HomeMy Public PortalAboutResolution 88-1435 PC" " RESOLUTION NO. 88- 1435PC RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING CODE AMEND- MENTS RELATED TO ACUPRESSURE ESTABLISHMENTS. The Planning Commission of the City of Temple City does hereby resolve: Section 1: Based upon a public hearing to consider an amend- ment to the Zoning Code pertaining to the above enumerated matter, the Planning Commission finds: 1. Acupressure is a unique use which is difficult to accommodate within many shopping areas. 2. A survey of other cities indicates a need to regulate this type of business operation. 3. A requirement for a Conditional Use Permit would allow for a case -by -case evaluation of individual applications. 4. The Los Angeles County Sheriff's Office has indicated that many acupressure businesses provide an opportunity for ille- gal sexual activity. 5. The presence of such business establishments and the possible proliferation of such uses could severely impact the charac- ter of the community and the City's relatively small commer- cial area. 6. The locational restrictions provide ample opportunity to locate within the City, while protecting the existing nature of the City's commercial area. The area where acupressure establishments would be permitted consist of approximately seventeen (17 %) percent of all "C" and "M" zoned land within the City. Section 2: It has been determined that this zoning code amendment will not have any significant adverse impact upon the environment and, therefore, a Negative Declaration has been pre- pared in accordance with the State CEQA Guidelines. Section 3: The Planning commission recommends that the Zoning Code shall be amended as follows: 9202. CONDITIONAL USE PERMITS. WHEN REQUIRED. Acupressure establishment as defined in Section 4180.1, subject to locational restrictions set forth in section 9455.
