NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from CME Associates for engineering services related to the Waterfront Marina, US Army Corps of Engineers and NJ Department of Environmental Protection at a total cost not to exceed $72,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:1 t- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 3. As you are aware, we are in the process of responding to the US Army Corps of Engineers permit review in collaboration with the team of professionals the Borough has assembled. We are also preparing modifications to the overall design to include a reduction in the slip total, along with construction cost estimates for each potential reduction scenario, so that you can decide which option best suits the Borough's needs. Once the permitting issues are resolved with the US Army Corps of Engineers, we will need to further coordinate the Waterfront Development permit review with the NJ Department of Environmental Protection, Office of Dredging and Sediment Technology. With this in mind we offer the following scope of services: ACOE Permit Coordination We anticipate the need to continue the collaborative effort with the assembled team for at least three months, until a permit decision is rendered. It is expected that additional meetings and responses to the ACOE and resource agencies will be needed during the Public Comment period. In addition, proposed changes to the design, including a scope reduction, dock orientation revision or means of stabilizing the post- dredging subaqueous slope will also have to be presented, if formally proposed. Also included in this phase will be the preparation of formal responses to the comments received during the ACOE public comment period. Marina Scope Reduction Plan Modifications and Construction Cost Estimates A number of different marina layouts will be presented, with slip counts ranging from 80 and 190 ( + / -), wherein a mix of larger vessels will be included, as you have prescribed. Each iteration will be accompanied by a construction cost estimate. Their office has not begun a formal review of the submission, because once the review clock is started, they will have to act on the application within a certain timeframe. They have been reluctant to start the review clock without having a favorable review from the ACOE. As with the efforts needed with the ACOE permit review, the NJDEP permit application would have to be revised in the event there are modifications to the plan. Included in this task will be the submission of a modified waterfront development permit application to the NJDEP to include revisions as a result of the ACOE decision. The NJDEP will likely require mitigation for the loss of intertidal- subtidal shallows, beyond the mitigation requirements of the ACOE. The mitigation will have to be accomplished either on a property offsite, or through the purchase of credits at an approved mitigation bank. This fee estimate does not include the planning or design of offsite mitigation. Fee Estimate 1.
