COMMON COUNCIL CITY OF RICHMOND, INDIANA ORDINANCE NO. 59-2018 A SPECIAL ORDINANCE PROHIBITING NEEDLE EXCHANGE PROGRAMS IN RESIDENTIAL AREAS WHEREAS, The Richmond Common Council is aware of Wayne County, Indiana Government's objectives in decreasing the spread of hepatitis C and HIV contracted through the use of syringes, as well as to provide a contact point to encourage users to seek treatment, which objectives, in August, 2016, manifested in what is often referred to as a "needle exchange program; and WHEREAS, The Richmond Common Council understands that Wayne County's needle exchange program will extend through June of 2020; and WHEREAS, Wayne County Government is operating the needle exchange program at locations within the corporate limits of the City of Richmond, Indiana, which includes, but is not limited to residential areas; and WHEREAS, When considering that the needle exchange program is designed to attract users of illicit substances to specific areas within the city for the purpose of providing clean syringes, which carries with it the potential for used syringes being improperly discarded by its user in the area in which new syringes are being provided, as well other potential detrimental unintended effects, the Richmond Common Council desires to institute certain limitations in order to ensure that the residential areas of the City of Richmond are not exposed to such outcomes. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as follows: Any needle exchange program, or other undertaking designed to furnish clean syringes or other devices which are utilized to ingest illicit substances for which the user has not secured a valid prescription from a licensed medical professional, regardless of the identity of the entity or person which is implementing such a program, is prohibited in any residential district within the corporate limits of the City of Richmond, Indiana as defined by Article 2 of its Unified Development Ordinance. 2. Any needle exchange program operating within a residential district within the City of Richmond, Indiana at the time of the adoption of this Ordinance shall receive "grandfathered" status; and as such, shall continue to be permitted to operate in a residential district; however, if, at any point in time, such a program ceases operation, its grandfathered status shall be removed and the entity or person(s) which previously operated the program will be subject to the prohibitions set forth within this Ordinance.
