HomeMy Public PortalAboutResolution 89-1486 PC" " RESOLUTION 89- 1486PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DENYING ZONE VARIANCE 89 -980 TO ALLOW THE CONSTRUCTION OF A SECOND SINGLE -STORY DWELLING UNIT ON AN R -2 ZONED LOT WITH A 10 FOOT 6 INCH WIDE DRIVEWAY RATHER THAN THE MINIMUM REQUIRED 16 FOOT WIDE DRIVEWAY TO SERVE THE FIVE (5) REQUIRED PARKING SPACES AT 4816 HALLOWELL AVENUE. The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon the public hearing for the above Zone Variance, the Planning Commission finds: 1. That there are no exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of such property which do not generally apply to other properties in the same zone in that the subject lot contains 8,250 square feet of area consisting of a width of 50 feet and a depth of 165 feet which is similar in size and shape to several other lots in the immediate area; and 2. That such variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated which is denied to the property in question in that other similar variance re- quests in the immediate area have been denied and other similarly sized parcels have been improved with two dwell- ing units without benefit of a Zone Variance; and 3. That the granting of the variance will be materially detrimental to the public welfare or injurious to the adjacent property in that the reduced driveway width will impede vehicular ingress and egress and could result in additional on- street parking which could impact the sur- rounding neighborhood; the rather narrow width would result in difficult ingress and egress to the required parking area; the existing driveway width is able to accommodate one family living on the lot, however, it is inadequate in width to accommodate a two family develop- ment and the resultant driveway usage; and 4. That there are no special circumstances as provided in Section 65906 of the California Government Code in that the subject lot is 50 feet wide by 160 feet deep, is generally rectangular and level and possesses no peculiar or unusual characteristics which would differentiate this lot from several lots along Hallowell Avenue and elsewhere " " RESOLUTION 89- 1486PC PAGE 2 ZONE VARIANCE 89 -980 throughout the City; additionally, the existing house can be structurally modified and remodeled so as to provide the minimum required driveway width for two (2) dwelling units on a single lot. Section 2. This project is categorically exempt per Section 15305 of the CEQA Guidelines. Section 3. Accordingly, Zone Variance 89 -980 is denied. Section 4. The secretary shall certify to the adoption of this Resolution.
