AUTHORIZING AN EXTRAORDINARYrUNSPECIPIABLE SERVICES
CONTRACT WITH APPLIED TECHNOLOGY AND MANAGEMENT, INC. —
MARINA MARINE RISK ANALYSIS -
WHEREAS, the Borough of Carteret, ( "Borough "), requires extraordinary, unspecifiable
expert consulting services with regard to the proposed Marina project at Carteret
Waterfront Park; and
WHEREAS, Applied Technology and Management, Inc., P.O. Box 20336, Charleston,
SC, 29413, is uniquely qualified to provide the required Risk Assessment Analysis with
regard to Tasks 1, 2, 3 S 6 of the navigational hazards and risks that would be associated
with the operation and enjoyment of the proposed Carteret Marina and with regard to the
permitting therefore; and
WHEREAS, the Borough has received a proposal from Applied Technology and
Management, Inc., to provide said services at a cost not to exceed $117;200.00 in
accordance with Change Order #1 dated March 3, 2014; and
WHEREAS, the Mayor and Council have reviewed said proposal and the Borough
Engineer has recommended the approval of the same; and
WHEREAS, the Chief Financial Officer has certified that finds are or will be available
for the saute.
NOW, THEREFORE BE IT RESOLVED by the Nfayor and Council of the Borough
of Carteret as follows:
The proposal from Applied Technology and Management, Inc., to
provide extraordinary, unspecifiable services in connection with
the Proposed Marina Marine Risk Analysis with regard to Tasks 1,
2, 3 & 6 at Carteret Waterfront Park in an amount not to exceed
$117,200.00 in accordance with Change Order 41 dated March 3,
2014 is hereby approved, and the Borough's Law Director is
hereby authorized to enter into an Agreement with Applied in a
form acceptable to him.
2. This action is approved without competitive bids as an award of an
extraordinary, unspecifiable services contract.
A copy of this resolution shall be forwarded to the Borough's
Purchasing Department and CME Associates.

This is to request your approval of a Resolution
authorizing a contract to be executed as follows:
Expert Consulting Services -Risk Analysis
Firm: Applied Technology and Management, Inc.
Cost: $117,200
Period: 1/01/14 - 12/31/15
Purpose: Expert consulting services associated with the
operation of the proposed Carteret Marina and with regard to the
permitting thereof.
This is requested to be awarded without competitive bids as an
extraordinary, unspecifiable service (N.J.S.A 40A:11 -5 (lii)(a)).
I do hereby certify as follows:
1. Quotations have been solicited and are stated above:
2. Expert Marine Consulting Services is specialized and
qualitative in nature requiring expertise, extensive training and
proven reputation.
3. This can not be described by written specifications because:
It is not reasonably possible to draft specifications to meet the
Federal /State and Borough requirements of all the various Marine
permitting issues and administration thereof.
4. I have reviewed the rules and regulations of the Division of
Local Government Services as contained in the local public
contract guidelines (revised) and certify that the proposed
contract may be considered as an extraordinary, unspecifiable
service in accordance with the requirements thereof.
