parking problem around schools and in the City. Lastly, she commented on the upcoming Plaza Mexico Cinco de Mayo celebration and asked that proper traffic control be implemented. Mayor Morton commented on Mr. Chapman's complaints. He stated that he believed the issue had been resolved. He commented on his own problem with Code Enforcement regarding an iron fence and stated that the City does not pick on any individuals. PUBLIC HEARING Item #8. CONSIDERATION OF AN ORDINANCE REGULATING THE LICENSURE OF TOBACCO RETAILERS Director of Development Services Jonathan Colin introduced the item regarding the consideration of an ordinance regulating the licensure of tobacco retailers. It was moved by Council Member Rodriguez, seconded by Mayor Pro Tern Alatorre, to open the public hearing. Irene Garcia stated she was opposed to the ordinance. She also commented on the drug problem in the City. Alicia Lopez stated that she was the Liaison for the Department of Public Health and she commented on the success of this ordinance in other cities. She stated that she is in favor of the ordinance. Francisco Lazama stated that he was a Project Trust Community Organizer and he commented on working with Lynwood residents and the problem with youth tobacco use. Sheila Kobo stated that she is a speaker for the American Lung Association. She commented on her heart condition exacerbated by second hand smoke. She asked for the City Council's support in passing the ordinance. Laura Geyschuck stated that she was a Public Health Nurse for the Public Health Department. She provided the Council with statistical data on smoking. She stated that she was in support of the ordinance. Ms. Besla stated that she is a Lynwood resident and in support of the ordinance in order to protect Lynwood youth. Margie Harper commented on retailers in Lynwood selling tobacco to minors. She stated she was in support of the ordinance and of Project Trust. It was moved by Council Member Santillan -Beas, seconded by Council Member Castro, to close the public hearing. After discussion by Council, it was moved by Council Member Santillan -Beas, seconded by Mayor Morton, to approve the staff recommendation to introduce the following ordinance for first reading. PROPOSED ORDINANCE ENTITLED: AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA AMENDING THE LYNWOOD MUNICIPAL CODE BY ADDING SECTION 4 -33 TO CHAPTER 4, REGARDING REGULATIONS AND REQUIREMENTS OF THE LICENSURE OF TOBACCO RETAILERS PROPOSED ORDINANCE ENTITLED: AN ORDINANCE OF THE CITY OF LYNWOOD ESTABLISHING A FEE FOR THE LICENSURE OF TOBACCO RETAILERS AYES: COUNCIL MEMBERS RODRIGUEZ, SANTILLAN -BEAS, ALATORRE AND MORTON NOES: NONE ABSTAIN: COUNCIL MEMBER CASTRO ABSENT: NONE Council Member Castro requested that the list of violators be given to the Sheriff's Department. Council Member Rodriguez pulled Item #15 — SPECIAL PERMIT FOR LIVE ENTERTAINMENT; 11004 ATLANTIC AVENUE (CORONA'S GRILL) Council Member Rodriguez commented on the family oriented business and invited residents to visit it. It was moved by Council Member Rodriguez to approve the special permit. Director of Development Services Jonathan Colin stated that the applicant requested to have the entertainment from 7pm to 2am every day. Mayor Pro Tern Castro seconded the motion with the amendment to approve the permit from 7pm to 2am every day. RESOLUTION NO. 2012.089 ENTITLED: A RESOLUTION OF THE LYNWOOD CITY COUNCIL APPROVING LIVE ENTERTAINMENT TO INCLUDE KARAOKE, LIVE PERFORMANCES AND ACCOUSTICAL MUSIC AT THE CORONA'S GRILL RESTAURANT LOCATED AT 11004 ATLANTIC AVENUE IN THE C -3 (HEAVY COMMERCIAL) ZONE, CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AYES: COUNCIL MEMBERS CASTRO, RODRIGUEZ, SANTILLAN -BEAS, ALATORRE AND MORTON NOES: NONE ABSTAIN: NONE ABSENT: NONE Item #16. Council Member Rodriguez pulled Item #16 — SPECIAL PERMIT FOR LIVE ENTERTAINMENT; 11120 ATLANTIC AVENUE ( MARISCOS EL VIEJON) Council Member Rodriguez commented on the success of this business. It was moved by Council Member Rodriguez, seconded by Council Member Castro, to approve the special permit. Director Jonathan Colin recommended that the Council approve the special permit for music inside only, Monday through Thursday from 7pm to 10pm and on the weekends until tam. It was subsequently moved by Mayor Pro Tern Alatorre, seconded by Council Member Santillan -Beas, to approve the special permit with the restrictions. It was subsequently moved by Council Member Castro to approve the special permit with the live music only inside and with the hours of Monday through Thursday from 7pm to 10pm and on the weekends until 2am. Council Member Rodriguez seconded the motion. RESOLUTION NO. 2012.090 ENTITLED: A RESOLUTION OF THE LYNWOOD CITY COUNCIL APPROVING LIVE ENTERTAINMENT TO INCLUDE DJ, KARAOKE AND ACCOUSTICAL MUSIC AT THE MARISCOS EL VIEJON RESTAURANT LOCATED AT 11120 ATLANTIC AVENUE IN THE C -3 (HEAVY COMMERCIAL) ZONE, CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AYES: COUNCIL MEMBERS CASTRO, RODRIGUEZ, SANTILLAN -BEAS, ALATORRE AND MORTON NOES: NONE ABSTAIN: NONE ABSENT: NONE Item #17. TREASURER'S QUARTERLY INVESTMENT REPORT Report received and filed. Item #18. Council Member Santillan -Beas pulled Item #18 — APPROVAL OF THE RESOLUTION ESTABLISHING PARKING AUTHORITY Council Member Santillan -Beas stated that she was against the $75 stipend. It was moved by Council Member Santillan -Beas, seconded by Council Member Castro, to approve the item without the stipend. City Attorney Fred Galante stated that the resolution would be amended to remove the section regarding the stipend. RESOLUTION NO. 2012.091 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACTIVATING THE PARKING AUTHORITY OF THE CITY OF LYNWOOD AYES: COUNCIL MEMBERS CASTRO, RODRIGUEZ, SANTILLAN -BEAS, ALATORRE AND MORTON NOES: NONE ABSTAIN: NONE ABSENT: NONE Item #19. Council Member Santillan -Beas pulled Item #19 — REQUEST FOR ONE- TIME TRAVEL AND MEETING INCREASE Council Member Santillan -Beas stated she was against the increase and made a motion to deny the request. Council Member Castro seconded the motion. After discussion by Council, it was moved by Council Member Rodriguez, seconded by Mayor Morton, to give the City Clerk the funds from Council Member Rodriguez's travel account. After further discussion, it was moved by Council Member Castro, seconded by Council Member Rodriguez to close the discussion. The motion was approved by general consent and roll call was taken on the motion to give the City Clerk the funds from Council Member Rodriguez's travel account. FIRST READING OF ORDINANCE AMENDING COUNCIL MEETING START TIME AND CORRECTING COUNCIL COMPENSATION INFORMATION PROPOSED ORDINANCE ENTITLED: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA AMENDING CHAPTER 2 -1 OF THE LYNWOOD MUNICIPAL CODE TO CHANGE THE REGULAR CITY COUNCIL MEETING TIME AND UPDATE THE COUNCIL REIMBURSEMENT AND COMPENSATION PROVISIONS CONSISTENT WITH PRIOR CITY COUNCIL ACTION CITY COUNCIL ORAL AND WRITTEN COMMUNICATION Council Member Santillan stated the following, "Well since I'm going to add more fuel to the fire, but, I'm sorry, we need to get some action once in a while. You know when I ran in 2003 the first time I ran and I said that my whole thing was about the salaries and how much money was being spent by the previous council and that's why two months ago when an additional stipend was approved by the council I voted against it. Tonight again the Parking Authority an additional $75 stipend was on the agenda for an additional $150 if we meet twice and again I voted against it. Because as an elected official, it is a lot of work but $800, 1 really one day maybe get all volunteers, right now $800, to me, is sufficient so, and that's the reason why I was also, nothing against the City Clerk but, you know, we have a budget it's been approved, it's not fair to other people, I hear residents tell me "there is no toilet paper, how come there's no toilet paper? How come you guys can't buy toilet paper ? ". So we can't buy toilet paper for the bathroom, but we can certify additional staff members in an office where two people should have already been certified so anyways that was my aggravation tonight but thank you and happy Cinco de Mayo. Council Member Castro stated the following, "I just want to say something to staff, as you guys can tell I was really heated under the collar about this whole tobacco thing, since I've been on the council, one of my complaints to the city manager has been that sometimes I feel like half of the stuff on the agenda is fluff and bureaucracy. We did something today based on a non - legitimate study because that's exactly what it was. This isn't over, wait till the actual retailers find out that they have to pay $250 and we're going to hear it and we're not being realistic about the fact that we can't even enforce the stuff that we currently have to enforce, the stuff that we have in the books and here we are adding more responsibility instead of utilizing the resources that we already have. I say all that, to say that, we have so many important things going on in the city and here we are wasting our time with that, when our resident came in showed something to us that to me should be an embarrassment, to us as council, which is "Hey! Your employees are functioning with bad tools, they don't have the necessary tools ". We talk about being business friendly, but every change we get, we want to raise fees on them, when they can barely keep their doors open. We don't do proper research, we don't look around what's going on we're just trusting what one entity has said. And the world that I come from, when you do a debate, you look at the opposing side and the supporting side. We didn't see both sides today; we saw a bunch of fluff of a department within the Public Health Department that got a hold of some grant money so it has to show justification that they're doing something. That's what I saw today, they packed the house with a bunch of non - residents, I mean, it's ridiculous, it was a photo - op opportunity it's laughable, because at the end of the day, this thing wasn't done properly and to me wasting all this staff time would have been more prudent to right away refocus that staff time and working with the Sheriff's Department and saying "Hey! We just found out that some of our retailers are selling to minors" and all our efforts could have been focused with that. That was my frustration and, you know, it's true, why do our residents have to come to us and say "there's graffiti here" "there's a couch there ". We all drive the city, Mr. Alatorre the other day, I think Friday, sent some picture to Public Works about some stuff that he saw, I've done it, I've taken city tours, everybody has taken city tours, I'll wrap up my statement Mayor, but what I'm basically trying to say that a lot of this stuff is common sense and sometimes it feels like staff takes the attitude, well it's not my job and that's not pride, that's not having pride in what we do in our jobs, that not having pride in where we live, where we work, every entity that I ever worked for, I always like to say "I worked for the best company ever ". It may not be true but in my mind I'm giving it my all, because I think it's the best company. If we drive around and we see these blatant evident things and we're not doing anything about it, then shame on us, we're the ones with the problem. Thank you. Council Member Rodriguez stated the following, "I've already said enough Mr. Mayor ". Mayor Pro Tern Alatorre stated the following, "I've been thinking we're going back to public orals because I have forgotten something, so, I'm taking the opportunity, the clock is running. There are things that we complaint about, you know, the City Clerk requesting 15, 17 hundred dollars for educating her staff. It's important to have staff being prepared and knowledgeable on what they do. But yet and I can apologize to staff the way I do it but I get frustrated, when I do a request with the City Manager and he forgets about it, and I get frustrated. I do a reminder and he probably gets a report from his staff, they come up with something that I can always question. So, all these issues is my opinion is lack of supervision, lack of accountability, that we need to have our employees be proud of what they do and take a ownership of the city when they work for the city and that goes for everybody from the top to the bottom. When I don't see that, we got resident complaining. Why? Because they are paying the taxes, same as me and everyone else that lives in the city, that's one thing. But, one of the things that caught my attention, that it was nothing but a game, and I said a game, because the L.A. Times reported how much money the City of Lynwood spends on legal, ok, the current Mayor requested the City attorney to provide a report back before he took the mayorship. I was there. I requested the same report, through the request of the Mayor. I reminded the attorney once, he didn't provide it yet. So, what are we doing here? And I get upset, and don't interrupt me Mr. City Attorney, the L.A. Times brought up a report, that we spent 1.5 million dollars on legal fees. They blamed it on the past council but if you were a treasurer for 4 years, you can see the abuse of the access to the attorney. There is no regulated, no one is watching and if anyone has a question and I've said it for the guy that is missing tonight, he wakes up on the right side of the bed, he calls the attorney, even if he has a personal question. I have confronted them about it, nothing. 1.5. million dollars, L.A. times, I confirmed that because I was the Treasurer I know the average that we spend on legal fees, you can claim it's not only my firm, it's not only, see, 1.5 million dollars. We complain about $1000, $1500 you just add zeros and you can see there is a lot of waste. I'm not saying we don't need legal representation, but there is an abuse: access to the legal system that we have. Mr. Mayor I'm going to wrap it up. That's the way it comes up, and tries to smooth it down. And it gives our legal representative here on the floor to kind of wash it down, white wash it they call it. And I'm upset about it, because I know how much it cost. And why, because of the mistake of past council members, past, the people that are still employed in the City of Lynwood, that hold different positions in the past have cost all this litigation, cause of their mistakes. Millions and millions of dollars, we're not done yet, ok, so one of things, my comments is that we need to watch this, these legal fees need to be reduced, they need to be reduced and the supervisor and the department head need to insure that their department, whenever they need access to the legal and I tell you one thing, I caught one case that often times, there's a gentlemen right here sitting, one of the business owners, that use legal to intimidate residents, ok. Why? Because there is easy access, there are ways to deal this administratively. A lot of these legal expenditures can be done at the level of administration through the City Manager, through the Department Heads, by having conferences with our residents to be in a friendly, I'm not saying ignore the violations, just bring them in, sit down, talk about it, give them the options, and after all the options are put on the table, they're not resolved, then we need legal access to the legal to take action ok, thank you. Mayor Morton stated the following, "I too, would like to thank everyone for coming, we really appreciate, we all have different opinions, sometimes we have questions that's unpleasant for not only staff but also for ourselves. We have to live within ourselves and what we say in this council meeting. I am glad to hear that the Maria Teresa Santillan, when she ran for reelection and defeated Paul Richards in the recall, ran to get rid of his high salary and all of the rest of the councils high salary and all of their wonderful perks that they had at that time and also when she did get on the election didn't take that high salary or didn't vote on additional perks after she was elected. I am very proud to hear her say that because that's what it's all about. This council is trying to make a difference and the only way we can make a difference is: work toward that difference. We need big boxes, the only way we can get big boxes is to get redevelopment money to clean up the dirt so the big boxes can come in. Sixty percent of the employees of those big boxes will be coming from Lynwood. We got a great Redevelopment Director, she's doing a great job, but we do need the Parking Authority because that's part of the big box needs for them to come in as well as cleaning up the dirt. Because we have bonds that we sold for redevelopment, but if we don't get something started pretty soon, the state could come in and take those bonds and pay them off themselves and we won't have anything to work with. So we got to move fast, we don't have any more time to waste. Any way, we thank you all for coming, we really appreciate it and we hope to see you next time, thank you. CLOSED SESSION City Attorney Fred Galante announced that the Council would recess to discuss two closed session items on the City Council agenda.
