The obligation to have a buffer is on him. I would include his note in the agenda package with the agenda item as I put it & let council decide whether to modify what they had said. I thought his neighbor did not want it as high as the ordinance reads but if he is talking about it having less length along the boundary, council would have to consider whether that will suffice under the special review part. They may not. When these come along in the future in the corridor, the applicant should be seeking special review & site plan approval. The problem here is I think this only came up in the context of his alcohol /entertainment request not as a building issue. Although there was once a draft of an ordinance for entertainment licenses to be reviewed in the context of conditional approvals, it was rejected.... This requirement caught me off guard. I was not prepared to present findings that may cause council to look at the fence that is already in place (50'). That straddles the property line, on the eastern end, as meeting the requirement of being built with eight foot materials. Photo showing built to the same height as the new fence just installed on the property next door. Therefore meeting the requirements as a buffer. To build another fence would cause destruction of the greenery that is in place.( photos attached) The other hundred foot of fence has been requested to be build to approximately 72 feet by Travis Williams in an attached note. The Georgia Environmental Protection Division administers the rules. In most cases, the rules require both the owner and the involved contractors to assure the portion of the building involved in the project is thoroughly inspected by an Accredited Asbestos Inspector for materials that contain asbestos; and the removal of the asbestos before renovation, wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed demolition notification from be submitted 10 workings days in advance even if no asbestos is present in the building.
