A resolution certi~ving to the Fraser Board of Trustees approval of a minor amendment in the
Maryvale Planned District Development (PDD) # I, by combining planning areas 4a, 5 and "old"'
planning area 6 into one new planning area, 6.
WHEREAS, Maryvale LLC and a local property owner have been negotiating the sale of certain
portions of the land owned by Maryvale, LLC, said land lying predominately in the Ranch Creek
drainage; and
WHEREAS, Article X of the Maryvale Annexation Agreement, entitled, Transfer of Planning
Area, requires that in order to permit the transfer of any planning area within the Maryvale POD
# I, a subdivi~ion exemption plat approval is necessary and the division of portions of the
property must be consistent with planning area boundaries~ and
WHEREAS, the Town of Fraser"s PDO Ordinance allo\Vs the Fraser Planning Commission to
approve minor changes to an approved PDD if the minor change renects no more than a 10%
change in the design standards identified in the PDD; and
WHEREAS, Fraser Planning Commission Resolution Jd.:::f.jhccepted and approved as a minor
amendment to POD #1, new boundaries for planning areas 4 and.4a~ and
WHEREAS, the new planning area 4a as identified by Fraser Planning Commission Resolution
3 -t!11 is designated below as "old" planning area 4a; and
WHEREAS, the sale of the proposed property requires the consolidation of "old" planning areas
4a, 5, and 6 into one single new planning area 6 to facilitate the subdivision exemption plat~ and
WHEREAS" Maryvale LLC has requested that "old" planning areas 4a, S, and 6 be consolidated
into one new planning area 6 (as identified by the attached exhibit "A ")~
NOW, THEREFORE, BE IT RESOLVED BY THE FRASER PLANNING COMMISSION
THAT THE PLANNING COMMISSION HAS REVIEWED ALL PERTINENT SUBJECT
MATTER AND HAS DETERMINED THAT THE PROPOSED CHANGE TO MAR YV ALE
POD #1 IS A MINOR AMENDMENT TO POD /I I AND IS SO APPROVED.
