A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING
THE VILLAGE MANAGER TO NEGOTIATE AND ENTER
INTO A CONTRACT WITH FIREWORKS BY GRUCCI, INC.
FOR JULY 4TH FIREWORKS DISPLAYS; AND PROVIDING
FOR EFFECTIVE DATE.
WHEREAS, the Village of Key Biscayne ("Village") entered into an agreement in 2012, as
amended in 2013, with Fireworks by Grucci, Inc. ("Grucci") to provide a professional fireworks
display for the Village in celebration of Independence Day (July 4th) (the "Agreement"); and
WHEREAS, Grucci has provided a successful and safe fireworks display for the Village
in accordance with the terms and conditions of the Agreement; and
WHEREAS, the Agreement has now expired and the Village desires to enter into a new
agreement with Grucci for future July 4th fireworks displays; and
WHEREAS, a fireworks display is a professional service and a contract for such professional
services is exempt from competitive bidding pursuant to Village Code Section 2-87; and
WHEREAS, the Village Council finds that this Resolution is in the best interest and welfare
of the residents of the Village.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted
and confirmed.
Section 2. Authorization. That the Village Manager is hereby authorized to negotiate
and enter into a new agreement with Grucci for substantially the same terms and conditions as the
Agreement, subject to approval of the Village Attorney as to legal form, content and sufficiency.
Section 3. Effective Date. That this Resolution shall be effective immediately upon
adoption hereof.
