THIS SUPPLEMENTAL AGREEMENT, made and entered into this day of
2018, by and between RUNDELL ERNSTBERGER ASSOCIATES, INC, Indianapolis,
Indiana, hereinafter referred to as the "CONSULTANT", and the City of Richmond, IN, hereinafter referred to
as the "LOCAL PUBLIC AGENCY" or "LPA"
WHEREAS, on February 2, 2014, the LPA entered into a Contract with the CONSULTANT for
services required for development of Contract Plans for the construction of the Richmond Stellar Streets Project,
Richmond, Indiana, INDOT Project Des. No. 1382810, herein after referred to as the Contract, and
WHEREAS, on March 9, 2017, the LPA and the CONSULTANT agreed to amend the Contract with
Contract Supplement No. 1, and
WHEREAS, the LPA and the CONSULTANT have determined that an additional modification of the
Contract is required to include additional compensation related to post -bid design changes, and
NOW, THEREFORE, the parties agree that the Contract shall be modified by this Contract Supplement
No. 2 in accordance with the following:
Appendix D of the Contract shall be modified as follows:
Appendix D, Section A, paragraph 1, shall be MODIFIED to read:
"1. The CONSULTANT shall receive as payment for the work performed under this Contract the
total fee not to exceed $782,180.00 in accordance with the . following Fee Schedule, unless a
modification of the Contract is approved in writing by the LPA."
Appendix D, Section A, paragraph 2, shall be MODIFIED to read-
"2. The CONSULTANT will be paid for the work performed under this Contract as indicated in the
following Schedule of Fees:
a. Environmental Documentation, as indicated in Appendix A, Paragraph A $86,330.00
b. Field Surveying, as indicated in Appendix A, Paragraph B $81,300.00
c. Preliminary Engineering Report, as indicated in Appendix A, Paragraph C $15,000.00
d. Design and Construction Documents, as indicated in Appendix A, Para. D $565,300.00
e. IDEM Rule 5 Permit, as indicated in Appendix A, Paragraph E* $11,550.00
f. Geotechnical Investigation, as indicated in Appendix A, Paragraph F $16,830.00
g. ReimbursableExpenses** $5,870.00

Dear Mr. Stiens:
As requested, Rundell Ernstberger Associates, Inc. is pleased to provide the following
proposed modification to the LPA- Consultant Agreement for the Richmond Stellar Streets
Project.
Contract Supplement No.2 is for the additional work that is required to complete changes to
the construction documents related to the City of Richmond's request for post -bid revisions
to redesign the intersection of Main and 2W Streets as well as the northwest corner of the
intersection of Main and 3rd Streets.
The proposed revisions related to the Main and 2"d Streets intersection include eliminating
curb extensions along 2"d Street, eliminating curb islands intheSE corner of the intersection
between the cycle track and the roadway, eliminating all work on the NE corner of the
intersection'and eliminating parking on the south side of Main Street between 2"d Street and
3rd Street. The proposed geometric revisions will also eliminate drainage structures 304 and
305.
The proposed revisions on the northwest corner of the Main and 3rd Streets include
reconstructing the sidewalk and curb ramp to meet ADA/PROWAG standards. The
reconstruction of this area was not included in the original scope of the project because
portions of the ramp and sidewalk are outside of the right-of-way. In an effort to eliminate
work outside of the right-of-way, the City originally elected not to reconstruct this area. The
City has since confirmed that they in fact own the adjacent property and want to reconstruct
the sidewalk and curb ramp on this corner.
The requested revisions will impact the plan & profile, construction details, layout plans,
sidewalk ramp details, planting plans, pavement marking & signing details, structure data
table, pipe material table and signing table plan sheets. Updates to the quantity calculations

and cost estimate will also be required. Level one design criteria, turning movement,
intersection sight distance and accessibility (ADA) design computations will be reviewed. No
additional pavement design, maintenance of traffic design, utility coordination, categorical
exclusion or Rule 5 permit work is anticipated. After approval of the proposed revisions by
the City and INDOT, all revised plan sheets and files will be uploaded to the INDOT ERMS
website as part of an official Construction Change.
Based on the above scope of work we have worked with our subconsultants to determine
the time and effort it will take to make these changes. We propose that Appendix D of our
contract be amended to reflect an additional fee of $31,800.00 for these services. The
attached worksheets provide a detailed estimate of the tasks and staff hours to complete
these services. We propose to invoice theseservices on an hourly basis.
Attached is Contract Supplement No.2 that will modify our LPA-Consultant Agreement to
include the work described above. If the terms of this supplement are agreeable to you,
