HomeMy Public PortalAboutResolution 88-1464 PC" " " RESOLUTION 88- 1464PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY AMENDING THE ZONING CODE TO EXCLUDE CERTAIN PROPERTIES WITH STREET FRONTAGE ON BOTH SIDES OF HALIFAX ROAD BETWEEN DAINES DRIVE AND LIVE OAK AVENUE FROM SECTION 9119(L) AND 9333 RELATING TO LARGE R -1 LOT SPLITS. The specific properties affected by the proposed Code Amendment are legally described as follows: Lots 1 through 12 of Block A; Lots 4, 8 through 11, and a portion of Lots 1 through 3, 5 through 7 of Block B, all within Tract No. 11695 as recorded in Map Book 215, pages 23 and 24, of Maps in the Office of the County Recorder, County of Los Angeles, State of California. The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing to consider an amendment to the Zoning Code pertaining to the exclusion of certain R -1 Zoned lots on Halifax Road legally described above, the Planning Commission finds: 1. That the rural character of the residential neighborhood on Halifax Road between Daines Drive and Live Oak Avenue, which has been created by large estate type lots could be substantially impaired if flag lot subdivisions are per- mitted in the neighborhood; and 2. That flag lots would be inappropriate in this particular neighborhood in that there are no other flag lot subdivi- sions found in the subject area; and 3. That the petitioners requesting the Ordinance amendment represent 65% of the lots in the subject area, which dem- onstrates substantial support for the Code Amendment; and 4. That passage of the Ordinance would not be to the detri- ment of the public's health, safety and general welfare in that the subject neighborhood would essentially remain status quo. Section 2. It has been determined that this Zoning Code Amendment would not have any significant adverse effect upon the environment; therefore, a Negative Declaration is prepared in accordance with the State CEQA Guidelines. Section 3. The Planning Commission recommends that the Zoning Code be amended as follows: RESOLUTION 88- 1464PC PAGE 2 CODE AMENDMENT • lows: • • 9119 "L" Section 9119. 4. d. is hereby amended to read as fol- 4. d. A parcel of real property lawfully created and dimensioned in accordance with City ordinances prior to January 1, 1967. The minimum frontage upon a public street or high- way for R -1 zoned lots shall be 60 ft. except for cul -de -sacs and knuckles, in which cases the mini- mum frontage may be reduced to 35 ft. provided the average lot width is 60 ft. Exception: R -1 zoned lots in existence on the effective date of this Ordinance (May 5,m 1988) may be subdivided subject to the following restrictions: 1) No existing lot shall be subdivided into more than two lots. 2) Each subdivision shall be subject to the ap- proval of a Parcel Map. 3) The original existing lot to be subdivided shall have a street frontage of at least 70 feet but less than 100 feet, and 4) Each subdivision shall be limited to the crea- tion of no more than one flag lot, with a minimum street frontage of 15 feet, and 5) A minimum of 7,200 square feet of lot area shall be provided per newly created lot, ex- clusive of any "pole" portion of a flag lot." 6) No such "flag lot" subdivision shall be cre- ated on Halifax Road between Daines Drive and Live Oak Avenue, legally described as Lots 1 -12 of Block A; Lots 4, 8 -11, and a portion of Lots 1 -3, 5 -7 of Block B all within Tract 11695 as recorded in Map Book 215, pages 23 and 24 of Maps in the Office of the Recorder, County of Los Angeles, State of California. 9333. STANDARDS OF DEVELOPMENT Section 9333. A. 3. is amended to read as follows: A. 3. "Provided that no lot shall be created after hav- ing the effective date of these regulations having less than 7,200 square feet of lot area, excluding " " RESOLUTION 88- 1464PC PAGE 3 CODE AMENDMENT areas used for easement driveways serving other properties, and the "pole" portion of any flag lot created as a result of a subdivision of an R -1 zoned lot in existence on the effective date of this Ordinance; such subdivision shall be limited to the splitting of an existing lot into no more than two (2) lots." Section 9333 B. is amended to read as follows: B. "Lot Width. Each lot or parcel of land in Zone R -1 shall have a minimum lot width of not less than 50 feet, provided that no lot shall be cre- ated after the effective date of these regulations having a lot width of less than 60 feet. Exception: R -1 zoned lots in existence on the effective date of this Ordinance (May 5, 1988) may be subdivided subject to the following restrictions: a. no existing lot shall be subdivided into more than two lots. b. Each subdivision shall be subject to the ap- proval of a Parcel Map. c. The original existing lot to be subdivided shall have a street frontage of at least 70 feet but less than 100 feet, and d. Each such subdivision shall be limited to the creation of no more than one flag lot, with a minimum street frontage of 15 feet, and e. Section 4. The Secretary shall certify to the adoption of this Resolution.
